Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, which declares the collective agreement of the Austrian Red Cross (ÖRK collective agreement for 2013) on the statutes of the German Federal Ministry of Labour, Social Affairs and Consumer Protection

The Federal Office of the Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 18 (1) of the German Labour Constitution Act, BGB No. 22/1974, in the version of the Federal Law BGBl. I n ° 71/2013 authorized, at the request of a collective contractual body, the party of a collective agreement, in the presence of the conditions set out in paragraph 3 above, to this collective agreement by declaration of statutes also outside its the spatial, professional and personal impact of a legally binding effect.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has adopted the following statutes by decision of 6 May 2013 following the implementation of a senate hearing:

Scope of the Statute

§ 1. The statutes shall apply

a)

Technical: for providers of rescue and ambulance services, with the exception of mountain, water, caves, flight rescue services and rescue hundestaffel

b)

Spatial: for the Republic of Austria

c)

Personal: for all employers in the technical field of application as well as the employees and apprentices employed by these employers in the territorial scope, provided that their employment relationships are not covered by a valid collective agreement (excluding collective agreements according to § 18 para. 4 ArbVG).

Content of the Statutes

§ 2. (1) The agreement between the Austrian Red Cross and the Austrian Trade Union Confederation, trade union of private employees, pressure, journalism, paper and trade union VIDA,

Collective agreement concerning the amendments of the collective contract of the Austrian Red Cross from 1. Jänner 2013
(ÖRK Collective Contract Final 2013),

at the Federal Ministry of Labour, Social Affairs and Consumer Protection under the register number KV 124/2013 and published in the "Official Journal of the Wiener Zeitung" of 2 April 2013,

shall be declared a statute.

(2) Provisions shall be excluded from the terms of the statutes, insofar as they relate to subject areas outside of the provisions of § 1 lit. a listed subject areas.

(3) In addition, the amendments contained in the agreement to the federal country-specific annexes shall be declared for the respective Land referred to therein, with the following exceptions to the statutes:

Section V (1) and (4),

Section VI, Z 4,

Section VII, Z 3 and 4.

Beginning of the effectiveness and duration of the Articles of Association

§ 3. (1) The date of effectiveness of the Articles of Association shall be 1 April 2013. The term of validity of the Articles of Association shall be governed by the period of validity of the Treasury Collective Agreement.

(2) Increments in wages or salaries carried out on the basis of the entry into force of the collective agreement in question from 1 onwards. January 2013 until the statutes have been released, can be applied to the actual wage or salary. The amount of salary increase which is made by the declaration of statutes is credited.
