247. Regulation of the Federal Minister for Science, Research and the Economy on the granting of study allowance to candidates of the additional examinations for admission to a university of applied sciences degree course

According to § 5 (2) of the Student Promotion Act 1992 (StudFG), BGBl. No 305/1992, as last amended by the Federal Law BGBl I No. 40/2014, is hereby assigned in agreement with the Federal Minister of Finance:

Equality

§ 1. (1) Persons who are subject to additional examinations in accordance with § 4 paragraph 7 of the Universities of Applied Sciences (FHStG), BGBl. No. 340/1993, as amended by BGBl I No. 45/2014, ordinary students are equated with regard to the entitlement to study grants according to the Law on the Promotion of Studies.

(2) Equality only takes place for the first time the access authorization to a university of applied sciences degree course. An equivalence under this Regulation shall be excluded if an admission to a university is already admitted to a university.

Duration

§ 2. (1) The duration of the equal treatment and thus the duration of the study allowance is one semester, provided that no more than two examination subjects are to be completed, otherwise not more than two semesters.

(2) As the first semester of equality, the semester in which the admission to additional examinations was carried out in accordance with § 4 paragraph 7 FHStG, and at the latest the semester following the admission, is valid at the earliest. The candidate is free to choose the candidate.

§ 3. (1) The entitlement to study aid pursuant to this Regulation shall be issued with the end of equality.

(2) Equality shall end with:

1.

the expiry of the duration of the claim or

2.

Admission to an ordinary course of study at an educational institution mentioned in § 3 StudFG or

3.

Expiry of the month in which the last prescribed additional examination has been completed, provided that the university of applied sciences (Fachhochschul-Bachelorstudium) is not accepted in the following semester.

Proof of favourable study success

§ 4. In order to exclude the repayment obligation pursuant to § 51 paragraph 1 Z 5 StudFG within the application period (§ 39 para. 2 StudFG) of the semester after the end of the equivalence evidence of the successful deposit of at least half of the to submit additional exams that have been completed.

§ 5. (1) This Regulation shall enter into force 1. October 2014, in force.

(2) This Regulation shall apply for the first time to applications for study aid from the academic year 2014/15.
