29. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management with which the Packaging Demarcation V is amended (Packaging Ordination V-Novelle 2016)

Due to § 13h (2) of the Waste Management Act 2002 (AWG 2002), BGBl. I n ° 102/2002, as last amended by Federal Law Gazette (BGBl). I No 193/2013, shall be arranged:

The packaging demarcation V, BGBl. II No 10/2015 shall be amended as follows:

(1) The following paragraph 3 is added to § 4:

" (3) By way of derogation from paragraph 1, a participant in a collection and recycling system for packaging may be entitled to the appendix in the version of the packaging demarcation V-Novelle 2016, BGBl. II No 29/2016, apply in the following cases:

1.		In the context of the annual report for the year 2015 to the collection and recovery system and
2.		for the participation and notification to a collection and recovery system for the period of 1. Jänner 2016 until the entry into force of the packaging demarcation V-Novelle 2016, BGBl. II No 29/2016; this also applies in accordance with the provisions of Section 3 of the Packaging Ordinance in 2014, BGBl. II no. 184/2014. "

2. § 5 reads:

" § 5. This Regulation lays down Directive 94 /62/EC on packaging and packaging waste, OJ L 94, 9.4.1994, p. No. OJ L 365, 31.12.1994, p. 10, as last amended by Directive (EU) 2015/720, OJ L 327, 31.12.1994, p. No. L 115 of 06.05.2015 S 11, implemented. "

(3) The text of § 6 shall be called "(1)" , the following paragraph 2 is added:

" (2) The 2016 Packaging Demarcation V-novelle has been established in compliance with the provisions of Directive (EU) 2015/1535 on a procedure for the provision of information in the field of technical regulations and the rules governing the services of the Information society (codified text) , 1. No. OJ No L 241, 17.09. 2015 p. 1, notified (Notifying number: 2015 /519/A). "

4. In § 7, the annual number shall be "2019" by the year "2020" replaced.

5. The text of § 7 shall become the name "(1)" , the following paragraph 2 is added:

" (2) § 4 (3), § § 5 and 6 and the appendix in the version BGBl. II No. 29/2016 shall enter into force with the day following the event. "
