133. Statement by the Federal Chancellor on the annulment of a phrase in section 24 (3) of the last sentence of the Code of Lawyers by the Constitutional Court

According to Art. 140 (5), (6) and (7) B-VG, and in accordance with § 64 (2) and § 65 of the Constitutional Court Act 1953, BGBl. No. 85, is made known:

The Constitutional Court, with the recognition of 11 June 2013, G 31 /2013-10, G 32-33/2013-8, V 20-28/2013-4, delivered to the Federal Chancellor on 16 July 2013, was rightly recognized under Spruchpunkt I.:

In § 24 (3) last sentence of the Bar Code, RGBl. No. 96/1868 in the version BGBl. I n ° 141/2009, the phrase '; the same applies in the case of a vote made in a plenary assembly' as unconstitutional.

The repeal shall enter into force with the expiry of 30 June 2014.

Previous legal provisions do not enter into force again.

The one at Spruchpunkt I.1. is the subject of the proceedings before the Constitutional Court on 11 June 2013, in which regulations are prejudicial to the application of the Regulations referred to in point I.1 of the Court of Appeal. , and no longer to apply. "
