189. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, by means of which the Regulation implementing Community market order measures in the wine sector, the DAC Regulation "Neusiedlersee", the vine variety regulation as well as the wine labelling regulation

On the basis of § § 6, 7 (1) Z 14 and 15 and (4), 22, 28 and 32 (3) of the Law on the Market Order 2007 (MOG 2007), BGBl. I n ° 55/2007, as last amended by the Federal Law BGBl. I n ° 189/2013, and on the basis of § § 10 para. 6, 22 and 34 of the Weingesetz 2009, BGBl. I n ° 111/2009, as last amended by the Federal Law BGBl. I No 189/2013, shall be arranged:

1. The Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the implementation of Community market organisation measures in the wine sector, BGBl. II No 279/2013, shall be amended as follows:

1. In Article 6, the following paragraph 6 is added:

"(6) The aid may be granted in advance if a security in the form of a bank guarantee is deposited in the amount of 110% of the advance payment."

2. Section 14 (2) reads as follows:

" (2) Changes to the gem. § 7 para. 6 of the approval notice as well as the reasons for this are to be requested in writing immediately by way of the cataster-leading office at the BMLFUW. The BMLFUW has to make a modest decision on changes affecting the level of aid, the land affected by the conversion measures or the approved management method. The change of a modest-approved conversion plan can only take place once and does not extend the deadlines according to. Section 12 (1). "

3. § 29 reads as follows:

" Sanctions

§ 29. (1) In the event that an eligible establishment does not fulfil the conditions or requirements of this Regulation or in another way does not comply with the provisions of this Regulation, disbursements may be refused or the amount of aid paid may be paid out. are reclaimed.

4. Annex II, lit. c (4) shall read as follows:

The upper limit for the extent of the terrace wall, which is based on the plot, is derived from a percentage of the total area of the land concerned. This percentage is calculated as follows for plot areas of up to 1 ha as follows:% = (20-land area in m²/1000). For land areas of more than 1 ha, the percentage shall be 10%. "

5. In Annex IV, point 1, lit. a and lit. b respectively supplemented as follows:

"-

The maximum eligible investment amount is 3 euros per litre of capacity. "

2. The regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for regional quality wines with origin profiles for the Neusiedlersee wine-growing region (DAC Regulation Neusiedlersee), BGBl. II No 90/2012, as amended by the BGBl Regulation. II No 48/2013, shall be amended as follows:

1. § 2 Z 2 reads:

" 2.

The indication of the vine variety or of a smaller geographical unit than the wine-growing region shall be made in such a way that it is subordinated to the indication 'Lake Neusiedl'. '

2. § 2 Z 3 reads:

" 3.

The indication of a further sales description is inadmissible (in particular, traffic designations such as "quality wine", "cabinet" or "late harvest"); likewise the indication of the traditional terms "classical" and "premium". The designations "DAC" or "Districtus Austriae Controllatus" shall be indicated on the label in direct connection with the wine-growing area of Neusiedlersee and in written signs which are significantly smaller than those for the indication "Neusiedlersee" used. "

4. The Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the designation of wines, BGBl. II No 111/2011, shall be amended as follows:

1. § 7 together with headline reads:

" Residual sugar content

§ 7. (1) In the case of wine-containing beverages, aromatised drinks and non-alcoholic wines, only the flavours of Article 64 in connection with Annex XIV Part B of Regulation (EC) No 607/2009 may be used.

(2) The following flavouring indications are permitted in the case of sparkling wine:

1.

dry: residual sugar content between 0 and 35 g/l;

2.

Semi-dry: residual sugar content between 35 and 50 g/l;

3.

mild: residual sugar content more than 50 g/l.

The taste information of Perlwein can be provided voluntarily and in the appropriate translations. It is also permissible to specify the residual sweetest content in grams per litre. "

2. § 11 together with the headline is:

" Production of quality wine and wine as well as predicate wine

§ 11. For the purpose of Article 6 (4) of Regulation (EC) No 607/2009, predicate wines, quality wine and agricultural wine may be produced in the wine-growing region of the wine-growing region concerned and in wine-making regions adjacent thereto. The content of unfermented sugar may be taken up in the case of an increase in the sugar content. Sweetened quality and country wine shall not exceed the content of 15 g per litre, tolerating a deviation of 3 g per litre. The volatile acid content may be used in the meaning of Annex I C Z 3 lit. a second indent of Regulation (EC) No 606/2009 laying down detailed rules for the application of Regulation (EC) No 479/2008 as regards the categories of wine products, the oenological practices and the restrictions thereto, OJ L 327, 31.12.2009, p.
