116. Regulation of the Federal Minister for Economic Affairs, Family and Youth on signs for accredited conformity assessment bodies and for the national accreditation body Accreditation Austria (Accreditation Mark Regulation 2013-AkkZV 2013)

Due to § 4 (3) Accreditation Act 2012-AkkG 2012, BGBl. I No 28/2012, shall be arranged:

§ 1. The accreditation mark according to the Annex shall consist of:

1.

the basic character,

2.

a specific inserted identification number for the relevant conformity assessment body in the basic sign of accreditation Austria; and

3.

a combination of numbers and letters, inserted into the mark of accreditation Austria for the respective conformity assessment body, on the nature of the conformity assessment activities (indication of the relevant harmonized products) Standard (s) referred to in Article 2 (9) of Regulation (EC) No 765/2008 laying down rules for the accreditation and market surveillance relating to the marketing of products, OJ L 327, 31.12.2008, p. No. 30), as well as any additional distinguishing features required.

§ 2. Each accredited conformity assessment body shall be accredited by accreditation Austria for each type of accredited conformity assessment activity a one-off accreditation sign made up of the components listed in section 1 above mandatory.

§ 3. The accreditation mark according to § 2 may be used exclusively by the accredited conformity assessment body. The mark shall not be altered in its appearance and in its colour, but may be reproduced in a proportional manner or in a reduced manner, the minimum size of which shall not be less than 15 x 15 mm.

§ 4. (1) The accredited conformity assessment bodies shall refrain from conducting the accreditation mark with anything that could lead to a misinterpretation of the nature and scope of the accreditation.

(2) Where a conformity assessment body is accredited for a number of conformity assessment activities, only that accreditation mark may be affixed to reports and certificates which are accredited to the relevant accredited conformity assessment activities.

(3) In the case of reports and certificates, services which are provided outside the scope of accreditation are clearly identifiable as such.

(4) The application of the Accreditation Mark shall not be permitted if there are no results from accredited conformity assessment activities, and no results from accredited conformity assessment activities.

§ 5. The basic sign is used as a logo by the national accreditation body. This logo may only be used by accreditation Austria.

§ 6. Up to 30 November 2013, the currently pre-defined accreditation marks may be used in accordance with the Accreditation Mark Ordinance, BGBl. II No 380/2008 and in accordance with § § 5 and 6 of the Calibration Service Ordinance, BGBl. No 42/1994 in the BGBl version. II No 490/2001 shall be used.

§ 7. This Regulation shall enter into force on 1 May 2013; at the same time, the Accreditation Mark Ordinance (BGBl) shall be entered into force. II No. 380/2008 and § § 5 and 6 as well as the facility of the Calibration Service Ordinance, BGBl. No 42/1994 in the BGBl version. II No 490/2001.
