126. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, with which a home-work tariff for the enveloping, addressing, adjustment or packing of goods by home workers is enacted

The Federal Office of the Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 34 (1) of the Home Labour Act 1960, BGBl No. 105/1961, in the version of the Federal Law BGBl. I n ° 74/2009 authorises the adoption of a collective labour force for workers at the request of a collective contract.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has issued a decision of 5 June 2014 following the implementation of a senate hearing:

Homework tariff

for enveloping, addressing, adjusting or packing goods by home workers

Scope

§ 1.

a)

Spatially: for the federal territory of Austria.

b)

Professional: for the enveloping, addressing, adjustment or packing of goods, insofar as this activity is not carried out in connection with the manufacture, working or processing of an article and not already in a home employment contract or Home-working tariffs are regulated.

c)

Personal: for all clients who employ homeworkers for the work listed under (b).

Charges

§ 2. According to the collective agreement signed on 7 March 2014 for the commercial bookbinders, cartonboard producers, Etuimacher and paper processors of Austria, the unit fees of the employees working in the home sector are Austria's wage table for Paper confectioner, pay group 5, with an hourly wage of 6.98 € to calculate.

Home surcharge

§ 3. In the case of unit charges calculated in this way, the employees employed in home employment receive an uncost (home work) surcharge of 10%. This shall be shown separately.

Payment for compensation in the event of prevention of work, holiday grant and Christmas Remuneration

§ 4. The holiday grant and the Christmas Remuneration shall be settled in accordance with the collective agreement for the commercial bookbinders, cartonboard goods producers, Etuimacher and paper processors, completed on 19 November 2002, from this date onwards as follows:

The holiday allowance is 1. to the full 6. Year of service 4 weekly earnings, i.e. 8%; from 7. Year of service 4 1/3 weekly earnings, i.e. 8.67%.

The Christmas Remuneration is 1. to the full 6. Year of service 4 weekly earnings, i.e. 8%; from 7. Year of service 4 1/3 weekly earnings, i.e. 8.67%.

Home workers who enter or withdraw from the holding during the year receive the aliquot part of the holiday grant and the Christmas Remuneration.

Onset of effectiveness

§ 5. This home-working tariff is valid from 1 April 2014.
