253. Regulation of the Federal Minister for Science, Research and Economy and the Federal Minister of Finance on the preparation of housing and housing price indices

On the basis of § § 4 to 10, 19 and 30 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Budgetaccompanying Act 2014, BGBl. I n ° 40/2014, shall be assigned in agreement with the Federal Chancellor:

Arrangement for the preparation of housing and housing price indices

§ 1. (1) The Bundesanstalt "Statistik Österreich" (Bundesanstalt) has been responsible for the fulfilment of Austria's obligations under the following conditions:

1.

Regulation (EU) No 93/2013 laying down detailed rules for the application of Regulation (EC) No 2494/95 with a view to the creation of price indices for self-used residential property,

2.

Regulation (EU) No 1174/2011 laying down enforcement measures for the correction of excessive macroeconomic imbalances in the euro area,

3.

Regulation (EU) No 1176/2011 on the prevention and correction of macroeconomic imbalances and

4.

of Regulation (EU) No 549/2013 on the European system of national and regional accounts in the European Union (ESA 2010)

collect data for the purposes set out in paragraph 2 in accordance with this Regulation.

(2) On the basis of the data collected in accordance with paragraph 1, the Bundesanstalt shall draw up:

1.

the price index for self-used residential property,

2.

the real estate price index and

3.

Calculations of non-financial balance sheets on land and land in accordance with ESA 2010.

Definitions

§ 2. For the purposes of this Regulation:

1.

Price index for self-used residential property: Index, which is used to develop the transaction prices of the new households sector "Private households" according to ESA 2010, and the prices of other goods and services provided by private households are purchased for their own use and are related to the ownership of living space and the transfer of the same; and other goods and services are materials and services for repairs and renovations, as well as insurance and brokerage, notary's and the understanding of registration fees incurred in the establishment and maintenance of private home ownership;

2.

Real estate price index: Index, which measures the evolution of the actual transaction prices of the living space purchased by the "private households" sector in accordance with ESA 2010;

3.

Houses: buildings which, by their nature and size, are suitable for the sole purpose of satisfying individual residential needs of people;

4.

Apartments: Construction-completed parts of a building, which are independent of the traffic, and are suitable according to their type and size to serve the satisfaction of individual housing needs of people.

Periodicity, continuity

§ 3. The surveys are to be carried out on a quarterly basis over the previous quarter (reporting period).

Survey mass, statistical units

§ 4. Statistical units within the meaning of this Regulation shall be:

1.

land for which market transactions are paid in the reporting periods;

2.

houses and dwellings that are transferred to private households in the periods of the reporting period;

3.

Undertakings referred to in Articles 1 and 2 of Regulation (EEC) No 696/93 concerning the statistical units for the observation and analysis of the Community economy, which is an activity in accordance with subclass F 41.20-1 of the Annex to Regulation (EC) No No 1893/2006 establishing the statistical classification of economic activities NACE Revision 2 and amending Council Regulation (EEC) No 3037/90 as well as certain EC Regulations on certain areas of statistics on a regular basis as well as in the Intention to obtain a yield or other economic benefits and in the framework of these activities, sell goods or provide services to households.

Survey characteristics

§ 5. The following are to be collected:

1.

the characteristics of the statistical units according to § 4 Z 1 and 2

a)

Purchase price;

b)

the number of the basic book, the Katastral municipality and the land number;

c)

Type of land plot (Bebautes plot, unfinished land);

d)

the type of transaction,

e)

Tax rate;

f)

Purchase contract date;

g)

Land area in m 2 ;

h)

Location parameters (location, zip code, street, house number);

i)

Dedication of the land plot (building land, grassland/open country, other specifations)

2.

in addition to the characteristics of the statistical units according to § 4 Z 2

a)

Location parameters (staircase, door number) of the apartment;

b)

Type of use and sector allocation according to ESA 2010 (Sectors Private household, Non-financial corporations, Financial corporations, State);

c)

Building area of the house in m 2 ;

d)

Floor area of the house or apartment in m 2 ;

e)

Home ownership;

f)

Information as to whether basement, warehouse, car parking space, terrace, balcony, garden in one apartment is available and on which floor an apartment is located;

g)

Construction period, number of residential units, number of floors, type of building owner, type of property, energy number;

3.

through the statistical units according to § 4 Z 3 of the retail price of prefabricated houses.

Type of survey

§ 6. The survey characteristics shall be collected in the following ways:

1.

the characteristics according to § 5 Z 1 lit. a to f by the procurement of administrative data of the Federal Government's tax authorities, which are the result of an electronic declaration pursuant to § 10 or electronic declaration pursuant to § 13 para. 1 of the German Basic Value Tax Act 1987 by party representatives ;

2.

the characteristics according to § 5 Z 1 lit. g to i, § 5 Z 2 lit. a to f as well as those characteristics which cannot be collected from administrative data according to Z 1, by using the data from the land register, including the collection of documents (General Basic Law Gazette Act 1955-GBG. 1955);

3.

the characteristics according to § 5 Z 2 lit. g, as well as those characteristics which cannot be collected from administrative data according to Z 1 and 2, by using the data from the central building and housing register of the Federal Institute (GWR-Gesetz);

4.

the characteristic according to § 5 Z 3 by questioning of the enterprises in accordance with § 4 Z 3 on the basis of a representative sample selection.

Selection of the survey units for the survey according to § 6 Z 4; Sample

§ 7. (1) The Bundesanstalt has to select the survey units for the survey according to § 6 Z 4, which are considered to be representative (principle of representative selection).

(2) The representative survey units shall be considered to be representative if they have an industry-specific turnover meaning that they, if necessary supplemented by random sampling of selected survey units, shall be Foresight after the price development of the represented industry sufficiently reliable.

(3) The Bundesanstalt has to select the survey units on the basis of the data from the register of the statistical units in accordance with § 25a of the Federal Statistics Act 2000.

Exchange of information

§ 8. (1) The Bundesanstalt has to obtain the feature in writing electronically and in justified cases in accordance with § 5 Z 3 within 60 calendar days after the end of the previous quarter.

(2) The exchange of information pursuant to § 6 Z 4 on the statistical units selected by the Federal Institute in accordance with § 7 by the natural persons, legal persons or partnerships, which the statistical units in question in the operate on a voluntary basis.

§ 9. The Bundesanstalt has to provide the information-giving information for a free electronic delivery of the survey forms according to § 6 Z 4.

Obligations of the holders of administrative data

§ 10. (1) The Federal Minister of Finance has the data according to § 5 Z 1 lit. a to f within 60 calendar days after the end of the previous quarter, to the Federal Institute for free via an electronic interface in an electronically processable format.

(2) The Federal Minister for Justice has the free access of the Bundesanstalt to the data according to § 5 Z 1 and 2 lit. a to f shall be granted.

(3) For the reporting periods from the calendar year 2010 to the entry into force of the Regulation, the Federal Office of the Federal Minister of Finance shall be free of charge, within 20 calendar days after the entry into force of the Regulation, of the data referred to in paragraph 1 of this Article. electronically.

Use of price index metrics

§ 11. In addition to the data to be collected in accordance with § 5, the Bundesanstalt has to use the following measurement figures to calculate the price index for self-used residential property:

1.

According to the regulation of the Federal Minister for Economic Affairs and Labour, the Federal Minister of Transport, Innovation and Technology, the Federal Minister of Justice and the Federal Chancellor on the compilation of indices of price developments in the Economy-produced measurement figures of the construction price index for building construction on residential and residential construction, excluding the position of passenger elevator systems and

Publication

§ 12. (1) The Bundesanstalt has the price index for self-used residential property and the real estate price index no later than 90 calendar days after the end of the quarter to which the index refers, free of charge to two commades in the The Internet should be made available in the following form:

§ 13. (1) The Federal Minister for Science, Research and the Economy and the Federal Minister of Finance provide the Federal Institute for the Creation of the Price Index for self-used residential property and the property price index and for the -related surveys a cost-effective

1. for the year 2014 in the amount of EUR 99 000 each and

2. for the year 2015 in the amount of 84 250 euros each.

The amounts for the year 2015 are to be valorised at 3% annually for the following years and, if necessary, to be rounded up to full euro.

(2) In 2018, the costs for the Federal Agency for the compilation of the price index for self-used residential property and the real estate price index and for the related surveys according to this Regulation shall be subject to an evaluation and by the Federal Minister for Science, Research and the Economy and the Federal Minister of Finance in agreement with the Federal Chancellor for the survey years from 2019 onwards. For the evaluation, the Federal Institute has to disclose the documents of the internal cost accounting in accordance with § 32 (2) of the Federal Statistics Act 2000.

Use of gender-specific form

§ 14. To the extent that personal terms are used in this Regulation, they do not have a gender-specific meaning. They are to be used in the application to specific persons in the gender-specific form.

§ 16. The Regulation shall expire on 31 December 2018.
