121. Regulation of the Federal Minister for Justice, amending the Regulation on the management of grades as the use designations in the Executive Service of the Working Group E 1 in the Justice Department

On the basis of § 145a of the Civil Service Act 1979, BGBl. No. 333/1979, as last amended by BGBl. I No 147/2013, shall be arranged:

The ordinance of the Federal Minister for Justice on the management of grades as usage designations in the executive service of the application group E 1 in the Justice Department, BGBl. II No 335/2007, shall be amended as follows:

1. § 1 (2) reads:

By way of derogation from the grades referred to in paragraph 1, the following levels of service shall be provided for officials of the Executive Service in the following uses, provided that these officials belong to a lower functional group:

Head or Head of the Executive Directorate

General

Deputy or Deputy Head of the Head of the Executive Directorate

Generallutnant

Head of department or head of department in the executive department

Brigadier

Deputy or deputy of a department head or department head in the executive committee

Top

Head of the Academy of Criminal Law

Brigadier

Head of department or head of department in the Academy of Criminal Law

Top

Head of a training centre or deputy head of a department head or head of department in the Academy of Criminal Law

Major (from salary level 16 Oberstleutnant)

Head of a judicial institution in the functional groups
8 and 9

Brigadier

Head of a judicial institution to function group 7 or head or head of the Central Economic Office

Lieutenant colonel (from salary level 12 colonel)

Deputy or Deputy Head of the Head of a judicial institution

Major (from salary level 12 Oberstleutnant)

Head of department or head of a judicial institution according to point 1.8. of the law enforcement order

Major (from salary level 16 Oberstleutnant)

Department head of a judicial institution pursuant to point 1.8. of the law of enforcement

Captain (from the salary level 16 major) "

2. In § 1, the following paragraph 2a is inserted after paragraph 2:

" (2a) By way of derogation from paragraph 1, in the event that an official or a civil servant of category E1 is entrusted with a workstation of function group 4 or higher of category A1, the degree of service for that official or of those officials shall be: Brigadier is intended to be used as a designation of use; for a civil servant or an official of category E1, who is entrusted with a job in function group 3 of category A1, up to salary level 11 is the degree of service Lieutenant Colonel and from the salary level 12 of the rank of rank Oberst. "

3. In § 4 (2), after the word "Appointment" the phrase "or open-ended betrauung" inserted.

4. The following paragraph 3 is added to § 5:

" (3) § 1 (2) and (2a) and § 4 (2) in the version of the BGBl Regulation. II No. 121/2014 will enter into force on 1 July 2014. "
