253. Decree of the Federal Minister for science and research, the knowledge balance regulation 2010 modifies the

On the basis of § 13 para 6 and 16 para. 6 of the Federal Act on the organisation of universities and their studies (universities Act 2002 - UG), Federal Law Gazette I no. 120/2002, as last amended by Federal Law Gazette I no. 176/2013, is prescribed:

The knowledge balance regulation 2010 - WBC 2010, Federal Law Gazette II No. 216/2010, no. 292/2012 is as follows in the version of regulation BGBl. II changed:

1 in § 4 par. 1 lit. e is for Word and string "Research clusters and networks;" the word and string "Large-scale research infrastructure;" inserted.

2. in article 4, par. 1 lit. f the word and string "Status of implementation of the Bologna" is replaced by the word and string "institutional implementation of the measures and objectives of the European higher education area (Bologna process), focusing on the professional qualifications with regard to the future employability of graduates and graduates".

3. in article 4, par. 1 lit. g is for Word and string "Measures to improve the social mobility;" the word and string 'measures to promote diversity in the student groups (origin, social and cultural affiliation, individual learning pathways, disability);"inserted.

4. § 4 par. 1 lit. i is as follows:



i)

5. § 4 par. 1 lit. l is as follows:

11. in section 4, paragraph 14, the term "Totals" is replaced by the term "Total row".

12 15 the following paragraph is added to article the 4:

              "(15) as far as the levying of the key figure" 3.B.3 number of patent applications, patents granted, recovery-spin-offs, license, options and sales contracts "in the respective reporting year in all stratification characteristics the value evaluates to zero, may waive the University at the publication of the intellectual capital report pursuant to § 11 of the representation of the code." A delivery of the code and its interpretation in accordance with § 6 has to be carried out in any case."

16 paragraph 3 deleted § 5.

17 pursuant to section 5, the following § 5a along with heading shall be inserted:

"Optional key figures

§ 5a. (1) the universities can for individual performance graphically, in particular in the context of the performance agreement, in article 4, paragraph 1 lit. Areas to (m) a further key figures add (optional data).

(2) If optional key figures in addition to a representation in the intellectual capital report in the data warehouse documented higher education of the Ministry of science and research and to provide, this is as far as allowed to serve higher education with regard to the representation of the universities in the Austrian higher education area or the appearance of individual or several universities make sense to extend the data warehouse and complement, and para 3 to 5 correspond to the requirements.

(3) the documentation and provision of optional measures referred to in paragraph 2 requires a joint proposal of all universities shown in this figure. Anyway, to include in the proposal are the following criteria:



1. justification, to what extent these optional indicator representing the universities in the Austrian higher education area or the appearance of individual or several universities can be usefully expanded or supplemented, 2nd definition according to the nomenclature of code shown in Appendix 1, and 3 data structure according to the guidelines of the Federal Ministry for science and research in accordance with article 6, paragraph 1.

The proposal for inclusion of an optional code has to be that for the first time subject to the documentation of the optional indicator in the data warehouse will be higher education of the Ministry of science and research no later than June 30 of that year. The proposal requires the approval of the Federal Ministry for science and research. The change in the definition of the code requires a renewed proposal from all universities pictured in the code and the approval of the Federal Ministry for science and research.

(4) as far as the Federal Ministry for science and research of the representation of an optional code higher education has agreed to in the data warehouse, is the appropriate optional code at least for a period of three years to provide at the universities. Is a further representation is no longer desired by one or several universities, providing the optional code may be suspended pictured universities after the three reporting years are to be rendered up to June 30 of that year, that no longer, higher education should be represented in the data warehouse, by notice in writing to the Federal Ministry for science and research, and the other in the code. An optional figure, representing several universities, can be continued after the withdrawal of one or more universities, under the proviso that the informative value of the ratio is maintained, the remaining University or the remaining universities. This requires a written notification to the Federal Ministry of science and research within four weeks and the consent.

(5) optional ratios that higher education of the Ministry of science and research are represented in the data warehouse, the provisions relating to the delivery of key figures and data clearing in accordance with § 6 shall apply."

18 paragraph 6 ABS. 3:


"(3) the figures" 1.C.2 proceeds from F & E projects/projects of development and development of the arts in euro "," 1.C.3 investments in infrastructure in the F & E area/field development and development of the arts in euro ","1.4 proceeds from license, options and sales contracts and recovery-spin-offs in euro", as well as"1.5 proceeds from private donations in euros"are to provide no later than 15 April of each year to the Federal Ministry of science and research together with the corresponding interpretation. The other key figures are to provide no later than 15 March of each year together with the related interpretations. The transfer has to be done about the interface in accordance with paragraph 1."

19 paragraph 8 section 1:

"(1) for those key figures that are to raise science branches, the Austrian classification of science activities 2012 (Statistik Austria) in annex 2 is to be used." The classification of the branches of art also takes place in accordance with Annex 2."

20. in article 9, paragraph 1, the word and string is "2.6 testing active ordinary students enrolled in Bachelor, master and diploma studies" through the word and string "2.6 testing active Bachelor's, Diplom and master studies" and the word and string "2.A.10 ordinary student success rate" replaced by the word and string "2.A.10 study completion rate".

Following code is added to 21 section 9, paragraph 1:

"1.5 proceeds from private donations in euros"

22. the existing text of § 11 receives the sales designation (1).

23 § 11 the following paragraph 2 is added:

27 paragraph 1 to 3 and 5 are eliminated § 15. The previous paragraph 4 is paragraph labeled (1).

28. the section 15 be added following paragraph 2 to 4:

(4) by way of derogation from the time limit laid down in Article 5a, paragraph 3 a proposal for inclusion of an optional code for the intellectual capital report for the year can be presented by September 30, 2013, 2013 at the latest."
