192. Presentation by the Federal Minister for Arts and Culture, the Constitution and the Media concerning amendments to Article 6 and Annex 9 to the Customs Convention on International Transport of Goods by TIR Carnets (TIR Agreement)

On the basis of § 5 paragraph 1 Z 6 of the Federal Law on the Federal Law Gazette 2004 (BGBlG), BGBl. I n ° 100/2003 idgF, shall be made known:

According to Annex 8 of the TIR Agreement (BGBl. No 112/1978, as last amended by BGBl. III n ° 139/2012) on 9 February 2012, the Management Committee adopted the following amendments to Article 6 and Annex 9 of the TIR Agreement:

Article 6, paragraph 2 to

Modify paragraph 2 to read:

2 bis. An international organization shall be authorized by the Administrative Committee to take on responsibility for the effective organization and functioning of an international guarantee system. The authorization shall be granted as long as the organization shall establish the conditions and requirements laid down in Annex 9, Part III. The Administrative Committee may revoke the authorization if these conditions and requirements are no longer fulfilled.

Annex 9, new part III

Insert a new part III to read:

Authorization of an international organization, as referred to in Article 6, to take on the responsibility for the effective organization and functioning of an international guarantee system and to print and distribute TIR carnets

Conditions and reguirements

1. The conditions and requirements to be carried out with by an international organization in order to be authorized, in accordance with Article 6.2 bis of the Convention, by the Administrative Committee to take on the responsibility for the effective organization and functioning of an international guarantee system and to print and distribute TIR carnets are:

(a)

Proof of sound professional competence and financial standing for the effective organization and functioning of an international guarantee system and the organizational capabilities to fulfil its obligations under the Convention by means of annual submissions of consolidated financial statements duly audited by internationally recognized independent auditors;

(b)

Absence of serious or repeated offences against Customs or tax legislation.

2. To the authorization, the international organization shall shall:

(a)

provide the Contracting Parties of the TIR Convention via the national associations affiliated to the international organization with certified copies of the global guarantee contract and proof of guarantee coverage;

(b)

provide the competent bodies of the TIR Convention with information on the rules and procedures set out for the issue of TIR Carnets by national associations;

(c)

provide the competent bodies of the TIR Convention, on a yearly basis, with data on claims conferred, pending, paid or settled without payment;

(d)

provide the competent bodies of the TIR Convention with full and complete information on the functioning of the TIR system, in particular, but not limited to, timely and well founded information on trends in the number of non-terminated TIR operations, claims lodged, pending, paid or settled without payment that might give rise to concerns with regard to the proper functioning of the TIR system or that could lead to difficulties for the continued operation of its international guarantee system;

(e)

provide the competent bodies of the TIR Convention with statistical data on the number of TIR Carnets distributed to each Contracting Party, broken down by type;

(f)

provide the TIR Executive Board with details of the distribution price by the international organization of each type of TIR Carnet;

(g)

take all possible steps to reduce the risk of counterfeiting TIR Carnets;

(h)

take the appropriate corrective action in cases where faults or tes with the TIR Carnet have been detected and report these to the TIR Executive Board;

(j)

fully participate in cases where the TIR Executive Board is called upon to facilitate the settlement of disputes;

(k)

ensure that any problem involving fraudulent activities or other difficulties with regard to the application of the TIR Convention is immediately brought to the attention of the TIR Executive Board;

(l)

manage the control System for TIR Carnets, provided for in Annex 10 of the Convention, together with national guaranteeing associations affiliated to the international organization and the Customs authorities and inform the Contracting Parties and the competent bodies of the Convention of problems encountered in the system;

(m)

provide the competent bodies of the TIR Convention with statistics and data on the performance of Contracting Parties with regard to the control system provided for in Annex 10;

(n)

concluded, not less than two months before the provisional date of entry into force or renewal of the authorization granted in accordance with Article 6.2 to the Convention, a written agreement with the United Nations Economic Commission for Europe secretariat, mandated by and acting on behalf of the Administrative Committee, which shall include the acceptance by the international organization of its duties set out in this paragraph.

3. When the international organization is informed by a guaranteeing association of a claim for payment, it shall, within a period of three (3) months inform the guaranteeing association of its position concerning the claim.

4. All information acquired, directly or indirectly, by the international organization under the Convention, which is by nature confidential or which is provided on a confidential basis, shall be covered by the obligation of professional secrecy and shall. not be used or processed neither for any commercial purpose nor for any other purpose than for which it has been provided or disclosed to any third party without the express permission of the person or authority that provided it. Search information may, however, be disclosed without permission to competent authorities of Contracting Parties to this Convention, where there is an authorization or obligation to do so pursuant to provisions of national or international law or in connection with legal proceedings. The disclosure or communication of information shall take place in full compliance with data-protection provisions in force.

5. The Administrative Committee shall have the right to revoke the authorization granted in accordance with Article 6.2 bis in case of non-compliance with the above conditions and requirements. Should the Administrative Committee decide to revoke the authorization, the decision will become effective at the earliest six (6) months afterthe date of revocation.

6. The authorization of an international organization under the terms set out above shall be without prejudice to that organization's responsibilities and liabilities under the Convention.

Article 6, paragraphe 2 to

Conditions et prescriptions

1. Les conditions et les prescriptions auxquelles doit satisfaire une organisation internationale pour être autorisée par le Comité de gestion, conformément au paragraphe 2 bis de l' article 6 de la Convention, à assumer la responsabilité de l' organisation et du fonctionnernent efficaces d' un système de warranty international et à imprimer et distribuer des carnets TIR sont les suivantes:

a)

Preuve de sa compétence professionnelle et de sa Consolité financière aux fins de l' organisation et du fonctionnenient efficaces d' un système de guarantee international, et de ses capacits à s' acquitter de ses obligations au titre de la Convention, fournie chaque année en communiquant des états financiers consolidés, dûment examinés par des vérificateurs indépendants ayant une réputation internationale;

b)

Absence d' infractions graves ou répétées à la législation douanière ou fiscale.

2. Comme le prévoit l' autorisation, l' organisation internationale s' engage à:

a)

Fournir aux Parties contractantes à la Convention TIR, par l' intermédiaire des associations national qui lui sont affiliées, des copies certifiées conformes du contrat général de warranty et la preuve de la couverture de la guarantee;

b)

Informer les organes compétents de la Convention TIR des règles et des procédures de délivrance des carnets TIR par les associations national;

c)

Fournir tous les ans aux organes compétents dc la Convention TIR des données sur les demandes de paiement soumises, en suspens, réglées avec paiement ou réglées sans paiement;

d)

Fournir aux organes compétents de la Convention TIR des informations complètes sur le fonctionnement du régime TIR notamment, mais pas seulement des renseignements à jour et bien fondés sur les tendances révélées par le nombre d' opérations TIR non terminées et de demandes de paiement soumises, en suspens, réglées avec paiement ou régées sans paiement qui pourraient faire douter du bon fonctionnement du régime TIR ou rendre plus difficile le maintien en vigueur du système de warranty international;

e)

Fournir aux organes compétents de la Convention TIR des données statistiques sur le nombre de carnets TIR distribués à chaque Partie contractante, valve ées par type;

f)

Fournir à la Commission de contrôle TIR des explications détaillées sur les prix des carnets TIR appliquées par l' organisation internationale pour chaque type de carnet TIR;

g)

Prendre toutes les mesures possibles pour réduire le risque de contrefaçon des carnets TIR;

h)

Prendre les mesures correctives appropriées pour remédier aux lacunes ou défauts constatés dans les carnets TIR et en rendre compte à la Commission de contrôle TIR;

j)

Intervenir en collaborant sans réserve dans les affaires où la Commission de contrôle TIR est appelée à faciliter le rèlement d' un différend;

k)

Veiller à ce que les problèmes soulevés par une activité frauduleuse ou quelque autre tique et rencontrée dans l' application de la Convention TIR soient immédiatement portés à l' attention de la Commission de contrôle TIR;

l)

Gérer le système de contrôle des carnets TIR, prévu à l' annexe 10 de la Convention, avec les associations garantes national qui lui sont affiliées et les autorités douanières, et saisir les Parties contractantes et les organes compétents de la Convention TIR des problèmes rencontrés dans le fonctionnement du système;

m)

Fournir aux organes compétents de la Convention TIR des données et des informational statistiques sur les résultats obtenus par les Parties contractantes avec le système de contrôle prévu à l' annexe 10;

n)

Conclure, au minimum deux mois avant la date provisoire de l' entre en vigueur ou du renouvellement de l' autorisation accordée en vertu du paragraphe 2 bis de l' article 6 de la Convention, avec le secrétariat de la Commission éonomique des Nations Unies pour I ' Europe, mandaté par le Comité de gestion et agissant en son nom, un accord écrit qui prévoira i'acceptation par l' organisation internationale de ses fonctions définies dans le présent paragraphe.

3. Lorsque l' organisation internationale est informée par une association garante d' une demande de paiement, elle doit, dans un délai de trois (3) mois, informer l' association garante de sa position au sujet de la demande.

4. Toute information de nature confidentielle ou fournie à titre confidentiel obtenue directement ou indirectement par l' organisation internationale en vertu de la Convention est couverte par le secret professionnel et ne peut être utilisée ou traitée à the fins commerciales ni à aucune autre fin que celle pour laquelle elle a été fournie, ni divulguée à des tiers, sans la permission expresse de la personne ou de l' autorité qui l' a fournie. 5. Le Cornité de gestion a le droit de révoquer l' autorisation accordée conformément au paragraphe 2 bis de l' articie 6 de la Convention en cas de manquement aux conditions et prescriptions ci-dessus. Dans le cas où le Comité de gestion déciderait de révoquer l' autorisation, la décision deviendrait effective au plus tôt six (6) mois après la date de la révocation.

6. L' habilitation d' une organisation internationale dans les conditions énoncées ci-dessus ne préjuge pas des responsabiIités et engmanagement incombant à cette organisation en vertu de la convention.

Article 6 (2) to

Paragraph 2 shall be replaced by the following:

(2 bis) The Management Committee shall allow an international organisation to assume responsibility for the effective design and functioning of an international guarantee scheme. The authorisation shall be granted as long as the organisation fulfils the conditions and requirements laid down in Annex 9, Part III. The Management Committee may revoke the authorisation if these conditions and requirements are no longer fulfilled.

Annex 9 Part III

A new Part III, with the following text, is drawn:

Authorisation of an international organisation in accordance with Article 6 to assume responsibility for the effective design and operation of an international guarantee scheme, as well as to the pressure and distribution of TIR carnets

Requirements and requirements

An international organisation must fulfil the following conditions and requirements in order to ensure that the responsibility for the effective design and functioning of the system is complied with in accordance with Article 6 (2) to the Convention by the Management Committee. of an international guarantee scheme, as well as for the printing and distribution of TIR carnets:

a)

Proof of professional competence and financial standing for the effective design and functioning of an international guarantee system, as well as the organisational competence to fulfil their obligations under the Convention by the annual presentation of the consolidated accounts, duly audited by internationally recognised independent auditors:

b)

No serious or repeated infringements of customs or tax legislation.

2. According to the authorisation, the international organisation shall ensure that:

a)

The Contracting Parties to the TIR Convention shall obtain certified copies of the worldwide guarantee contract and proof of the coverage of the guarantee by means of the national associations affiliated with the international organisation.

b)

The competent bodies of the TIR Convention shall obtain information on the rules and procedures laid down by the national associations for the issue of TIR carnets.

c)

The competent bodies of the TIR Convention shall receive annual data on claims which have been declared, outstanding, paid or unpaid.

d)

The competent bodies of the TIR Convention shall provide full and complete information on the functioning of the TIR system, in particular, but not exclusively, timely and well-informed information on trends in the number of uncompleted TIR operations, the claims outstanding, settled or unpaid, which give rise to concerns or difficulties with regard to the proper functioning of the TIR system; the continued operation of its international guarantee system.

e)

The competent bodies of the TIR Convention shall obtain statistical data on the number of TIR carnets distributed to all Contracting Parties, which shall be broken down according to their nature.

f)

The TIR Control Commission will receive detailed information on the price of each type of TIR carnet that is distributed by the international organisation.

g)

It shall take all possible steps to reduce the risk of counterfeiting of TIR carnets.

h)

In cases where errors or defects have been detected in relation to the TIR carnets, it shall notify the TIR Control Commission and shall take appropriate remedial action.

j)

In cases where the TIR Control Commission is requested to facilitate the settlement of disputes, it shall participate fully.

k)

Any problem relating to fraudulent activities or any other difficulties with regard to the application of the TIR Convention shall be notified immediately to the TIR Control Commission.

l)

It shall administer the control system for carnets TIR provided for in Annex 10 to the Convention, together with the national guaranteeing associations and the customs authorities attached to the international organisation, and shall inform the Contracting Parties and the competent bodies of the Convention of problems that have occurred in the system.

m)

The competent bodies of the TIR Convention shall receive statistics and data on the performance of the Contracting Parties with regard to the control system provided for in Annex 10.

n)

At the latest two months before the date of entry into force or the renewal of the authorisation referred to in Article 6 (2) to the Convention, it shall conclude with the Secretariat of the United Nations Economic Commission for Europe, which shall: The Administrative Committee shall, acting on its behalf, issue a written agreement in which the international organisation shall accept its tasks pursuant to this paragraph.

3. If the international organization is informed by a guaranting association about a payment request, it shall set the guaranteeing association within a period of three (3) months from its point of view regarding this payment request in Knowledge.

Any information collected directly or indirectly by the international organization within the framework of the Convention, which, by its nature, is confidential or is communicated confidentially, shall be covered by the obligation of confidentiality and shall not be subject to: For commercial purposes, for purposes other than those for which they have been made available, are used or processed and may not be accessible to third parties without the express consent of the person or authority which has provided them . The information may, however, be made available to the competent authorities of the Parties to this Convention without the consent of the Contracting Parties, if, in accordance with national or international legal provisions or in connection with legal proceedings, a Authorisation or obligation to do so. The disclosure or transmission of data shall be carried out in compliance with the applicable data protection rules.

The Management Committee shall have the right to revoke the authorisation granted in accordance with Article 6 (2), in the event of non-compliance with the conditions and requirements referred to above. If the Management Committee decides to revoke the authorisation, the decision shall take effect no earlier than six (6) months after the date of withdrawal.

The authorisation granted to an international organisation in accordance with the provisions of the above provisions shall be without prejudice to the responsibilities and obligations of that organisation under the Convention.

The amendments shall be amended in accordance with Article 59 (3) of the Agreement with 10. It entered into force in October 2013.
