144. Federal law amending the FNG-Adaptation Act, the Foreigners Restructuring Act, the BFA procedural law, the Asylum Act 2005 and the Foreigners Police Act 2005

The National Council has decided:

Article 1

Amendment of the FNG-Adaptation Act

The FNG-Adaptation Act, BGBl. I n ° 68/2013, shall be amended as follows:

1. In Art. 3 Z 2, the word sequence shall be "already in the country of origin" through the phrase "has already existed in the country of origin" replaced.

2. In Art. 3 the following Z 15 is added after Z 14:

" 15. § 75 is added after paragraph 22 of the following paragraph 23:

" (23) statements made in accordance with § 10 in the version before the Federal Act BGBl. I n ° 87/2012 have been issued within 18 months from the departure of the foreign. These expultions shall be deemed to be a period of residence in accordance with the 1. or 3. Section of the 8. Main piece of the FPG in the version according to the Federal Law BGBl. I No 87/2012. '

3. Art. 5 Z 30 reads:

" 30. In section 37, paragraph 4, the word order shall be "the Federal Office of Foreign Affairs and Asylum" through the phrase "the State Police Directorate" and the quote "§ 73 (1) AVG" by quoting "§ 8 VwGVG" as well as the word order "the Federal Office for Foreign Affairs and Asylum" through the phrase "the State Police Directorate" replaced. "

Article 2

Amendment of the Tourism Restructuring Act

The Tourism Restructuring Act (FNG), BGBl. I No 87/2012, shall be amended as follows:

1. In Art. 3 Z 46, before the word sequence "or an expulsion pursuant to § 66 FPG" the phrase ", an arrangement for the non-national application in accordance with § 61 FPG" inserted.

Article 3

Amendment of the BFA procedural law

The BFA-procedural law (BFA-VG), BGBl. I No 87/2012, as last amended by BGBl. I n ° 68/2013, shall be amended as follows:

1. In § 9 para. 5 the quote shall be: "53 (1a)" by quoting "53" replaced.

2. § 22a is added in accordance with section 4 of the following paragraph 5:

"(5) An idea is not admissible against the arrangement of the thrust."

3. § 56 is added in accordance with section 4 of the following paragraph 5:

" (5) § § 9 (5) and (22a) (5) in the version of the Federal Law BGBl. I n ° 144/2013 are due to 1. Jänner 2014 in force. The orders of the Federal Law BGBl. I n ° 144/2013 are to be understood as referring to the version of this federal law, which it is through the FNG-Adaptation Act, BGBl. I n ° 68/2013. "

Article 4

Amendment of the Asylum Act 2005

The Asylum Act 2005 (Asylum G 2005), BGBl. I n ° 100, as last amended by the BGBl. I n ° 68/2013, shall be amended as follows:

1. In § 12a (1) (3), after the phrase "recently recognized" the phrase "and, since the decision in accordance with § 5, the circumstances in the competent other State have not significantly deteriorated with sufficient probability in view of Article 3 of the ECHR." inserted.

Article 5

Amendment of the Tourism Act 2005

The Foreign Police Act 2005 (FPG), BGBl. I n ° 100, as last amended by the BGBl. I n ° 68/2013, shall be amended as follows:

1. § 114 is added in accordance with section 6 of the following paragraph 7:

"(7) Paragraph 1 to 4 shall apply to criminal offences committed abroad, irrespective of the criminal laws of the crime scene, if Austrian interests have been violated by the act."
