151. Regulation of the Management Board of E-Control concerning the reporting of data concerning the preparation of the steering measures to ensure the supply of natural gas and the implementation of a monitoring of security of supply in the natural gas sector (Gas-Energy-Energy-Data-Regulation 2014, G-EnlD-VO 2014)

Due to § 27 (3) Energy Law 2012 (EnLG 2012), BGBl. I No 41/2013, shall be arranged:

Section 1

General

Definitions

§ 1. (1) For the purposes of this Regulation, the term:

1.

"supply to end users" means the quantities of gaseous energy sources which a final consumer refers to for their own use from a transmission or distribution system;

2.

"Ausspeisung" (Ausspeisung) the quantity in kWh, which is fed out of the market area. In this context, the supply to the final consumer shall not be considered to be an exeasable;

3.

"operator of production facilities" means a natural or legal person or a registered partnership which is responsible for the technical operation and maintenance of a production facility;

4.

"storage facility operator" means a natural or legal person or a registered personal company responsible for the technical operation and maintenance of a storage facility (storage station);

5.

"reference and supply" means the physically measured quantities of gaseous energy carriers, measured by appropriate methods, at the point of transfer, where reference and levy are to be recorded separately and not to be salted;

6.

"own consumption" means the quantities of gaseous energy sources which are

a)

a network operator needs to be able to operate the Fern and distribution lines without interference (including compressor operation),

b)

requires a producer in order to be able to operate the production in a trouble-free way,

c)

a storage company needs to be able to maintain the storage operation without interference,

where network losses, including measurement differences, are to be identified separately from their own consumption;

7.

"limitation of contractual deliveries" means any reduction in the aggregated preview values for references reported by the supplier to the Virtual Trading Point and for imports by more than 30%;

8.

"feed" means the quantity in kWh which is fed into the market area;

9.

"significant reduction of imports" means a deviation of the actual amounts actually fed in at least one feed point from the quantities declared as initial nomination "D-1" and confirmed in the day-ahead matchingresult by more than minus 30% (undeclared imports below 30% of at least one feed-in point);

10.

"Export" means the quantities of gaseous energy sources which are transported abroad abroad;

11.

"gaseous energy source" means natural gas and biogenic gases;

12.

"gas-fired power plant" means the totality of the technical equipment and installations which are used for the conversion of gaseous energy sources into thermal energy and/or in electrical energy, whether or not the gaseous energy sources are used exclusively or only partially;

13.

"Large customer" means all end users according to § 7 (1) Z 11 GWG 2011 with a contractually agreed maximum power of more than 50,000 kWh per hour;

14.

"heating plant" means an installation in which other forms of energy are exclusively converted into usable heat and are made available for a supply area;

15.

"heating power plant" means a thermal power plant in which other forms of energy are implemented in a combined process both in electrical energy and in useful heat (cogeneration) and are provided for a supply area;

16.

"Import" means the quantities of gaseous energy sources which are brought into Austria in a cross-border manner;

17.

"combined heat and power (CHP)" means the simultaneous production of thermal energy and electrical and/or mechanical energy in a process;

18.

"Combined heat and power (CHP)" means an extension of the combined heat and power generation (CHP), which is also used for cold production. The provisions of this Regulation relating to cogeneration plants shall also apply to cogeneration plants, mutas or other than those used in cogeneration plants;

19.

"maximum storage and removal rate (capacity) of a storage facility" means the maximum possible amount per unit of time that can be inserted into or removed from the storage system;

20.

"maximum production rate (capacity)" means the maximum possible quantity per unit of time, which can be taken from a production plant;

21.

"storage volume" means the amount of natural gas that can be transferred to a maximum amount of storage, with the upholstery gas being withdrawn;

22.

"net heating power" means the heat of the heat transfer medium supplied to the (Fern) heat network by a heating plant or a heating power plant (thermal power plant with combined heat and power);

23.

"cushion gas" means that part of the gaseous energy source contained in the storage, which is not used for regular storage use but for maintaining storage operations;

24.

"storage content" means the amount of storage space in the storage facility at the time of collection, the cushion gas being to be withdrawn;

25.

"location" means one or more connected premises, owned or held by a final consumer, in so far as it constitutes a unit with regard to economic activities and for which a unit (s) is ( Final consumer means natural gas and, where appropriate, distributes it at self-cost via its own network;

26.

"available hourly rates" means the maximum available rates in kWh per hour, which, in any case, can be made available on the basis of contractual arrangements for the supply of end-users.

27.

"heat exchange capacity" means the maximum possible extendable heat-continuous power of a heating (power), limited by the most powerful component of the power supply;

28.

"additionally activatable hourly rates" means the maximum available rates in kWh per hour, which can be applied beyond the available hourly rates, in particular via non-contracted storage rates and production rates.

(2) "components of the levy or consumption (end-consumer groups)" within the meaning of this Regulation are:

1.

Final consumers, which are final consumers with an annual consumption of at least 400,000 kWh. These are also broken down by size class of the reference,

2.

non-performance end consumers, which are final consumers with an annual consumption of less than 400,000 kWh. These are also broken down by size class of the reference and according to the following end user groups:

a)

households,

b)

Industry,

c)

Others;

For the purposes of this Regulation, the allocation of a standard load profile shall not be mandatory, the performance measured, or to be assigned to the non-performance-measured end-users.

(3) For all other terms, the definitions of § 7 paragraph 1 Gaswirtschaftsgesetz 2011 shall apply (GWG 2011, BGBl. I n ° 107/2011 in the version of BGBl. I No. 174/2013) and in accordance with § 2 paragraph 1 Gas-Market Model Regulation 2012 (GMMO-VO 2012, BGBl. II No 171/2012 in the version BGBl. II No 466/2013).

(4) All quantities (measured values) collected in the framework of this Regulation for gaseous energy sources, or shall be subject to the normal condition and shall be subject to the application of the Regulation (GSNE-VO 2013, BGBl) in accordance with § 2 (1) Z 13 Gas-Systems-Use-charges Regulation 2013 (GSNE-VO 2013). II No 309/2012), in kWh. The quantity data to be reported by the balance group coordinators shall be based on the calorific value used for clearing.

(5) Where reference is made in this Regulation to provisions of other Regulations of E-Control, the provisions in force shall be applied.

Section 2

Current and historical data

Hourly values-daily surveys

§ 2. In each case at the latest by 2 p.m., hourly energy quantities must be reported for the last day of the day:

1.

the physical imports and exports per frontier coupling point of the network operators;

2.

by the producers, in so far as the notification is not made by the network operator, the feed from domestic production per network operator;

3.

by the storage companies, in so far as the notification is not made by the network operator, the feed and discharge from or from the network operator, respectively. storage systems in each storage facility;

4.

by the operators of storage facilities and the operators of production facilities, the physical imports and exports via lines which form part of the storage and/or storage facilities. The production plant is, in each case, per storage and/or Production plant;

5.

by the network operators, the levy on large customers, in each case separately according to the counting points.

Hourly-Monthly Hebrews

§ 3. (1) In each case at the latest by the working day after the last month of the reporting month, the hourly energy quantities of the network operators shall be the hourly quantities of energy from the network operators for the survey period from 6 a.m. to the month of the month of the following month. To report delivery quantities to end consumers (consumption).

(2) In each case at the latest by 20. Calendar day after the last month of the reporting month, for the survey period from 6 o'clock to the month of the month of the following month, 6 o'clock per hour of energy from the balance group coordinators are the quantities of the final consumer (consumption) and the self-consumption (levy to the balance sheet group network losses), in each case to be reported separately according to network operators. Corrections due to the second clearings must be reported immediately.

Week withdrawals

§ 4. (1) Each Wednesday at the latest by 2 p.m. for the time of the survey must be reported at 6 a.m.:

1.

from the storage companies or from the operators of storage facilities to the total content of the storage;

2.

the stored volume of working gas per storage undertaking by the natural gas distributors;

3.

by natural gas traders, the volume of the work gas available for each storage undertaking for the Austrian consumer supply;

4.

by the storage companies the sum of the contractually bound storage rates;

5.

by the producers the sum of the contractually bound production rates.

(2) Data referred to in paragraph 1 (1) (2) and (3) may be summarised in agreement with E-Control by the balance group responsible for the respective balance group and can be transmitted as an aggregate, specifying the natural gas dealers taken into account. In this case, the supplier of natural gas shall be released from his obligation to notify E-Control.

Monthly surveys

§ 5. In each case at the latest by 20. The calendar day after the last month of the month of the month is to be reported for the survey period from 6 p.m. to the month of the following month at 6 a.m.:

1.

by the network operators

a)

the total amount of the final consumer, excluding the levy on large-scale customers and the levy on gas-fired power stations with a contractually agreed maximum output of more than 50,000 kWh/h,

b)

the total supply to large-scale customers, with the exception of the supply of gas-fired power stations with a contractually agreed maximum output of more than 50,000 kWh/h,

c)

the total supply of gas-fired power stations with a contractually agreed maximum output of more than 50,000 kWh/h,

d)

physical imports and exports, separately after transfer points;

2.

by the operators of storage facilities and the operators of production facilities, the physical imports and exports via lines which form part of the storage and/or storage facilities. the production plant, in each case separately after crossing points;

3.

from the storage companies or from the storage facility operators for all storage facilities located on the territory of the Federal Republic of Germany, the storage movement, indicating the withdrawal and storage in each month of storage facilities, in each case separately by storage facility;

4.

by the producers or by the operators of production facilities of natural gas for all production plants located in the territory of the Federal Republic of Germany, the total production separately according to production facilities.

Surveys of 15. October

§ 6. At the latest by 15. October each year must be reported:

1.

by the network operators for final consumers with the same billing address, which have a contractually agreed maximum power of more than 50,000 kWh per hour on 30 September in sum over all the counting points, company and address (billing address) of the company, the counting point name (s) and the respective annual reference;

2.

From the major customers at the time of the survey 31. August 24 h separately per location:

a)

name and address as well as the corresponding count name (s),

b)

economic activity (s) in accordance with the classes of NACE (as amended), indicating the weighting given in relation to annual gas consumption;

c)

Performance and quantity data on gas consumption in the last twelve months,

d)

substitution possibilities for the use of natural gas by other sources of energy, specifying in particular the energy sources which can be used, the maximum possible reduction in the reference power of natural gas, the lead time for the changeover, and any technical or other restrictions.

Year-on-year surveys

§ 7. No later than 15 February of the date of the survey, or the following year shall be the date of the survey, respectively the date of the survey. for the survey period of 1. Report on the annual values in accordance with § 5 of January 0 to 31 December 24 h:

1.

by the network operators for the components of the levy (consumption)

a)

the number of final consumers measured at 31 December 24 o'clock, broken down by size class of the levy (consumption), with the gas-fired power stations having a contractually agreed maximum output of at least 50,000 kWh/h as the sum value shall be specified separately,

b)

the number of final consumers not measured by performance at 31 December 24 h, broken down on the one hand by the household, trade and other end-consumer groups and, on the other hand, by size classes of the levy (consumption),

c)

the levy on final consumers, broken down by size of the levy (consumption), with the gas-fired power stations with a contractually agreed maximum output of at least 50,000 kWh/h, to be given separately as the sum value,

d)

the supply of non-performing final consumers, broken down on the one hand by standard load profiles, by the household, trade and other end-consumer groups and, on the other hand, by size classes of the levy (consumption);

2.

from the storage companies or The storage volume, the maximum technical storage and storage rate as well as the existing upholstery gas are separated by the operators of storage facilities for all storage facilities located on the Federal territory at 31 December 24 h for each storage facility;

3.

by the producers or the maximum production rate for all production facilities on the territory of the Federal Republic of Germany at 31 December 24h by the operators of natural gas production facilities.

Section 3

Preview Data

Day previews

§ 8. (1) For the following day at the latest, each day at the latest by the balance sheet group responsible for the following day, the large customer schedules are to be reported separately according to locations as hourly energy quantities.

(2) The members of the balance-sheet group shall provide the accounting group responsible with the necessary values for the determination of the data in accordance with paragraph 1 in a timely manner and in the required quality.

Four-week previews

§ 9. (1) In each case once a week, the maximum possible, non-interruptible rates in kWh per hour shall be reported for the coming four weeks at the latest by Wednesday 2 p.m., beginning with the following Friday 6 o'clock, indicating the maximum possible, non-interruptible rates:

1.

from suppliers, the hourly rates available for end-consumer supply in the market area from the virtual trading point and from imports, the latter separately per feed point;

2.

from the suppliers, in addition to Z 1, the hourly rates which can be activated for the final consumer supply in the market area for the next day in each case from the virtual trading point and from imports, the latter separately per feed point;

3.

from the suppliers, the hourly rates available for the supply of end-users in the market area separately from each producer;

4.

from the producers, the hourly rates from production which can be activated in addition to Z 3 for the market;

5.

by suppliers, the hourly rates available for the supply of final consumers in the market area separately for each storage undertaking;

6.

of the storage companies the hourly rates for the storage of the storage, which can be activated in addition to Z 5 for the market area.

(2) Data referred to in paragraphs 1, Z 1 to 3 and Z 5 may, in consultation with E-Control, be summarised by the balance sheet group responsible for the respective balance sheet group and be transmitted as an aggregate together with the consideration of providers. In this case, the supplier is relieved of his obligation to notify E Control.

(3) Once a week, the distribution area manager shall, at the latest by Wednesday 2 p.m., start with the following Friday 6 a.m., at least for the next four weeks, a forecast for the total release to end users in the market area. report. A documentation of the methodology used by the distribution area manager as well as the assumptions made is to be transmitted once a year on request of E-Control.

Section 4

Data messages for the district heating sector

Under-year surveys

§ 10. From district heating companies with hydraulically connected district heating networks with a total heat transfer capacity of all the associated heating plants and heating power stations of at least 50 MW (thermal) or an entire annual heat output of at least 300 GWh shall be in each case at the latest by 20. Report calendar day after the month of the last month of the report:

1.

for the survey period from 0 p.m. to the last month of the month, the total heat output to a district heating network as hourly and daily measured values, in each case separately from natural-gas-fired plants and other installations;

2.

At the end of the survey month, the last 24 o'clock of the month, the stock of the fossil primary energy sources intended for electricity and heat generation, in each case separately according to the location.

Year-on-year surveys

§ 11. From district heating companies with hydraulically connected district heating networks with a total heat transfer capacity of all the associated heating plants and heating power stations of at least 50 MW (thermal) or an entire annual heat output of At least 300 GWh shall be reported at the latest by 15 February of the following year at the time of collection at the time of collection at the time of collection 31 December 24:

1.

the gross performance and the heat transfer capacity of all combined heat and power plants and heating units, separated by block;

2.

the gross performance and the heat transfer capacity of all combined heat and power plants and heating plants separately according to primary energy sources;

3.

the gross bottleneck performance and heat performance of gas-fired power stations and heating plants, which are substitutable by other than gaseous energy sources, in each case separately by location (power stations) and, in addition, by primary energy sources;

4.

the maximum storage capacity of the primary energy sources intended for the generation of electrical energy and for the generation of heat, in each case separately according to the location.

Section 5

Advanced Data Messages

Significant reduction of imports of natural gas into the federal territory

§ 12. Any significant reduction in imports shall be reported without delay by the transmission system operators, specifying in particular the quantities declared and actually fed in per feed-in point. This notification shall be sent to the distribution area manager at the same time.

(2) The notifications referred to in paragraph 1 are independent of the occurrence of a significant reduction in import volumes per year for the surveys of the 15. to be reimbursed in accordance with § 6.

Limitation of contractual deliveries of natural gas

§ 13. (1) Any restriction of contractual deliveries shall be made without delay by the suppliers, specifying in particular the proportion of the restriction on the declared deliveries as well as the expected duration and the feed points concerned. and the virtual trading point. This notification shall be forwarded simultaneously to the distribution area manager.

(2) The notifications referred to in paragraph 1 are independent of the occurrence of a restriction of contractual deliveries per year for the surveys of the 15. to be reimbursed in accordance with § 6.

Extended data reporting in the event of restriction of contractual deliveries of natural gas

§ 14. (1) If the restriction of contractual deliveries is more than 30%, the following data shall be reported on the order of E-Control:

1.

the group responsible for the balance sheet group daily, at the latest, the forecast end customer consumption of their balance sheet group on the following day of the day as hourly values. The members of the balance sheet group shall provide the balance group responsible for the values necessary for the determination of the data in good time and in the required quality;

2.

of district heating companies with a total heat transfer capacity of all heating plants and heating power stations of at least 50 MW (thermal) or an annual heat output of at least 300 GWh per day at the latest by 4 p.m.:

a)

for the survey period of the following guest-day, the planned hourly performance (timetable) of the gas collection,

b)

substitution possibilities for the use of natural gas as well as the planned use of substitution fuels, indicating the respective fuel reserves, and the possible full-load hours for the survey period of the next guest day;

c)

for the survey period from 0 to 24 o'clock of the previous day as hourly measurements, the total heat generation as well as the heat emission into a (public) district heating network, in each case separately according to natural gas-fired plants and other plants,

d)

for the survey period from 0 to 24 o'clock of the coming day as hourly values the planned total heat generation as well as the planned heat emission into a (public) district heating network, in each case separately according to natural gas-fired plants and other Installations;

3.

by the operators of power plants, plants with combined heat and power, (Fern) heating power plants and heating plants with a total power (electric and thermal) of at least 25 MW or those directly at the grid levels according to § 63 Z 1 to 3 ElWOG 2010 The survey contents according to Z 2 are each separated according to the blocks by at least 16 o'clock daily for the survey period from 0 to 24 o'clock of the coming day.

(2) The reporting obligations referred to in paragraph 1 shall remain in force for a period of three working days from the date on which a restriction of contractual deliveries has last passed by more than 30%.

(3) If the restriction of contractual deliveries is more than 30%, changes to the information pursuant to § 9 para. 1 shall be announced without delay on order of the E-Control.

(4) The notifications referred to in paragraph 1 are independent of the occurrence of a restriction of contractual deliveries per year for the surveys of the 15. to be reimbursed in accordance with § 6.

Crisis enhancements

§ 15. (1) If the conditions pursuant to § 4 (1) EnLG 2012 are fulfilled, the E-Control may in particular:

1.

Arrange the reporting of the data in accordance with § 2 within the next hour;

2.

the reporting of the data pursuant to § 3 (1) daily and/or in each case within the next hour;

3.

Arrange the reporting of the data according to § 4 (1) daily;

4.

the reporting of the data in accordance with § 7 Z 1 lit. a and lit. b, Z 2 and Z 3 as well as § 10, § 11, § 16 para. 2 as well as § 17 are in each case currently arranged;

5.

Arrange the reporting of the data according to § 8 and § 9 para. 1 at shorter intervals as well as for a longer preview horizon.

(2) Data in accordance with paragraph 1 are independent of the existence of the conditions pursuant to § 4 (1) EnLG 2012 per year for the 15. October 2008.

6.

Arrangements for the event of a crisis

Monitoring of security of supply

§ 16. (1) For the purposes of the monitoring of security of supply, the transmission system operators shall be each year from 1 to 30 April each year for the survey period of 1 January 2007. Jänner 6 o'clock of the previous year up to 1. January 6 o'clock of the current year and, at least for the two years following the reporting year, a description of the maintenance and expansion programmes carried out and planned, including a general description of the Maintenance and extension strategies, broken down according to network levels and operating resources.

(2) The natural gas undertakings shall be at the latest by 15. October of each year for the survey time 1. October 6 Clock of the reference year, the quantities actually paid for the past twelve months from imports of natural gas from imports with a duration more than one-year duration, and the contracted annual quantities (maximum contract values) for the twelve months, including the remaining term (s).

Contact persons and persons responsible for crisis

§ 17. (1) Companies subject to notification shall have to be registered at the latest by 15. to report the persons responsible for the collection and transmission of data and report their contact details. If the persons displayed are divorced from the company or if the advertisement is revoked, the persons now responsible and their contact details are to be notified immediately.

(2) Natural gas undertakings, district heating undertakings and large-scale customers shall each have at the latest by 15. The report will be published in October by those persons who are responsible for the implementation of management measures, and to report their contact details. These persons must have the right to implement steering measures and must, in the event of the conditions laid down in § 4 (1) EnLG 2012their availability or their representation within a appropriate period of time. If the persons displayed are divorced from the company or if the advertisement is revoked, the persons now responsible and their contact details are to be notified immediately.

(3) Natural gas undertakings as well as district heating companies shall each have at the latest by 15. Contact details of a post which can be reached at any time in the event of a crisis, which can contact the group of persons in accordance with paragraph 2. Changes to this at any time can be made immediately known.

Exercises

§ 18. Every two years exercises can be arranged by the E-Control with the acceptance of crisis scenarios. For this purpose, the extensions according to § 12 bis § 15 can be arranged for the period of a calendar week.

Section 7

Data Messages

Reporting and disclosure requirements

§ 19. (1) For the purposes of this Regulation, notifiable undertakings are operators of storage and/or storage systems. production facilities, balance-sheet groups responsible, natural gas traders, transmission system operators, large-scale customers, market area managers, producers, storage companies, suppliers, distribution area managers, distribution system operators, and Balance group members and district heating companies.

(2) The holder or the body responsible for the external representation of a reporting company shall be subject to information.

Data Formats

§ 20. All data are to be transmitted to the E-Control in electronic form. directly on an electronic input platform set up by the E-Control. The formats or the input platform is defined by the E-Control and is made available in electronic form on the Internet.

Transfer and use of data

§ 21. (1) Data collected on the basis of this Regulation may be used exclusively for the purposes provided for in the EnLG 2012.

(2) In accordance with Section 27 (9) of the EnLG 2012, the distribution area manager or the market area manager for the preparation and operational execution of steering measures on request data according to § 2 bis § 11 as well as § 16 and § 17 as currently or as possible as possible or until 31 May of the survey period, the following year shall be made available in electronic form by means of uniform formats at the time of the survey.

(3) For reasons of simplicity and usefulness

1.

The reporting of the data pursuant to § 2 and § 4 (1), which is available to the distribution area manager or the market area manager, is directly from this, in compliance with in particular the quality, the reporting deadlines and the data formats to the E-Control , Data transmitted by the market area manager to the E-Control shall be transmitted simultaneously to the distribution area manager;

3.

The reporting of the data pursuant to § 12 (1), which is available to the market area manager, is to be carried out directly by the market area manager, with due regard in particular to the quality, the reporting deadlines and the data formats to the E-Control. Such data shall be transmitted at the same time to the distribution area manager.

4.

on the one hand, and on the other hand, on the basis of agreement between the respective reporting person and the E-Control and the distribution area manager, a direct transmission of the data to the distribution area manager and a forwarding by the Distribution area manager to the E-Control, in compliance with the quality, the reporting deadlines as well as the data formats.

In these cases, the respective reporting requirements are released from their reporting obligations to E-Control.

Transitional provisions

§ 22. (1) The data in accordance with § 4 (1) shall be reported for the reporting month of July 2014 at the latest by 15 August 2014.

(2) The information according to § 6 Z 1 and § 7 Z 1 lit. a and lit. b as well as Z 2 and 3 are to be transmitted for the first time for the survey time 1 July 2014 24 h by 15 August 2014 at the latest

(3) The data according to § 7 Z 1 lit. c and d are to be transmitted for the entire calendar year 2014 to 15 February 2015.

(4) The information in accordance with § 10 shall be transmitted for the entire winter half-year 2013/2014 until 15 August 2014.

(5) The data in accordance with § 11 shall be submitted for the first time for the survey time of 1 July 201424 and no later than 15 August 2014.

entry into force

§ 23. (1) This Regulation shall enter into force on 1 July 2014.

(2) With the entry into force of this Regulation, the gas-energy-collection data-Regulation 2006 of 21 December 2006, made known in the Official Journal of the Vienna newspaper No 250 of 28 December 2006, as amended by the Gas Energy Data Regulation-Regulation 2006 of 29 June 2009, published in the Official Journal of the Vienna newspaper no. 125 of 1 July 2009.
