459th Ordinance of the Federal Minister for science, research and economy, with the feed-in tariffs for the purchase of electricity from eco-electricity plants on the basis of contracts are set to complete the eco power clearing agency from 1 January 2016 until the end of the year 2017 is obliged (eco-electricity one dining fare regulation 2016 - 2016 ÖSET VO)

On the basis of article 19 and article 20 of the eco-electricity Act 2012 (ÖSG 2012), Federal Law Gazette I no. 75/2011, last modified by the pronouncement Federal Law Gazette I no. is 11/2012, in agreement with the Federal Minister of agriculture and forestry, environment and water management and the Federal Minister for labour, Social Affairs and consumer protection:

Scope of application

1. (1) this regulation has the setting of feed-in tariffs for the purchase of electricity from new plants (article 5, paragraph 1 Z 20 in conjunction with Z 23 ÖSG 2012) on the subject, which a recognition decision in accordance with § 7 eco-electricity Act, Federal Law Gazette I no. 149/2002, as amended by Federal Law Gazette I no. 114/2008 or § 7 ÖSG 2012 has been granted and on the basis of renewable wind energy , Liquid or gaseous biomass, geothermal energy or small hydropower Sun (except photovoltaics with a peak capacity of up to 5 kW according to § 12 ABS. 2 Z 3 ÖSG 2012), fixed, (with a bottleneck capacity of up to 2 MW in accordance with § 14 paragraph 7 ÖSG 2012) be operated.

Minimum efficiency

Plants at least partially operated on the basis of geothermal energy, biomass or biogas, the feed-in tariffs in the regulation are section 2 (1) to grant, only when a fuel efficiency (§ 5 par. 1 Z 8 ÖSG 2012) or overall energy efficiency is achieved by at least 60%.

(2) the achievement of the fuel efficiency and overall energy efficiency is to prove prior to commissioning of the plant by a concept. Achieving the fuel efficiency and overall energy efficiency for each completed calendar year is until no later than 31 March of the following year are to demonstrate the eco power clearing agency, which does not include the first three months after commissioning.

Duration of the feed-in tariffs

§ 3. The feed-in tariffs contained in this Regulation apply ÖSG pursuant to § 16 para 1 2012 1 for plants referred to in § 5 to 7 and § 11 and § 12 for a period of 13 years and 2. for equipment in accordance with § 8 to section 10 for a period of 15 years from contracting with the eco power settlement Agency (ÖSG start the purchase of green power by the eco power clearing agency in accordance with § 12 2012) and end no later than at the end of the 20th year of operation of the plant.

Definitions

§ 4. This regulation 1 "solid biomass" means forest fuels and blade of benign fuels and whose fruits (ÖNORM EN ISO 16559:2014-12);

Feed-in tariffs for green electricity from photovoltaic systems

5. (1) the tariff for the purchase of electrical energy from photovoltaic systems with a bottleneck capacity of 5 kWpeak-200 kWpeak, which are attached to or on a building, is as follows fixed: application and conclusion of the contract in the year 2016 8.24 cents / kWh.

As investment aid for the construction of 40% of the construction costs, are in addition but not exceeding a sum amounting to 375 euros per kWpeak granted.

(2) the required proof of the investment is made through the submission of bills necessary for the construction costs at the eco power clearing agency at the latest six months after the conclusion of the contract.

(3) that section 14 para 6 ÖSG granting a Netzparitäts tariff in accordance with 2012 is for plants, which do not Gebäude-and fassadenintegriert or that are greater than 20 kWpeak, excluded.

Feed-in tariffs for green electricity from wind turbines

§ 6. The tariffs for the purchase of electrical energy from wind turbines are set as follows: 1. application in the year 2016 9.04 cents / kWh;

2. when submitting the year 2017 8.95 cents / kWh.

Feed-in tariffs for green electricity from geothermal energy

§ 7. The tariffs for the purchase of electricity from geothermal energy are set as follows: 1. application in the year 2016 7,43 cents / kWh;

2. when submitting the year 2017 7.36 cents / kWh.

Feed-in tariffs for green electricity from solid biomass and wastes with high content of biogenic and setting the heat price

§ 8 (1) tariffs for the purchase of electricity from power plants, but operated under exclusive use of solid biomass, with the exception of waste with high content of biogenic, are set following amounts: 1. application in the year 2016 a) for high-efficiency equipment with a bottleneck capacity up to 500 kW 22,22 cents / kWh;

(b) in the case of a bottleneck capacity up to 500 kW 18,80 cents / kWh;

(c) in the case of a bottleneck capacity of more than 500 kW to 1 MW 16,32 cents / kWh;

(d) when a bottleneck capacity of over 1 MW and 1.5 MW 14.97 cents/kWh;

(e) in the case of a bottleneck capacity of over 1.5 MW and 2 MW 14.47 cents/kWh;

f) at a bottleneck capacity of more than 2 MW to 5 MW 13.88 cents/kWh;

(g) in the case of a bottleneck capacity of over 5 MW to 10 MW 13,39 cents/kWh;

h) at a bottleneck capacity of over 10 MW 10.61 cents/kWh;

2. application in the year 2017 a) for high-efficiency equipment with a bottleneck capacity up to 500 kW 22,00 cents / kWh;

(b) in the case of a bottleneck capacity up to 500 kW 18.61 cents / kWh;

(c) in the case of a bottleneck capacity of more than 500 kW to 1 MW 16.15 cents / kWh;

(d) when a bottleneck capacity of over 1 MW and 1.5 MW 14.82 cents/kWh;

(e) in the case of a bottleneck capacity of over 1.5 MW and 2 MW 14.33 cents/kWh;

f) at a bottleneck capacity of more than 2 MW to 5 MW 13.74 cents/kWh;

(g) in the case of a bottleneck capacity of over 5 MW to 10 MW 13.26 cents/kWh;

h) at a bottleneck capacity of over 10 MW 10.50 cents/kWh;

3. as far as the total installed capacity of plants on the basis of solid biomass over the contract pursuant to § 15 2012 has done ÖSG since October 20, 2009, 100 MW or exceeds: a) for high-efficiency equipment with a bottleneck capacity up to 500 kW 18.09 cents / kWh;

(b) in the case of a bottleneck capacity up to 500 kW 12,88 cents / kWh;

(c) in the case of a bottleneck capacity of more than 500 kW to 1 MW 10.61 cents / kWh;

(d) when a bottleneck capacity of over 1 MW and 1.5 MW 10.14 cents/kWh;

(e) in the case of a bottleneck capacity of over 1.5 MW and 2 MW 9,74 cents/kWh;

f) at a bottleneck capacity of more than 2 MW to 5 MW 9.46 cents/kWh;

(g) in the case of a bottleneck capacity of over 5 MW to 10 MW 8.62 cents/kWh;

h) at a bottleneck capacity of over 10 MW 8.22 cents/kWh.

(2) as regards the tariffs for the purchase of electricity from power plants, the waste with high content of biogenic are operated using only the energy carrier, the following applies: 1. with the use of primary energy sources in accordance with all five-digit key numbers of in table 2 of annex 1 of the ÖSG 2012, which begin with SN 17 in paragraph 1 be reduced fixed rates by 25%;

2. for use of primary energy sources, the tariffs laid down in paragraph 1, to 40% be reduced according to all five-digit key numbers of table 1 of annex 1 of the ÖSG 2012, beginning with SN 17;

3. use of primary energy sources in accordance with all other five-digit key numbers in table 1 and 2 of Appendix 1 of the ÖSG 2012, the tariff is set as follows: a) for application in the year 2016 4.80 cents / kWh;

(b) in the case of submission of the year 2017 4.75 cents / kWh.

(3) with respect to the rates for the decrease electric energy of hybrid and mixed combustion plant to co-firing in thermal power plants, which are operated under use of the biomass or waste with high content of biogenic fuels, the following shall apply: of the tariff 1. exclusive use of solid biomass is set as follows: a) for application in the year 2016 5.88 cents / kWh;

(b) in the case of submission of the year 2017 5,82 cents / kWh;

the tariffs set out in subpara 1 20% be reduced use of primary energy sources in accordance with all five-digit key numbers in table 2 of Appendix 1 of the ÖSG 2012, beginning with SN 17;

3. use of primary energy sources in accordance with all other five-digit key numbers in the tables 1 and 2 of Appendix 1 of the ÖSG 2012, reduce the tariffs set out in subpara 1 to 30%.

(4) in the case of combination of the materials referred to in paragraph 1 to paragraph 3 a proportional rate comes after the fuel quantities used, relative to the fuel thermal power, to the application.

(5) the tariffs referred to in paragraph 2 and paragraph 3 shall apply regardless of whether the used waste with high content of biogenic in their original form or be used but be changed by previous hack, presses or other troubleshooting steps in their shape and density.

Feed-in tariffs for green electricity from liquid biomass

9. (1) the tariffs for the purchase of electrical energy from liquid biomass are as follows set: 1. application in the year 2016 5.57 cents / kWh;

2. when submitting the year 2017 5.51 cents / kWh.

(2) for electricity produced in CHP plants operated solely on the basis of liquid biomass and for that where in accordance with § 1 para 2 2 period a request pursuant to article 15 ÖSG 2012 has been made Z on acceptance of eco-electricity feed-in tariffs determined by this regulation, there is a surcharge of 2 cents / kWh, if these systems the efficiency criterion in accordance with § 8 par. 2 CHP Act , Federal Law Gazette I no. 111/2008 as amended by Federal Law Gazette I no. 72/2014, meet.

Feed-in tariffs for green electricity from biogas

§ 10 (1) tariffs for the purchase of electricity from power plants, which are operated by using the energy of biogas with purely agricultural substrate use materials are set following amounts: 1. application in the year 2016 a) a bottleneck capacity up to 250 kW 18.67 cents / kWh;

(b) a bottleneck capacity of over 250 to 500 kW 16.15 cents / kWh;

(c) a bottleneck capacity of over 500 to 750 kW 12.97 cents / kWh;

(d) a bottleneck capacity over 750 kW 12,51 cents / kWh;

2. application in the year 2017 a) a bottleneck capacity up to 250 kW 18,48 cents / kWh;

(b) a bottleneck capacity of over 250 to 500 kW 15.99 cents / kWh;

(c) a bottleneck capacity of over 500 to 750 kW 12.84 cents / kWh;

(d) a bottleneck capacity over 750 kW 12,38 cents / kWh.

(2) that in para 1 subpara 1 lit. a and Z 2 lit. a fixed rates are only under the condition of ensuring that animal manure with a mass fraction of at least 30% is used. Evidence of the use of substrate feedstock is to provide the eco power settlement agency for each calendar year no later than 31 January of the following year. Is this proof is not produced by 30% in a single calendar year of the funding period, the plant achieves a fertilisers of animal economy but with a mass fraction of at least 20%, which shall be Z for this past calendar year retroactively in para 1 1 lit. b or subpara 2 lit. b fixed tariffs. (5) the tariffs for the purchase of electrical energy of hybrid and mixed combustion plant using biogas as a fuel, will be pro-rated according to paragraph 1 or paragraph 3 according to the amount of used bio-gas, based on the fuel thermal capacity, fixed.

(6) by way of derogation by par. 1 and par. 2, ÖSG 2012 for the where in accordance with § 1 para 2 2 period a request pursuant to article 15 ÖSG 2012 is set Z on acceptance of eco-electricity at the rates specified by this regulation, as tariffs for those quantities of electricity from gas according to § 8 section 3 be ÖSG 2012 for plants referred to in article 7, paragraph 1 , which has been fed into the grid and prepares them to natural gas quality, established the following amounts: 1. application in the year 2016 a) a bottleneck capacity up to 500 kW 16.15 cents / kWh;

(b) a bottleneck capacity of over 500 to 750 kW 12.97 cents / kWh;

(c) a bottleneck capacity over 750 kW 12,51 cents / kWh;

2. application in the year 2017 a) a bottleneck capacity up to 500 kW 15.99 cents / kWh;

(b) a bottleneck capacity of over 500 to 750 kW 12.84 cents / kWh;

(c) a bottleneck capacity over 750 kW 12,38 cents / kWh.

(7) a surcharge of 2 cents/kWh for those quantities of electricity from gas pursuant to § 21 para 1 consists ÖSG 2012, if the gases injected into the grid to natural gas quality are prepared to (technology bonus) for electric energy of plants referred to in paragraph 6.

Feed-in tariffs for green electricity from landfill and sewage gas

§ 11 (1) tariffs for the acceptance of electrical energy from power plants, which are operated by using the energy of landfill and sewage gas, provided the following amounts: 1 for sewage gas a) for application in the year 2016 5.76 cents / kWh;

(b) in the case of submission of the year 2017 5.71 cents / kWh;

2. for a landfill gas) for application in the year 2016 4.80 cents / kWh;

(b) in the case of submission of the year 2017 4.75 cents / kWh.

(2) the tariffs for the purchase of electrical energy of hybrid and mixed combustion plant using landfill and sewage gas as an energy source, will be pro-rated according to paragraph 1 according to the amount of gas, based on the fuel thermal capacity, fixed.

Feed-in tariffs for green electricity from new or revitalized small hydropower plants

(§ 12 (1) as tariffs for the acceptance of electrical energy from new small hydropower plants or those that were revitalized Z 26a ÖSG 2012 to such an extent that increasing the bottleneck capacity or of the rule working capacity by at least 50% upon completion of the revitalization is achieved, in accordance with article 5, paragraph 1, provided that the bottleneck capacity exceeds not 2 MW, the following amounts set: 1. submission of the year 2016 a) for the first 500 000 kWh 10.35 cents / kWh;

(b) for the next 500 000 kWh 7,43 cents / kWh;

(c) for the next 1 500 000 kWh 6.49 cents / kWh;

(d) for the next 2 500 000 kWh 5.42 cents / kWh;

(e) for the next 2 500 000 kWh 5.12 cents / kWh;

(f) about 7 500 000 kWh, 4.87 cents / kWh;

(g) for power buoys for the first 500 000 kWh 13,32 cents / kWh;

h) for power buoys over 500 000 kWh, 12,32 cents / kWh;

2. application in the year 2017 a) for the first 500 000 kWh 10.25 cents / kWh;

(b) for the next 500 000 kWh 7.36 cents / kWh;

(c) for the next 1 500 000 kWh 6.43 cents / kWh;

(d) for the next 2 500 000 kWh 5.37 cents / kWh;

(e) for the next 2 500 000 kWh 5.07 cents / kWh;

f) over 7 500 000 kWh/year, 4.82 cents / kWh.

(2) as tariffs for the acceptance of electrical energy from small hydroelectric power plants, which were revitalized Z 26a ÖSG 2012 to such an extent that achieves a boost of the bottleneck capacity or of the rule working capacity by at least 15% after implementation of revitalization, in accordance with article 5, paragraph 1, provided that the bottleneck capacity exceeds not 2 MW, established the following amounts: 1. submission of the year 2016 a) for the first 500 000 kWh 8.10 cents / kWh;

(b) for the next 500 000 kWh 5.91 cents / kWh;

(c) for the next 1 500 000 kWh 5.12 cents / kWh;

(d) for the next 2 500 000 kWh 3.73 cents / kWh;

(e) for the next 2 500 000 kWh 3.45 cents / kWh;

(f) about 7 500 000 kWh, 3.17 cents / kWh;

2. application in the year 2017 a) for the first 500 000 kWh 8.02 cents / kWh;

(b) for the next 500 000 kWh 5.85 cents / kWh;

(c) for the next 1 500 000 kWh 5.07 cents / kWh;

(d) for the next 2 500 000 kWh 3.69 cents / kWh;

(e) for the next 2 500 000 kWh 3.42 cents / kWh;

f) over 7 500 000 kWh/year, 3.14 cents / kWh.

(3) the zone tariff limits laid down in paragraph 1 and paragraph 2 refers to a calendar year. A collective compensation for the amounts injected an incomplete year is prorated basis in terms time to calculate.

(4) the increase of the standard capacity is to be proven by the opinion of a civil engineer.

(5) that in para 1 subpara 1 lit. g unf lit. h fixed rates are only under the condition, that proof of the investment at the latest six months after the conclusion of the contract takes place through the submission of bills necessary for the construction costs at the eco power clearing agency.

Entry into force

§ 13. This Regulation shall enter into force 1 January 2016.
