147. Amendment of the Postal Structure Act

The National Council has decided:

The Postal Structure Act, BGBl. No 201/1996, as last amended by BGBl. No 210/2013, shall be amended as follows:

1. In Section 17 (2), the expression "Service and Pension Authority" by the expression "Service Authority" is replaced by the second sentence.

Section 17 (7) reads as follows:

" (7) The Federal Government shall pay the pension costs for the former pensioners of the postal and telegraph administration as well as for civil servants who were assigned according to paragraph 1 or paragraph 1a, and their relatives and survivors. The company to which the official or official is assigned according to paragraph 1a has to make a monthly contribution to the federal government to cover the pension costs ("service contribution"). The official contribution amounts to 12.55% of the respective tax base of the official, respectively, of the official or of the staff pension contribution ('service contribution '). The contributions to the service are to be deducted from the federal government. "

(3) In § 17, para. 7a and 7d are deleted.

4. § 17 (8) reads:

" (8) The assessment, calculation and payment of the

References to the officials referred to in paragraph 1a shall be the responsibility of the undertaking to which they are assigned in accordance with paragraph 1 (a);

in the case of cash benefits provided for in paragraph 7, the cash benefits provided for in paragraph 7 shall be the responsibility of the public servant (BVA) in the transferred sphere of activity for the persons and their relatives and survivors of the pension. The costs of carrying out this task are borne by the Federal Government. § 1 para. 2, § 2 para. 1 and 2, § 3, § 4, § 5 and § 6 of the BundespensionsamtTransmission-Gesetz, BGBl. I No 89/2006, are to be applied. The active civil servants employed on 31 December 2016 in the undertakings referred to in paragraph 1 (a) with the assessment, calculation and payment of the pensions shall be from 1. Jänner 2017 for the duration of her service of the office "Office for Federal Pensions" and are assigned to the BVA to the permanent service. "

(5) The following paragraphs 10 and 11 are added to § 24:

" (10) The abduction of § 17 para. 7d occurs with 1. Jänner 2016 in force.

(11) § 17 (2), (7) and (8) and the case of the dismise of Section 17 (7a) shall take place with 1. Jänner 2017 in force. Proceedings pending at the time of entry into force shall continue to be carried out by the BVA. "
