253. Regulation of the Federal Minister for industry, science and research and the Federal Ministry of finances the creation of houses - and house price indices

On the basis of sections 4 to 10, 19 and 30 of the Federal Statistics Act 2000, Federal Law Gazette I no. 163/1999, as last amended by the budget bill 2014, Federal Law Gazette I no. 40/2014, is in agreement with the Chancellor prescribed:

Order to create housing and housing price indexes

1. (1) the Federal Agency "Statistics Austria" (Federal Agency) has to fulfil the obligations of in Austria on the basis of the

Regulation (EU) No. 93/2013 laying down implementing rules for Regulation (EC) No 2494/95 with regard to the creation of price indexes for even used residential property, 2 of the Regulation (EU) No. of 1174/2011 about enforcement actions to correct excessive macroeconomic imbalances in the euro area, 3 the Regulation (EU) No. of 1176/2011 about the prevention and correction of macroeconomic imbalances and 4 of Regulation (EU) No. 549/2013 on the European system of integrated economic accounts at national and regional level in the European Union () ESA 2010) to collect data for the purposes referred to in paragraph 2 in accordance with this regulation.

(2) on the basis of the data collected in accordance with paragraph 1, the Federal Agency has to create:



1. the price index for even used residential property, 2. the real estate price index and 3. calculations of non-financial balance sheets of land according to ESA 2010.

Definitions

§ 2. Within the meaning of this regulation means:



1 even used residential property price index: index, with the development of transaction prices of new the "private sector" according to ESA 2010 available standing room and the prices of other goods and services that are bought and are related to the ownership of housing and the transmission of the same, by private households for own use is measured; among other goods and services are materials and services for repairs and renovations as well as insurance companies and brokers, to understand notarial and registration fees incurred for the establishment and maintenance of private residential property;

2. real estate price index: index, with the development of the actual transaction prices of housing 2010 purchased by the sector "households" according to ESA is measured;

3. homes: Building, designed according to their type and size to serve exclusively the satisfaction of individual housing needs of people;

4. apartments: Structurally completed, according to the transport independent parts of a building, according to their type and size are suitable, to serve the individual living needs of people.

Periodicity, continuity

§ 3. The surveys are making quarterly on the each preceding quarter (period).

Population, statistical units

4. statistical units within the meaning of this regulation are:



1. land supply market transactions take place for that in the reporting periods;

2. houses and apartments, for a consideration, transferred in the reporting periods to households

3. companies referred to in article 1 and 2 of Regulation (EEC) no 696/93 on the statistical units for the observation and analysis of the economy in the community, an activity according to subclass F 41.20-1 of the annex to Regulation (EC) No. 1893/2006 establishing the statistical classification of economic activities NACE revision 2 and amending Council Regulation (EEC) No 3037/90 of the Council, as well as some regulations of the EC on specific areas of statistics regularly, as well as with the intention to achieve exercise of profits or other economic advantage and within the framework of these activities to households goods sell or provide services.

Survey characteristics

§ 5. There are to collect:



1. statistical units in accordance with § 4 Z 1 and 2 the characteristics of a) purchase price;

b) Insert number of the land register part - and lot number;

(c) nature of the land (cultivated land, vacant lot);

(d) payment type of transaction;

(e) tax rate;

(f) date of purchase;

g) land area in m2;

h) location parameter (town, postal code, street, house number);

i) dedication of land (land, grassland/free range, other specifications) 2. the statistical units in accordance with § 4 Z 2 in addition, the characteristics of a) location parameter (staircase, door number) of the apartment;

b) usage type and sector allocation according to ESA 2010 (private sectors financial, non-financial corporations, financial corporations, State);

c) building area of the House in m2;

(d) space of the House or apartment in m2;

(e) residential property;

(f) information, whether cellar, storage, parking, terrace, balcony, Garden in an apartment is available and on what floor is an apartment;

g) construction period, number of units, number of floors, building owner type, energy indicators;

3. about the statistical units in accordance with § 4 Z 3 of the retail price of prefabricated houses.

Type of survey

§ 6. The data collection characteristics are to collect in the following ways:



1. the characteristics referred to in article 5 subpara 1 lit. a to f by procurement of administrative data of tax authorities of the Federation, 1987 provided this on the basis of an electronic declaration according to § 10 or e-filing according to section 13, paragraph 1 of the real estate transfer tax act of party representatives;

2. the characteristics referred to in article 5 subpara 1 lit. g to i, § 5 No. 2 lit. a to f, as well as those characteristics that exempt from administrative data according to no. 1 can be, by extending the data from the land registry including the document collection (General basic book Act 1955 - GBG. 1955);

3. the characteristics referred to in § 5 No. 2 lit. g, as well as those characteristics that exempt from administrative data in accordance with Nos. 1 and 2 can be, by extending the data of the central building and apartment register of the Bundesanstalt (GWR law);

4. the characteristic according to § 5 No. 3 through interviews with the company pursuant to § 4 No. 3 on the basis of a representative sample.

Selection of survey units for the collection in accordance with § 6 No. 4; Sample

7. (1) has the Federal Agency to select those collection units for the collection in accordance with § 6 No. 4 considered representative (principle of representative selection).

(3) the Federal Agency has the survey units based on the data of the register of statistical units in accordance with section 25a of the Federal Statistics Act 2000 to choose from.

Disclosure

8. (1) the Federal Agency has the characteristic according to § 5 No. 3 within 60 calendar days after the end of the previous quarter electronically and in justified cases in writing to catch up.

(2) who is no. 4 over the statistical units by the natural persons, legal entities or partnerships, which operate the statistical units concerned, in their own name, chosen by the Federal Agency pursuant to § 7 voluntary disclosure in accordance with § 6.

Survey documents

§ 9. The Federal Agency has to a free electronic delivery of survey forms in accordance with § 6 No. 4 on the respondents.

              Obligations of holders of administrative data

§ 10 (1) of the Federal Minister of Finance has the data pursuant to article 5 subpara 1 lit. to transmit a f within 60 calendar days after the end of the previous quarter on the Federal free via an electronic interface in an electronically-processable format.

(2) the Federal Minister of Justice has the free access of the Federal Agency for the data according to § 5 Nos. 1 and 2 lit. to grant a to f.

(3) for the period from the calendar year 2010 pending entry into force of the regulation the data referred to in paragraph 1 are the Federal Agency by the Federal Minister of Finance within 20 calendar days after entry into force of the regulation to submit electronically and free of charge.

Use of price index measures

§ 11. The Federal Agency has to calculate the price index for even used residential property in addition to the data to be collected in accordance with paragraph 5 to be used following metrics:



1 in accordance with the regulation of the Federal Minister for Economic Affairs and labour, the Federal Minister for transport, innovation and technology, the Federal Minister for Justice and the Chancellor about the creation of indices of price trends in the economy created metrics of the construction price index for building construction over the settlement construction and House - except the position of elevator equipment and 2. in accordance with the regulation of the Federal Minister for Economic Affairs and labour over the creation of consumer price indexes created metrics of the four digit level 04.2.1 , 04.3.1, 04.3.2 and 12.5.2 of the COICOP classification set out in annex I of to Regulation (EC) No 1749/1999 amending Regulation (EC) No. 2214/96 concerning the sub-indices of the harmonised index of consumer prices.

Publication


12. (1) the Federal Agency has the price index for even used residential property and the real estate price index at the latest 90 calendar days after the end of the quarter to which the index refers for free on two decimal places exactly the public on the Internet in the following form to make: 1. annual average index based 2010;

2. quarterly indexes on index base 2010.

              (2) in the indexes published by the Federal Agency, label revisions.

Expenses and reimbursement of costs

Section 13 (1) the Federal Minister for science, research and industry and the Federal Minister of finance provide a reimbursement of the costs of the Federal Agency for the creation of the price index for even used residential property and the real estate price index and the related surveys

1. for the year 2014 at a height of 99 000 EUR and

2. for the year 2015 at a height of 84 250 euros each.



The amounts for the year 2015 are to develop per year with 3% for the following years and, if necessary, be rounded to full euro.

(2) in the year 2018 are to take the cost of the Federal Agency for the creation of the price index for even used residential property and the real estate price index and the related surveys under this regulation of an evaluation and by the Federal Minister of science, research and technology and the Federal Minister of finance in agreement with the Federal Chancellor for the survey years from 2019 to redefine. For the evaluation, the Federal Agency has to disclose the documents of the internal cost accounting pursuant to § 32 para 2 of the Federal Statistics Act 2000.
