171. Federal law amending the Food Safety and Consumer Protection Act

The National Council has decided:

The Food Safety and Consumer Protection Act-LMSVG, BGBl. I n ° 13/2006, as last amended by the Federal Law BGBl. I n ° 80/2013, shall be amended as follows:

1. In Section 81 (3), the word order shall be "with a fine of up to 360 daily rates" through the phrase "with a custodial sentence of up to six months or a fine of up to 360 days ' sentences" replaced.

2. In § 90 (1) to (4), the word order shall be "20 000 euro" through the phrase "50 000 euro" and the phrase "40 000 euro" through the phrase "100 000 euro" replaced.

3. In Section 90 (1), the following sentence shall be inserted:

" In the case of intentional violations of Z 1 and 2, which are committed in the knowledge of the illegality of the action, if the consequences of the transgressive are not insignificant, a fine of at least 700 euros, on repetition of 4000 The euro shall be fixed. In the event of incrimination, a replacement custodial sentence of up to six weeks shall be fixed. "

4. In § 90 (2), the following sentence shall be inserted at the end:

5. The following paragraph 20 is added to § 95:

" (20) On criminal acts which before the entry into force of § 81 (3) and § 90 (1) to (4) in the version of the Federal Law BGBl (Federal Law Gazette).
