Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management on special market support measures for producers of certain livestock sectors

On the basis of § § 17 and 23 of the Law on the Market Order 2007 (MOG 2007), BGBl. I n ° 55, as last amended by the Federal Law BGBl. I No 89/2015, shall be arranged:

Scope

§ 1. (1) This Regulation shall serve the purpose of:

(2) This Regulation regulates the use of the funds available in the Annex to Regulation (EU) No 2015/1853 for Austria as temporary special aid to producers in the pigmeat and milk sectors. Where:

for the pigmeat sector, an amount of EUR 3 000 000; and

in the milk sector, an amount of EUR 4 004 590

is available.

Responsibility

§ 2. The market organisation "Agrarmarkt Austria" (AMA) is responsible for the enforcement of this Regulation and of the acts referred to in § 1.

Reporting requirements

§ 3. (1) The Animal Health Services (TGD) in accordance with § 1 Animal Health Service-Regulation 2009-TGD-VO 2009, BGBl. II No 434/2009, as amended, the AMA has to report the following data of its members with production in the pigmeat sector by no later than 26 February 2016:

name and address;

2.

operating number;

3.

the figures for the year 2015, calculated by calculation for pig farming, per holding.

(2) Data provided by the AMA in the context of the enforcement of pursuant to § 3 paragraph 2 Z 2 AMA-Act 1992, BGBl. Application

§ 4. (1) producers of the sectors referred to in Article 1 (2), for whose operation (operating number) in 2015 a collective application (multiple trag areas) in accordance with Article 11 of Regulation (EU) No 640/2014 in conjunction with sections 21 and 22 of the Horizontal CAP Regulation, BGBl. II No 100/2015, as amended, are eligible for the grant of the temporary special allowance in accordance with § § 6 and 7. § 5 of the horizontal CAP regulation is to be applied in a reasonable way.

(2) Producers of the sectors referred to in Article 1 (2), for whose operation (operating number) was not submitted in 2015 a collective application (multiple trag areas), the aid pursuant to Article 1 (2) of the AMA shall have no later than 31 March 2016, indicating the following: Request data by means of the form set out by the AMA:

(3) Producers of the sectors referred to in Article 1 (2), for whose operation (operating number) a collective application (multiple trait area) was submitted in 2015 and which, despite the conditions laid down in § § 6 and 7, does not pay a temporary payment Special aid should be granted in writing to the AMA by 31 March 2016 at the latest.

Disclosure and co-action obligations

§ 5. Use of temporary special aid in the pigmeat sector

§ 6. The temporary special aid in the pigmeat sector is to be used in the form of aid to producers whose holding (operating number) is a member of a TGD on the date of 31 January 2016 and whose production is located in the pigmeat sector. The aid shall be calculated by dividing the amount available in accordance with Article 1 (2) (1) (1) by the sum of the amounts notified in accordance with Article 3 (1) (3) (3) (3) and by the factor calculated in this way with the reported amounts of the Member concerned. multiplied.

Use of temporary special aid in the dairy sector

§ 7. (1) The use of the temporary special aid in the milk sector shall take the form of a base amount in accordance with paragraph 2 and an animal-related amount as referred to in paragraph 3.

(2) The base amount shall be granted to milk producers, from their holding (operating number) in the period 01.04.2015 to 31.10.2015 cow's milk to companies according to § 3 (1) Z 1 of the milk registration regulation 2010, BGBl. II No 249/2010, as amended. The base amount is EUR 54 per milk producer.

(3) Producers whose operations (operating number) have been kept on average at least six cows during the period 1 April 2015 to 31 October 2015 shall receive an animal-related amount per cow. The amount is calculated by the fact that, after deduction of the amount available for the financing of the base amount in accordance with section 2 (2) (2) (2), the amount of cows kept on average over the period referred to above is commercial, commercial rounded up, divided. The average of the cows will be based on seven key days for each month's list and the data according to the cattle database in accordance with § 5 of the cattle identification regulation 2008, BGBl. II No 201/2008 in the current version, as amended.

Override

§ 8. This Regulation shall enter into force as of 31.12.2016. However, it shall continue to apply the provisions relating to the grant of the temporary special aid.
