376. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, which will issue a home-work tariff for home workers in the industrial and commercial marine embroidery sector

The Federal Office of the Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 34 (1) of the Home Labour Act 1960, BGBl No. 105/1961, in the version of the Federal Law BGBl. I No 74/2009, authorizing the adoption of homework tariffs at the request of a collectivelycontractable body of workers.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has issued a decision of 19 November 2013 following the implementation of a senate hearing:

Homework tariff

for home workers in the industrial and commercial marine embroidery industry

Scope

§ 1. This home work tariff applies:

a)

Spatial: for the province of Vorarlberg.

b)

Factual: for all homework in the field of marine embroidery.

c)

Personal: for all clients who belong to industry and commerce and who spend their homework in the field of marine embroidery, and for all homeworkers who take care of such homework, if not for the client and home workers have been subject to a different scheme through relevant home employment contracts.

Date of effectiveness and duration of validity

§ 2. (1) This home work tariff shall apply in accordance with Section 35 (1) of the Home Labour Code for all orders which are from 1. Jänner 2014 shall be granted and shall be valid until a repeal or amendment in accordance with Section 36 (1) of the German Home Labour Act or by means of a home employment contract.

(2) The hourly wages of the home labour rate shall only be applied if the calculation of the remuneration for the home work order is not based on a piece fee, but only on an hourly wage.
