473. Regulation of the Federal Minister of Transport, Innovation and Technology, which changes the civil aviation declaration regulation

On the basis of § § 24f, 24g and 136 of the Aviation Act, BGBl. N ° 253/1957, as last amended by the Federal Law BGBl. I n ° 108/2013, shall be arranged:

The Civil Aviation-Reporting Ordinance, BGBl. II No 319/2007, shall be amended as follows:

1. In Section 1 (1) (2), the word order shall be " of accidents (§ 2 para. 3 of the Accident Investigation Act, BGBl. (2) The following paragraph 5 is added to § 1:

" (5) The provisions of this Regulation shall apply to unmanned aerial vehicles of Class 1 and 2 (§ 24f and § 24g of the Aviation Act), including their equipment, subject to the provisions applicable to aircraft, provided that none of the provisions of the Regulation are applicable. Special arrangements for unmanned aerial vehicles are laid down. "

§ 6, first sentence reads:

" Reporting obligations under other provisions, eg in accordance with the Civil Aviation Vehicle and Aeronautical Equipment Ordination 2010, BGBl. II No 143/2010, of the Air Transport Operator Certificate-Regulation 2008, BGBl. II No 254/2008, of Regulation (EC) No 2042/2003 on the maintenance of the airworthiness of aircraft and aeronautical products, parts and equipment and the granting of authorisations for organisations and persons who: carry out these activities, OJ L 327 No. 1, of Regulation (EU) No 748/2012 laying down detailed rules for the granting of airworthiness and environmental events for aircraft and related products, construction and equipment parts and for the Approval of development and manufacturing plants, OJ C 327, 28.4.2002 No. 1, of Regulation (EU) No 965/2012 laying down technical requirements and administrative procedures relating to the operation of a flight pursuant to Regulation (EC) No 216/2008, OJ L 327, 28.12.2008, p. 4. In § 7 (1) Z 5, the citation "§ 2 (9) of the Accident Investigation Act" through the citation " Art. 2 Z 5 of Regulation (EU) No 996/2010 " as well as the citation "§ 2 (10) of the Accident Investigation Act" through the citation " Art. 2 Z 17 of Regulation (EU) No 996/2010 " replaced.

5. In § 7 (1) Z 7, the citation shall be "§ 12a of the Dangerous Goods Transport Act" through the citation "§ 12 of the Dangerous Goods Transport Act" replaced.

6. § 9 together with headline reads:

" Forwarding of messages to the Federal Security Office

§ 9. The Central Reporting Office of Austro Control GmbH must immediately forward the notifications of accidents and serious incidents that have been received to the Federal Security Office. "

Section 10 (1) reads as follows:

" (1) All notifications that have entered the central reporting office of Austro Control GmbH shall be checked by the Austro Control GmbH for their completeness in respect of the information required in accordance with Section 7 (1). Any necessary supplements must be obtained from the Austro Control GmbH at the reporting point or at the reporting office. "

8. In Section 10 (2), (4), (6) and (7), the word order shall be "Federal accident investigation agency" through the phrase "Austro Control GmbH" replaced.

9. The following sentence is added to Article 10 (2):

"With regard to reporting requirements, all information relevant to security, including the information referred to in Article 19 (1) of Regulation (EU) No 996/2010, shall be stored."

10. In Section 10 (3), the phrase "Federal accident investigation agency" through the phrase "Central Reporting Office of Austro Control GmbH" replaced.

11. § 10 (5) last sentence reads:

"The obligation to provide mutual assistance to the courts and public prosecutors shall remain unaffected."

12. In § 10 (7) the citation shall be "§ 120" through the citation "§ 120c" replaced.

13. § 11 reads:

" § 11. If an investigation into an incident in the field of aviation is initiated by the Federal Security Investigation Agency, the information contained in the investigation report under Article 16 of Regulation (EU) No 996/2010 shall also be published in the To store, process and evaluate the database in accordance with § 136 (4) of the Aviation Act and to evaluate it within the meaning of Section 10 (4). "

14. In § 12, the previous text receives the sales designation "(1)" ; the following paragraph 2 is added:
