153. Regulation of the Federal Minister of Health, amending the Regulation on the Food Safety Council

Pursuant to Section 70 (4) of the Food Safety and Consumer Protection Act-LMSVG, BGBl. I n ° 13/2006, as last amended by the Federal Law BGBl. I No 95/2010, shall be arranged:

The food expert's regulation, BGBl. II No 161/1997, shall be amended as follows:

1. § 1 reads:

" § 1. Persons who may be used for the independent elaboration of expert reports in the Agency according to § 65 LMSVG must be subject to the conditions laid down in § § 2 to 4 of the scientific vocational training and practical training. "

2. § 2 reads:

" § 2. For the scientific professional education, the degree of degree, consecutive master degree or doctorate degree of a national university or university of applied sciences or an equivalent degree in a member state or a contracting state of the EU or EEA State or Switzerland in a training corresponding to the desired activity, such as, for example, chemistry, biology, pharmacy, medicine, veterinary medicine, food and biotechnology, nutritional sciences, or one in Austria nostrified equivalent foreign degree, proof of consecutive master degree or doctoral degree. "

3. § 3 reads:

" § 3. For practical training, it is necessary to demonstrate a practical activity in the field of goods subject to the LMSVG, from which it is necessary to carry out practical work on the territory of the LMSVG, after a degree of diploma, consecutive degree of degree, doctorate degree or equivalent degree. , it is possible that investigations can be carried out and opinions can be reimbursed in accordance with the provisions of the food law; with regard to Group F of Annex , a corresponding experience in the field of toxicological assessments shall be established. "

4. In § 4 (1) and (2), the expression "§ 3 (1)" by the expression "§ 3" replaced.

5. The previous § 5 is deleted.

6. § 6 receives the name "§ 5." and reads:

" § 5. If necessary, the Federal Minister of Health shall, at the request of a national of a Member State or a Contracting State of the EU or the EEA State or Switzerland, decide whether a certificate of competence with regard to the qualifications of the Member State or States of the European Union Skills and knowledge mediated or certified in accordance with the requirements of § 1. "

7. § 7 shall be replaced by the name "§ 6." .

8. In group E Z 12 and F Z 13, the word sequence shall be "Food Law 1975" through the phrase "Food Safety and Consumer Protection Act-LMSVG" replaced.

9. The note shall be deleted in the Appendix.
