345. Regulation of the Federal Minister of Finance on the statistics of the building sector in the public sector 2014 (Gebarungsstatistik-VO 2014)

On the basis of § 4 (4), § 8 (1) and § 9 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by Federal Law BGBl. I n ° 111/2010, shall be assigned in agreement with the Federal Chancellor:

Arrangement for the compilation of statistics

§ 1. (1) The Federal Statistical Office (Bundesanstalt Statistik Österreich) has to compile statistics on the public sector in the light of the following European legislation:

(2) For the statistics referred to in paragraph 1, the Bundesanstalt Statistik Austria shall carry out statistical surveys within the meaning of these Regulations.

Definitions

§ 2. For the purposes of this Regulation:

1.

State units: statistical units to be assigned to the State sector in accordance with Regulation (EU) No 549/2013 Annex A, Chapter 20, paragraphs 20.05 to 20.17.

2.

Other public units: statistical units not classified in the State sector pursuant to Regulation (EU) No 549/2013, but subject to control by State units;

3.

Control: in accordance with Regulation (EU) No 549/2013 Annex A, Chapter 20, point 20.18, the ability to determine the general management line or the general programme of the controlled unit;

4.

Public sector: sum of public and other public sector units;

5.

Sector classification: mapping of a statistical unit to a sector in accordance with Regulation (EU) No 549/2013 Annex A, Chapter 2, points 2.31 to 2.44 (in particular Table 2.1-Sectors and sub-sectors as well as Figure 2.1-Allocation of units) sectors).

Survey units

§ 3. (1) Survey units are:

1.

state units;

2.

other public entities.

(2) The Bundesanstalt Statistik Austria (Bundesanstalt Statistik Österreich) has a list of state units and other public units in electronic form available on the homepage of the Bundesanstalt Statistik Austria. www.statistik.at to make known. This shall be done annually by 31 March at the latest.

Survey characteristics, periodicity of the survey

§ 4. The following characteristics shall be collected:

1.

in the case of the public units (survey units according to § 3 (1) (1)), the data on the accounts, the balance sheet, the profit and loss account, as well as data on contingent liabilities, participations in the capital of private or public companies and employment per year;

2.

in the case of the federal government, the Länder, the municipalities and the social security institutions, the reserved stands of the data in accordance with Z 1 as well as the other survey units pursuant to § 3 (1) (1) (1) of the records of the data from the balance sheet and the data Profit and loss account quarterly at the end of each quarter of a calendar year;

3.

in the case of the federal government, the Länder and the social security institutions, household data on a cash basis (or equivalent data from the public accounting system) monthly;

4.

in the case of other public units (survey units as defined in Section 3 (1) (2)), balance sheet data and profit and loss account data each year.

Implementation of the survey

§ 5. (1) The state units (survey units in accordance with § 3 (1) (1) (1)), in particular the federal government, Länder, municipalities and municipal associations, have the Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) to draw up the lists in accordance with § 3 paragraph 2, beginning with 31. January 2014 to submit the following data:

1.

annually by 31. January of the year following the budget or financial year concerned, a list of the units of the public sector which they control;

2.

Within two months of the establishment of newly created units, all data and information necessary for the allocation of these units to a sector classification by the Bundesanstalt Statistik Austria.

(2) The transmission of the characteristics listed in § 4 to the Bundesanstalt Statistik Austria shall be carried out:

1.

in accordance with § 4 Z 1, by the state units (collection units pursuant to § 3 (1) (1) (1)) by 31 May of the year at the latest, which follows the relevant budget or financial year;

2.

pursuant to § 4 (2) (2) of the Federal Government, the Länder and the Main Association of Social Security Institutions (BCC) by 25. of the following month after the end of the quarter, concerning the fourth quarter, within five weeks of the end of the quarter;

3.

within six weeks after the end of the quarter, in accordance with Section 4 (2) of the Z 2 concerning the municipalities within four weeks and from the other survey units pursuant to § 3 (1) (1) (1) (1);

4.

Pursuant to § 4 Z 3 of the Federal Government, the Länder and the social security institutions of the Austrian Social Security Union (Hauptverband der Austrian Sozialversicherbearer) by 25. of the following month; the transmission of data for the months of March, June, September and December may be omitted, provided that these data are included in the message referred to in Z 2.

5.

pursuant to § 4 (4) (4) of the other public units (collection units pursuant to § 3 (1) (2) (2)), no later than 31. October of the year following the relevant budget or financial year.

(3) In accordance with § 4 (1) and (4) of this Directive, the data may be used for the approval of organs of the survey units and if the data is not available up to the date specified in paragraph 2, the relevant survey units shall have preliminary data or Estimates to be transmitted. The final data shall be supplied immediately after the approval has been granted.

(4) The survey units shall transmit the data and information electronically in data formats specified by the Federal Statistical Office of Austria. The data formats to be used for data transmission are to be determined by the Federal Statistical Office of Statistics Austria after consultation of the state units and the Federal Ministry of Finance. They are available from the Bundesanstalt Statistik Austria on the homepage of the Bundesanstalt Statistik Austria. www.statistik.at to make known. Prior to the transmission of the data of the Federal Government, the Länder and the municipalities as well as all state units, their preliminary estimates or Financial statements in accordance with the preliminary draft and accounts regulation 1997-VRV 1997, BGBl. No 787/1996, as amended, they are based on the formal correctness (structure and coding) and on conformity with the accounting rules (Council Regulation of 2013, BGBl. II No 74/2012, as amended, respectively; VRV 1997).

(5) The Federal Government's data shall be transmitted by the Federal Ministry of Finance, the data of the Länder and the municipalities via the competent national authorities. The state authorities have to check the data of the municipalities for plausibility, particularly as regards conformity with the provisions of the VRV 1997, before being forwarded to the Bundesanstalt Statistik Österreich. The test result is to be recorded in a report and to be transmitted at the same time as the data delivery to the Bundesanstalt Statistik Austria.

Forwarding of data to the Oesterreichische Nationalbank

§ 6. Collected data needed for the statistics, according to the Foreign Exchange Act 2004, BGBl. I No 123/2003, or on the basis of guidelines or regulations issued by the European Central Bank, by the Oesterreichische Nationalbank, may be sent to the Oesterreichische Nationalbank by the Federal Statistical Office in Austria shall be transmitted in an unanonymized form.

Advisory Body

§ 7. (1) In support of the Bundesanstalt Statistik Österreich in the compilation of statistics pursuant to § 1 paragraph 1, the Federal Ministry of Statistics Act 1986, BGBl. 76/1986, as amended by Federal Law Gazette (Federal Law Gazette) 1986, is hereby amended as amended by the Federal Ministry of Statistics. I No 35/2012, a consultative body established. The tasks of this body are in particular:

1.

identification of lack of information in the public accounting system needed for the production of macroeconomic data;

2.

Support in ensuring the full coverage of all public sector units (identification, data transfer);

3.

Further development of the data formats for the transmission of data and information pursuant to § 5 (4);

4.

Evaluation of the individual steps in data collection and data processing;

5.

Elaboration of recommendations for quality improvement in relation to the measures listed in Z 1 to 4.

(2) An expert from the Federal Ministry of Finance is a member of the Advisory Board. The following posts can be sent to the advisory board:

1.

Bundesanstalt Statistik Austria;

2.

Court of Auditors

3.

the liaison office of the federal states and a representative for the federal states as a whole;

4.

Austrian Municipal Debate;

5.

Austrian Association of Cities;

6.

Main Association of Social Security Institutions.

(3) The expert appointed by the Federal Institute shall be chaired by the President. If the Federal Institute has not sent a representative, the representative of the Federal Ministry of Finance will be chairing the meeting. Meetings shall be held at least once a year.

(4) The Advisory Board shall adopt its rules of procedure.

Obligation to provide information

§ 8. According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information. The survey units shall provide their information in time, in full and in the best of their knowledge. In particular, you have to answer back questions from the Austrian Federal Statistics Office without delay. Local authorities may be involved in public sector units controlled by them, in particular those in their supervisory or shareholding areas.

Other obligation to participate

§ 9. Public sector units have to provide all the information on the question of the Federal Institute of Statistics in Austria, which is part of the sector classification or the review of the sector classification carried out by the Federal Institute for Statistics (Bundesanstalt). Statistics Austria is required.

Information on information and co-action obligations

§ 10. The Bundesanstalt Statistik Austria (Bundesanstalt Statistik Österreich) has the right to provide information and to cooperate on the legal consequences in accordance with Section 66 of the Federal Statistics Act 2000 in case of refusal of information or participation and in the case of knowingly incomplete or not the best. Cost

§ 11. The Federal Statistical Office of Statistics Austria shall be the additional expenditure in 2013, which is linked to the surveys and the compilation of statistics pursuant to this Regulation and not covered by the flat-rate amount of Section 32 (5) of the Federal Statistics Act 2000. Amount of € 294 842, € 442 881 in 2014, and € 573 763 per year from 2015. The cost rate is based on the "consumer price index 2010" (or "consumer price index 2010"), which was determined by the Austrian Federal Institute of Statistics Austria. of the index which may be replaced by the index), with the index number for the month of January 2015 forming the basis of the starting point. External force and entry into force

§ 12. The Regulation of the Federal Minister of Finance on the Statistics of the Building Statistics in the Public Sector (Gebarungsstatistik-VO), BGBl. II No 361/2002, as amended by the BGBl version. II No 465/2004, shall take place on 1 January 2007. January 2014 out of force. At the same time this Regulation shall enter into force.
