481. Regulation of the Federal Minister for the Interior, amending the law on the establishment of a law on the establishment of a residence permit and the residence law implementing regulation

On the basis of the Law on the Law of the Netherlands (NAG), Federal Law Gazette (BGBl). I n ° 100/2005, as last amended by the Federal Law BGBl. I No 144/2013, shall be arranged:

The regulation of the Federal Minister of the Interior on the implementation of the law on the establishment of a law on the establishment of the law of establishment and residence (German Law on the Law of the Netherlands-NAG-DV), Federal Law Gazette (BGBl). II No 451/2005, as last amended by the BGBl Regulation. II No 201/2011, shall be amended as follows:

1. In § 2 para. 1 Z 7 the word order shall be "Permanent residence-EC" through the phrase "Permanent residence-EU" replaced.

2. In § 2 para. 1, in Z 8 the line point is replaced by one point and the Z 9 is omitted.

3. In § 2 para. 2, in Z 10 the line point is replaced by one point and the Z 11 is omitted.

4. In § 2 para. 5, in Z 1 the word "or" is replaced by a dash.

5. In § 2 para. 5 Z 2, after lit. (b) the following final word inserted:

"or".

6. In Section 2 (5), the following Z 3 shall be inserted after Z 2:

" 3.		a residence permit "Artists"

7. In Section 7 (1) (7), the word order shall be deleted "or Declaration of Patentability" .

8. § 7 is added in accordance with section 3 of the following paragraph 4:

"(4) In the event of an extension request for the issue of a further residence permit" permanent residence-EU ", the requirement of presenting the documents and evidence in accordance with paragraph 1 (1) (4) to (7) shall not be required."

9. In § 8 Z 4, the word order shall be "Safety certificate or employment permit as an artist" through the phrase "Employers ' declaration in accordance with the Foreigners Employment Act" replaced.

10. In § 8, in Z 9 the line point is replaced by one point and the Z 10 is omitted.

11. In the title of § 9, the quote "§ 8 (1) (1) and (3) NAG" by quoting "§ 8 (1) (1) to (3) NAG" replaced.

12. In § 9 para. 1, the quote shall be "§ 41 (1) NAG" by quoting "§ § 41 (1) or 49 (2) NAG" replaced.

13. The following final sentence shall be added to Article 9 (2):

"This provision shall also apply to cases of Section 49 (2) NAG, provided that a written notice of the regional office of the Labour Market Service pursuant to § 20d Z 2 or 3 AuslBG is available in accordance with § 49 paragraph 2 Z 3 NAG."

14. The following final sentence shall be added to Article 9 (3):

"This provision shall also apply to cases of Section 49 (2) NAG, provided that a written notice of the regional office of the Labour Market Service pursuant to § 20d Z 4 AuslBG is available in accordance with § 49 paragraph 2 Z 3 NAG."

15. § 9 is added in accordance with Section 5 of the following paragraph 6:

"(6) In addition to the documents and documents referred to in § 7, the application for the residence permit" Rot-Weiß-Rot-Karte plus " pursuant to § 41a (10) NAG shall be proof that the minor is due to have a court decision, force Act or an agreement not only temporarily in the care of foster parents or the youth welfare service provider. " (2) A residence permit according to § 1 may be made in the period of 1. January 2014 until 31 December 2014 according to the model of the Appendix K are issued.

(3) Confirmations on the timely status of an extension request in accordance with the model of Annex G in the version before the Regulation of the Federal Minister of the Interior, BGBl. II No 481/2013, may continue to be used until 31 December 2015.

(4) Before 1. Jänner 2014 or pursuant to section 81 (23) NAG after the end of 31 December 2013, residence permits issued pursuant to section 69a (1) Z 1 to 3 NAG shall be deemed to be valid for the period of validity of the residence permit as "residence permit of special protection" in accordance with § 57 Asylum Act 2005 further.

(5) Before 1. Residency permits issued in January 2014 pursuant to § 69a Section 1 Z 4 NAG shall continue to apply within their period of validity and their scope of authorization. "

19. In accordance with § 12, the title of § 13 is inserted:

20. § 13 is added in accordance with paragraph 7 of the following paragraph 8:

" (8) § § 2 para. 1 Z 7 and 8 and subsection 2 Z 10 as well as section 5, § 7 para. 1 Z 7 and para. 4, 8 Z 4 and 9, the title of § 9, § § 9 para. 1 to 3 and 6, the title of the 6. Section, § 12 including the title and the title of § 13 as well as the Annexes A, G and K in the version of the regulation of the Federal Minister of the Interior, BGBl. II No 481/2013, enter into force 1. Jänner 2014 in force. § 2 (1) Z 9 and 2 (2) Z 11 as well as § 8 Z 10 shall expire on 31 December 2013. The Appendix K shall expire at the end of 31 December 2014. "
