Presentation by the Federal Minister of Arts and Culture, the Constitution and the Media concerning the corrigendum to the agreement between the Austrian Federal Minister for Europe, Integration and Foreign Affairs and the Norwegian Minister for Foreign Affairs on the Representation of Austria in the procedure for the granting of Schengen visas in Lilongwe (Malawi)

On the basis of § 10 Z 1 of the Federal Law Gazette Act-BGBlG, BGBl. I n ° 100/2003 idgF, shall be made known:

The published German-language translation of the Austrian opening note of the agreement between the Austrian Federal Minister for Europe, Integration and Foreign Affairs and the Norwegian Minister for Foreign Affairs on the Representation of Austria in the proceedings of the granting of Schengen visas in Lilongwe (Malawi), BGBl. The Austrian Embassy in Oslo offers the Royal Norwegian Ministry of Foreign Affairs its recommendation and is honoured to propose the following agreement:

Norway will represent Austria in matters relating to all types of visa applications at the following consular post:

Lilongwe (Malawi)

The present verbal note and the reply note of the Royal Norwegian Ministry of Foreign Affairs, in accordance with Article 8.4 of Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009, shall be adopted. In 2009, a bilateral agreement on a Community Code on Visas (Visa Code), which entered into force on 05 April 2010, is a bilateral agreement. The agreement is to be implemented in accordance with the Community Code on Visas and in accordance with the provisions of this Agreement.

The factual conditions of application of this agreement may reach agreement informally.

The Austrian Embassy in charge of the Austrian Embassy is the Austrian Embassy in Nairobi (hereinafter referred to as the Austrian Embassy). Address, telephone and fax data as well as email addresses and contact persons of the Austrian Embassy will be communicated in written form. If the Norwegian Embassy in Lilongwe, (the following: the Embassy) considers that all the conditions for issuing a visa, in accordance with the Community Code on Visas, are met, the Embassy will issue the Visum.

Should the Embassy come to the conclusion that the conditions for issuing a visa, in accordance with the Community Code on Visas, are not given, the embassy will be empowered to reject the issuance of a visa, as laid down in Article 8, paragraph 4 (d) of the Community Code on Visas.

The embassy has the power to place visas on those travel documents, which are recognized as valid by the Austrian authorities as well as by the Norwegian authorities.

Visas with limited territorial validity can only be issued with the consent of the Austrian Embassy. This provision shall not be applicable, provided that the restriction is based solely on the fact that the travel document is not recognised as valid by all Schengen States, unless Austria does not recognise the validity of the travel document.

Norway will inform Austria about the visas issued after a general or concrete request has been made. Visa fees are to be raised in accordance with the Schengen acquis, with Norway being entitled to any visa fees. In addition, Austria is not supposed to make payments to Norway for the processing of visa applications.

In the event of the Norwegian Foreign Minister's agreement to this Agreement, the Austrian Embassy will be honoured to propose that this note as well as the confirming note of the Royal Norwegian Ministry of Foreign Affairs be a The agreement between the Austrian Federal Minister for Europe, Integration and Foreign Affairs and the Norwegian Minister for Foreign Affairs is to be formed. This agreement is due to enter into force on August 15, 2014 and can be suspended or lifted from both sides by means of a verbal note at any time.

The Austrian Embassy is using this opportunity to renew the insurance of its excellent high esteem to the Royal Norwegian Ministry of Foreign Affairs.
