NATIONAL SYSTEM FOR COMPREHENSIVE PROTECTION NATIONAL SYSTEM ANDTHE RISK MANAGEMENT TO THE MANAGEMENT OF RISK and CIVIL PROTECTION law 27287 creation.

ARTICLE 2 ° - for the purposes of this Act means: to) alarm: alerts or signals that are informed about the existence of a danger and serves to follow specific instructions of emergency due to the actual or impending presence of an adverse event; (b) warning: been declared prior to the manifestation of a threat under monitoring, which allows to take specific decisions to activate action procedures previously established; (c) threatens: Factor external represented by the possibility that occurs a phenomenon or an event adverse, in a moment, place specific, with a magnitude determined and that could cause damage to the people, to the property; the loss of livelihoods; disorders of social, economic and environmental; (d) disaster: interaction between a threat and a vulnerable population that, by its magnitude, creates an interruption in the operation of a society or system from a disproportion between the means to overcome it and the means available to the affected community; (e) emergency: is a situation, a damage caused by an adverse event of natural or caused by human beings who, by its magnitude, can be met by the resources available locally; (f) adverse event: is a situation, event or fact that produces changes in the lives of the people, https://www.boletinoficial.gob.ar/pdf/linkQR/ZkJUcWkzOWZ4aFJycmZ0RFhoUThyQT09 economy, social systems and the environment, caused by phenomena of origins natural or caused by humans; (g) emergency management: Organization and administration of resources and responsibilities to address aspects related to situations of emergency or disaster; (h) integrated risk management: a continuous, multidimensional and inter-ministerial and systemic process of formulation, adoption and implementation of policies, strategies, planning, organization, direction, execution and control, practices and actions aimed at reducing the risk of disasters and their effects, as well as the consequences of activities associated with the management of emergencies or disasters. Includes actions of mitigation, management of the emergency and recovery; (i) management of crisis: actions and measures that allow face situations of emergency or disaster. Constituted by two components: warning and response; (j) map of risk: representation graphics, with information qualitative and quantitative, of the risks existing in a territory (country, province, region, area, municipality, district, community) given; (k) mitigation: set of actions to reduce, mitigate or limit the effects generated by the occurrence of an event; (l) hazard: potential harm that has a threat; (m) preparation: set of actions oriented to plan, organize and improve the capacity of response facing the likely effects of them events adverse; (n) prevention: actions aimed to eliminate the risk, already is avoiding the occurrence of the event or preventing the damage; (o) reconstruction: set of activities intended to repair the infrastructure, restore production systems and recover the everyday life of the affected community; (p) recovery: set of actions after an adverse event that seeks the re-establishment of adequate and sustainable living conditions through reconstruction and rehabilitation of the affected area, goods and services damaged or interrupted and reactivation or impulse of the economic and social development of the community; (q) reducing the risk of disaster: approach that includes the concept and practice of preventing and mitigating the risk of disasters by systematic efforts to the analysis and management of the factors of emergencies or disasters, including the reduction of the degree of exposure to the threats, the reduction of the vulnerability of the population and property sensible management of soils and the environment, and the improvement of the preparation to adverse events; (r) resilience: capability of a community, society or ecosystem to absorb negative impacts, or recover, once occurred an emergency or disaster. Allows the strengthening through the acquisition of experiences, to reduce her own vulnerability; (s) response: set of actions led to out before the occurrence of an emergency and/or disaster, with the purpose of save lives, reduce impacts in the health, meet them needs basic of subsistence of the population affected, safeguard goods materials and preserve the environment; (t) rehabilitation: set of measures and actions to restore essential basic services of the community affected by an adverse event; (u) risk: probability that a threat to produce damage to the Act about a population vulnerable; (v) early warning system: mechanism or tool of provision and dissemination of timely and effective information prior to the manifestation of a threat, in charge of institutions responsible for identified, allowing the taking of decisions; (w) vulnerability: internal Factor of a community or system. ARTICLE 4 ° - the national system for the Integral risk management and Civil protection will be made by the National Council for the comprehensive risk management and Civil protection, the Federal Council of Integral risk management and Civil protection.
Chapter II National Council for the integrated risk management and the Civil Protection ARTICLE 5 ° - the National Council for the comprehensive risk management and Civil protection is the higher court's decision, articulation and coordination of the resources of the national State. Has as purpose design, propose and implement the political public for the management integral of the risk.
(ARTICLE 6 ° - are features of the National Council for the comprehensive risk management and Civil protection: to) determine policies and strategies for the implementation of the process of integrated risk management within the national system for the Integral risk management and Civil protection; b) establish mechanisms of articulation and coordination of national agencies in the field of risk management; (c) to promote and regulate the participation of non-governmental organizations, civil society and the private sector; (d) design, determine and implement a national policy on education and training in integrated management of risk, taking into account issues of gender equity and respect for indigenous cultures; (e) promote the development of resilient communities to contribute to the strengthening of their capacities; f) promoting the conclusion of agreements for technical cooperation with national and international, public and private agencies in the field of risk management; (g) participate in the proposals for implementing mechanisms and international cooperation; (h) involved in the elaboration of national reports and documents to be filed with agencies and international conferences; (i) develop national center of information on integrated risk management; j) promoting scientific and technical research aimed at the formulation of public policies on risk management; (k) designing an information system as a network connection to improve the mechanisms of communication between the nation, the provinces, the autonomous city of Buenos Aires and the municipalities; (l) contribute to the strengthening of mechanisms suitable for the employment of human resources, material and financial for the care and rehabilitation in situations of emergency or disaster; (m) approve the reduction of risk, crisis management and recovery plans; (n) declared emergency by disaster.
ARTICLE 7 ° - the Presidency of the National Council for the comprehensive risk management and Civil protection shall be exercised by the national executive power and will be integrated by the agencies and departments mentioned in the annex to this law, without prejudice to those who in the future will be included.
ARTICLE 8 ° - the National Council for the comprehensive risk management and Civil Protection has to work with an Executive Secretariat of the Presidency of the Council, which shall have the following functions: to) advise the Council on the development of plans and programmes on integrated risk management; (b) develop reports periodicals for knowledge of the members of the Council; (c) assist technically to the members of the Council in: 1. the development of them actions in matter of management integral of the risk. 2. the design of the policies of education and training in integrated risk management. 3. the actions of strengthening communities resilient. 4. the holding of conventions and agreements of cooperation with public and private, national and international organizations. 5. the proposals for mechanisms and international cooperation. 6. the preparation of documents and reports to be presented to agencies international. 7. the promotion of scientific and technical research in the field of risk management. 8. the elaboration of plans and programs for reducing the risk, crisis management and recovery in the field of the national system for the Integral risk management and Civil protection. (d) coordinating the actions of the Centre national of information in management Integral of the risk; (e) to coordinate the system of information and communication between the members of the system; (f) direct actions and coordinate the use of human resources, material and financial of the national State in the field of Integral risk management; (g) assist, coordinate and monitor the implementation of plans and programs of Integral risk management; (h) instruct the National Fund for the Integral management of risk in the use of resources in accordance with the mandates of the President of the National Council for the comprehensive risk management and Civil protection; (i) convene ordinary and extraordinary meetings of the National Council for the comprehensive risk management and Civil protection when directed by the national executive power; j) propose additional standards for the better functioning of the system; (k) to coordinate the implementation of the policy of information and communication between the various components of the system; (l) propose the reorganization budget for the obtaining of them resources necessary for the operation of the system national for the management Integral of the risk and the protection Civil; (m) sign agreements of assistance and technical cooperation; (n) sign conventions for the Constitution of the network of bodies scientific and technical for the management Integral of the risk established in the article 15.
ARTICLE 9 - the Presidency of the National Council for the comprehensive risk management and Civil protection, through the Executive Secretariat, should convene two (2) regular meetings per year, at a minimum, without prejudice to extraordinary meetings that must be held before the occurrence of an event of magnitude in order to coordinate response, rehabilitation and reconstruction activities.
Chapter III https://www.boletinoficial.gob.ar/pdf/linkQR/ZkJUcWkzOWZ4aFJycmZ0RFhoUThyQT09 of the Federal Council for the Integral risk management and Civil Protection ARTICLE 10. -The Federal Council for the Integral risk management and Civil protection consists of one (1) representative of the national executive branch, one (1) for each province and one (1) by the city of Buenos Aires, all of rank not lower than Assistant or equivalent, which shall be appointed by the national executive power, Governors and by the head of Government of the city of Buenos Aires respectively. They will integrate the Federal Council, in addition, leaders of organizations of Civil protection or Defense National Civil, of the Government of the city of Buenos Aires and the provinces.
ARTICLE 11. (-Are features of the Federal Council for the Integral risk management and Civil protection: to) understand the preparation, counseling and articulation of regional and provincial public policies for integrated risk management; b) promote regional integration for the implementation of public policies for integrated risk management; (c) to develop and keep updated a federal map of integrated risk management.
ARTICLE 12. -The Federal Council for the Integral risk management and Civil protection shall adopt its internal and operating rules.
ARTICLE 13. (-It Secretariat Executive created by the article 8 °, without prejudice of them functions established with relationship to the Council national for it management Integral of the risk and the protection Civil, must: to) attend administratively to the Council Federal for it management Integral of the risk and it protection Civil in the coordination of them meetings, leading it continuity of them themes, background and priorities and preparing the information for them presentations; (b) channel the flow of information scientific and technical; (c) propose modalities of work, meetings, agendas and calls for the development of the Council and for cases outstanding from situations of emergency or disaster; (d) make them calls for the meetings annual and elaborate the respective records; (e) propose mechanisms that articulate the cooperation and assistance between the Council national for the management Integral of the risk and the protection Civil and the Council Federal for the management Integral of the risk and the protection Civil; (f) promote the creation of areas u agencies directed to the management integral of the risk in the provinces, in the city autonomous of Buenos Aires and them municipalities; (g) recommend the implementation of a framework regulatory in management Integral of the risk in the different jurisdictions.
Chapter IV other instances of coordination ARTICLE 14. -Create the registry of civil associations, voluntary and non-governmental organizations for the integrated risk management within the scope of the Executive Secretariat, which shall generate a field of exchange of experiences, mechanisms of articulation and https://www.boletinoficial.gob.ar/pdf/linkQR/ZkJUcWkzOWZ4aFJycmZ0RFhoUThyQT09 coordination and presentation of programmes, plans and projects.
ARTICLE 15. -Create is the network of agencies scientific and technical for it management Integral of the risk (GIRCYT), that will have by object meet them requirements of information specific of both tips, as well as link and put to available of these them capabilities, knowledge and information developed in the field scientific and technical, channeling them efforts and optimizing the use of them resources. Will be constituted by them bodies public scientific and technical, the universities public and private, other institutions and agencies recognized in the field academic.
Chapter V financing for the management Integral of the risk and the protection Civil ARTICLE 16. -Create is the Fund national for the management Integral of the risk with the objective of finance them actions of prevention managed by the Secretariat Executive of the Council national for the management Integral of the risk and the protection Civil. Them resources of this Fund will come of the budget General of the nation of the year corresponding, will have character budget and is governed by the law 24.156 and its amending.
ARTICLE 17. -Create the national emergency fund in order to finance and implement response actions managed by the Executive Secretary of the National Council for the comprehensive risk management and Civil protection. The national emergency fund will have character of trust and will be governed by the rules for this Institute, by this law and its regulation. The economic resources of the national emergency fund, earmarked for response actions, will settle by: a) contributions made by the nation, the provinces and the autonomous city of Buenos Aires; (b) donations and bequests; (c) income from financial assets; (d) national loans and international and others requiring the State at the time of emergencies or disasters; (e) taxes or charges that are created with specific involvement to this trust; (f) any other resource that is assigned to it.
ARTICLE 18. -The national executive branch implement the Constitution and shall regulate the functioning of both funds. The resources of the national emergency fund originated in income from financial assets may be applied to actions to prevent only with permission of the National Council for the Integral risk management and Civil protection.
ARTICLE 19. (- Contributions the national emergency fund mentioned in the literal to) article 17 can be made in cash or bonds of the contributor jurisdiction in order to not affect the liquidity of the respective budgets during its Constitution or its eventual recapitalization then occurred an event of great magnitude. disaster, established by the National Council for the comprehensive risk management and Civil protection, to provide liquidity by selling its assets either by applying them as collateral in transactions designed to obtain short-term liquidity.
Provisions General ARTICLE 20. -The system created by this law operates independently to the established law 26.509 (agricultural emergency) and all other existing specific system or that in the future it is believed. Without prejudice to the provisions of the preceding paragraph when the circumstances of the case so the national system for the Integral risk management and Civil protection require it may act as a network of support at the request of the competent authorities.
ARTICLE 21. -Repeal of the Decree of the national executive power 1250/99 date of 28 October 1999.
ARTICLE 22. -Repeal is the resolution of the Ministry of the Interior 968 / 2011 of date 19 of July of 2011.
ARTICLE 23. -The national executive power shall appoint the authority for the application of this law.
ARTICLE 24. -He to Executive national, in the term of cent eighty (180) days starting from the entry in force of the present law, must proceed to its regulation.
ARTICLE 25. -Resources that demands the implementation of the present law shall be assigned by the national executive power through the relevant budgetary adjustments.
ARTICLE 26. -Invite the provinces and the autonomous city of Buenos Aires to adhere to the terms of this law for the regulation of the national system for the Integral risk management and Civil protection, in their respective fields.
ARTICLE 27. -Communicate to the national executive power.
