NATIONAL CAMPAIGN FOR BLOOD PLASMA DONATION OF RECOVERED COVID-19 PATIENTS
Declare of national interest, promotion and registration
Article 1-Object. This law aims to promote the voluntary donation of blood for the collection of plasma from recovered COVID-19 patients for the treatment of patients who require it, according to the protocols in force authorized by the authority. application.
Article 2 °-National Campaign. The creation of a National Campaign for the dissemination and promotion of voluntary donation of blood plasma, from recovered COVID-19 patients, is available throughout the national territory in the framework of the "Strategic Plan to regulate the disease". use of plasma from recovered COVID-19 patients for therapeutic purposes. "
Article 3-Declaring of Interest. The voluntary blood donation for plasma collection of recovered COVID-19 patients was declared in the national public interest.
Article 4 °-Creation of the National Register of Patients Recovered from COVID-19 plasma donors. The National Register of Recovered COVID-19 Patients, plasma donors, is created.
The registration shall be in charge of the enforcement authority of this law, and shall be in accordance with the provisions of Law 22,990-Blood Law.
Information from the National Registry of Patients Recovered from COVID-19 plasma donors must be protected in compliance with the law 25.326-Protection of Personal Data.
Article 5 °-Special License. Patients recovered from COVID-19 donors of blood plasma and who are female workers who are under a dependency relationship, in the public or private sphere, will enjoy a special paid leave of two (2) days for each donation of blood plasma. Article 6-Recognition. Patients recovered from COVID-19, who are donors of blood plasma, are recognized as "prominent citizens of the Republic of Argentina". Article 7 °-Authority of application. It is for the national executive branch to determine the enforcement authority of this law.
Article 8 °-Transfer. The implementing authority must in conjunction with the provincial and municipal jurisdictions arbitrate appropriate and necessary means, during the health emergency established by Decree 260/2020 and the rules that extend, modify or replace, seeking to ensure the transfer of patients recovered from COVID-19, suitable for the donation of blood plasma, that do not have the necessary resources to move in compliance with all safety and hygiene safeguards appropriate.
Article 9-Functions of the implementing authority. They are functions of the implementing authority, adapting to existing protocols:
(a) Ensure that donors meet all eligibility criteria according to existing protocols and have expressed their informed consent for this purpose;
b) Increase the availability of plasma from recovered COVID-19 patients for therapeutic purposes and approved research as required;
c) Require the jurisdictional health authorities to define the Regional Hemotherapy Centers and/or Blood Banks that will be responsible for performing the collection and collection of plasma from recovered COVID-19 patients;
d) Encourage training to health teams on the procedure for the donation of blood plasma from recovered COVID-19 patients.
(e) To promote the development of research activities on the subject;
(f) Promote the participation of non-governmental organizations (NGOs) in the actions provided for in this Law;
g) Formulate and plan guidelines, proposals, strategies and actions aimed at the plasma donation of recovered patients recovered from COVID-19;
h) Ensure access to information on plasma donation from recovered COVID-19 patients.
Article 10.-Dissemination. The national executive branch is empowered to adopt the necessary measures to implement specific activities related to the promotion of voluntary donation of blood plasma from recovered COVID-19 patients and to perform the highest dissemination of the same, through the mechanisms of official communication.
Article 11.-Accession. The provinces and the Autonomous City of Buenos Aires are invited to adhere to this law.
Article 12.-Commune to the national executive branch.
