358. Regulation of the Federal Minister for Health, which amends the diagnostic and performance documentation regulations as well as the statistical regulations for national fund-funded and non-country health care institutions
Article 1
On the basis of § 4(2). 1 and 2 of the Federal Law on documentation in health care, BGBl. No 745/1996, last amended by the Federal Law BGBl. I No. 81/2013, is prescribed:
The diagnostic and performance documentation regulation, BGBl. II No 589/2003, last amended by Regulation BGBl. II No. 103/2012, as follows:
1. In § 1(2). 1, § 2(2). 1 and 3, § 3 3 and § 6. 1 will be the word "Pfleglinge" by the words "Patientents/patients" replaced.
2. § 4 is:
"§ 4. (1) All data transfers
1. | hospitals financed by the National Health Fund to the Landeshauptmann, | |||||||||
2. | public health fund-funded hospitals | |||||||||
3. | from the Landeshauptmann to the Federal Ministry of Health and | |||||||||
4. | from the National Health Fund to the Federal Ministry of Health | |||||||||
as well as the nature and structure of these data transfers, the statistical regulation for national fund-funded hospitals has to comply. | ||||||||||
(2) All transfers of data from non-national health fund-funded hospitals to the Federal Ministry of Health and the nature and structure of these data transfers have to comply with the statistical regulation for non-national fund-funded hospitals. “
3. According to § 7, the following sections 7a to 7c and headings are inserted:
"The generation of pseudonyms and technical and organisational frameworks for pseudonymisations
§ 7a. (1) The pseudonym of the patient is to be formed by HMAC-Algorithmus from the field-specific identifier (bPK) for health documentation (GH-GD) within a hardware security module (HSM) and then to be broken down within the HSM.
(2) The first configuration of the HSM has been set up in the premises of the pseudonymisation body set up at the main association of Austrian social security providers (data protection service providers) with the presence of a representative/a representative of the Data Protection Authority (the Federal Ministry of Health) and under the supervision of a confirmatory body pursuant to § 19 of the Signature Law, BGBl. I No. 190/1999, last amended by BGBl. I No 75/2010. The whole process is to be protocold.
(3) After the first configuration referred to in paragraph 2, the guarantee copy of the cryptographic keys used shall be transferred to a confirmatory body pursuant to Article 19 of the signature law and must be kept safe and secret. The protective copy may be used exclusively for the following purposes and only with the consent of the Federal Ministry of Health:
1. | to restore the configuration of a HSM in the event of disturbance, and | |||||||||
2. | configurations of additional necessary HSM (enlargement case). | |||||||||
These configurations have to be carried out in the premises of the pseudonymisation body set up at the main association of Austrian social security providers, in the presence of a representative/representative of the Federal Ministry of Health and under the supervision of a confirmatory body pursuant to Article 19 of the Signature Law. The whole process is to be protocold. | ||||||||||
(4) The Federal Ministry of Health has the protocols referred to in paragraph. 2 and 3 of the Data Protection Authority.
Audits
§ 7b. (1) Compliance with data protection in the context of pseudonymisation and related processes must be verified and confirmed by an independent/independent external/external expert/experts at regular audits.
(2) A first audit is carried out regularly during the first configuration of the HSM and other audits, but at least every two years.
(3) The pseudonymisation body set up at the main association of Austrian social security providers has supported the implementation of audits by their own staff and to ensure that the evaluator receives access to all necessary information to carry out the audits.
(4) The selection and order by the Federal Ministry of Health of the external evaluator.
(5) The external evaluator must not be aware of the cryptographic key used.
One-stop-use (Hash) of the data-ID
§ 7c. As an algorithm for a single-use switch (Hash discharge) of the non-returnable data-ID from the number of entries according to § 3. 1 of the Federal Law on documentation in health care is to apply the cryptoological Hash function SHA-256. “
4. The § 9 is the following paragraph. 5:
"(5) Articles 1, 2, 3, 4, 6 and 7a to 7c as amended by Regulation BGBl. II No 358/2014 will enter into force on 1 January 2015 and will be applied for the first time for the 2015 reporting period. “
Article 2
On the basis of § 7(1). 4 of the Federal Law on Documentation in Health, BGBl. No 745/1996, last amended by the Federal Law BGBl. I No. 81/2013, is prescribed:
The statistical regulation for national fund-funded health institutions, BGBl. II No 639/2003, last amended by Regulation BGBl. II No. 103/2012, as follows:
1. § 3(2). 1 is:
"(1) All data transfers have to be encrypted. In addition,
1. | the transfer of data from the National Health Fund to the Federal Ministry of Health and the transfer of data from the Landeshauptmann to the Federal Ministry of Health via an internet application operated by the Federal Ministry of Health and | |||||||||
2. | the transfer of data between the pseudonymisation body set up by the main association of Austrian social security providers and the Federal Ministry of Health via the SV data hub | |||||||||
to be done. Data transfers have to comply with the requirements of Annex 1. The Internet application under Z 1 is equipped with a encryption (transport layer security) and it is necessary to ensure that user access is technically possible only through appropriate safeguards (e.g. organisational-specific client-certification). The Internet application is not an information system within the meaning of Section 14 DSG 2000. After the full completion of the data processing for the period concerned, the Federal Ministry of Health has to empty all the lists used for the exchange of data by Internet application, so that the data previously contained can no longer be read. “ | ||||||||||
2. § 3(2). The first sentence is:

"§ 3a. In the absence of data transfer from national health fund-funded health care institutions and from the National Health Fund to the Federal Ministry of Health Data, it is necessary to correct or delete data as follows:

Data security measures
§ 3b. (1) All the institutions involved in the reporting system have to document all the security measures taken in accordance with § 14 DSG 2000 and the provisions of the Federal Law on documentation in the health care sector. This documentation must show that both access and transfer of data are done properly and data is not accessible.
(2) Confidentiality in the electronic transmission of health data is ensured by the electronic transfer of health data through networks that are protected against unauthorised access, in accordance with the state of technology, by at least
1. | security of traffic through cryptographic and, where appropriate, structural measures; | |||||||||
2. | access to the network exclusively for a closed user/user group; and | |||||||||
3. | authentication of users | |||||||||

(3) Any institution involved in the reporting process has proven to ensure that any/perceived person has issued a statement of assurance before access to the data or before the use of the DIAG. “
