45. Regulation of the Federal Minister for health and women relating to certain dehydrated milk and milk powder

On the basis of § 10 paragraph 1.19 (1) and 42 para. 4 of the Food Act 1975, BGBl. No. 86, I no. 69/2003, is amended by the Federal Act Federal Law Gazette - in terms of §§ 3 and prescribed 4 in consultation with the Federal Ministry of Economics and labour -:

Scope



§ 1. This Regulation shall apply to the following products:



1. dehydrated preserved milk liquid condensed and products, which are manufactured with the addition of milk may not exceed 25% of total milk solids in finished products directly by the partial removal of water from milk, from wholly or partly skimmed milk or a mixture of these products, including the addition of cream, milk, or these two products.

These include: a) types ungezuckerter condensed milk - condensed milk with a high fat content partly dehydrated milk containing fat by at least 15% and on total milk dry matter of at least 26.5%.

-Condensed milk or condensed milk partly dehydrated milk containing fat of at least 7.5% and by at least 25% of total milk solids.

-Partly skimmed milk partly dehydrated milk containing fat by at least 1% and less than 7.5% and by at least 20% of total milk solids.

-Kondensmagermilch or condensed skim milk partly dehydrated milk containing fatty by no more than 1% and by at least 20% of total milk solids.

(b) types of sweetened condensed milk - sweetened condensed milk or sweetened condensed milk partly dehydrated milk with addition of sucrose (semi-white sugar, white sugar or refined white sugar) and a content of fat by at least 8% and on total milk dry matter of at least 28%.

-Condensed semi-skimmed milk or sweetened low-fat condensed milk partly dehydrated milk with the addition of sucrose (semi-white sugar, white sugar or refined white sugar) and a content of fat by at least 1% to less than 8% and on total milk dry matter of at least 24%.

-Kondensmagermilch sugared or sweetened condensed skimmed milk partly dehydrated milk with addition of sucrose (semi-white sugar, white sugar or refined white sugar) and a content of fat not more than 1% and in total milk dry matter of not less than 24%.

2. milk directly by removal of water from milk, skimmed or partly skimmed milk, from cream or from a mixture of these products-manufactured products in the form of powder with a moisture content of not more than 5% in the final product.

These include: a) powdered milk with a high fat content milk powder with a content of fat by at least 42%.

b) powdered milk or whole milk powder dehydrated milk containing less than 26% and less than 42% fat.

(c) Teilentrahmtes milk powder dehydrated milk with a content of more than 1,5% and less than 26% fat.

(d) skimmed-milk powder dehydrated milk containing not more than 1,5% fat.

Treatment in the production of



Section 2 (1) the manufacture of products referred to in article 1 subpara 1 lit. Lactose in an amount of up to 0.03% of the finished product may be added to b.

(2) without prejudice to the provisions of milk hygiene regulation, Federal Law Gazette No. 897/1993, in its up-to-date version, has to be carried out by the conservation:



1. heat-treatment (sterilisation, UHT, etc.) for products referred to in paragraph 1 subpara 1 lit. a-2 addition of sucrose, for the products referred to in paragraph 1 subpara 1 lit. b 3. drying of products referred to in paragraph 1 Z 2 labelling requirements



Section 3 (1) without prejudice to the provisions of the 1993 - LMKV, BGBl. No. 72, the food labeling regulations amended, as well as section 4 reserved and as Sachbezeichnungen to use the designations provided for in § 1 the listed products.

(4) in the case of products referred to in article 1, no. 2 is to specify that the product "intended as a food for infants under 12 months" is.

§ 4. without prejudice to the provision of § 3 para 1 following special designations may be used for certain products referred to in paragraph 1:



1. the term "condensed cream of coffee" for "Condensed milk with a high fat content".

2. the names "Cream powder" and "Cream powder" for "High-fat milk powder".

Sampling and analysis methods



§ 5 (1) has the sampling of products referred to in paragraph 1 in accordance with the provisions of the annex of to Directive 87/524/EEC of 6 October 1987 laying down Community methods of sampling time dairy products, OJ No. L 306 of 28th 1987, to be carried out.

(2) for the examination of the composition of the products referred to in article 1, which according to the criteria of annex I of to Directive 79/1067/EEC of 13 November 1979 laying down Community methods of analysis for testing certain types of dehydrated milk and powdered milk for human consumption, OJ No. L 327 of 24 December 1979, to be carried out, to apply those methods of analysis are described in annex II to this directive.

Final provisions



§ 6 (1) this Regulation comes into force occurs the regulation on concentrated milk and milk powder types, Federal Law Gazette II No. 129/1997, override.

§ 7. This regulation is the Directive 2001/114/EC of 20 December 2001 relating to certain dehydrated milk for human consumption, OJ No. L 15 of 17 January 2002, transposed into Austrian law.
