HEALTH public health law 26.873 public breastfeeding. Promotion and public awareness. This law aims at promoting and raising public awareness about the importance of breastfeeding and best practices of safe nutrition for infants and children up to two (2) years.
Article 2º - reaches. For the purposes of this Act are covered, within the framework of public policies of breastfeeding, the following actions: to) promote exclusive breastfeeding and best practices of feeding in children of up to six (6) months of age; (b) promotion of continued breastfeeding and timely complementary feeding for infants up to two (2) years of life; (c) dissemination and accessibility to information for the purpose of public awareness, especially of pregnant women; (d) promotion and support for the creation of centers of breastfeeding and breast milk banks.
Article 3º - implementing authority. Present law enforcement authority is the Ministry of health the nation, that its application must be coordinated with the authorities of the provinces and the autonomous city of Buenos Aires.
Title II objectives article 4 - determination of the objectives. Within the framework of the promotion and public awareness of breastfeeding objectives of this law are: to) promote the practice of breastfeeding according to provisions of this law; b) promote actions and make recommendations in the subsectors State, private and public social security, with respect to the conditions of breastfeeding and encourage, where appropriate, their incorporation; (c) report on the importance of adequate nutritional status of women in fertile age and especially from pregnancy, and promote its nutritional support up to twenty-four (24) months of their children's lives; d) disseminate the importance of the benefits of breast feeding by means of campaigns and all the media that arbitrator enforcement authority; (e) raise awareness and educate the population in general, health workers, social promoters and parents in particular, about the benefits and advantages of breastfeeding and the correct use of substitutes and complementary foods; (f) promote the training of them teams of health to is recommend the breastfeeding breast as them reaches of the present law; (g) develop research projects that promote safe practices of nutrition for pregnant mothers and lactation, and for children up to two (2) years of age; (h) disseminate research and interdisciplinary studies on infant feeding, breast feeding and the socio-cultural, legal and economic factors involved in it; (i) promote the creation and development of centers of breastfeeding whose function will be to collect, conserve and manage the mother's milk to the own child; (j) to promote the creation and development of banks of breast milk whose function will be to collect, process, store and distribute the same; (k) promote the provision of breast milk to infants when specific circumstances so require; (l) encourage voluntary and free breast milk donation to provide existing breast milk banks and to create (m) promote the provision of adequate breast milk substitutes and complementary foods breastfeeding children up to two (2) years of age, as determined by regulation; n) disseminate the international code for breast milk substitutes, in accordance the Argentinean alimentary code, law 18.284 and its complementary standards; (o) promoting the accession of hospitals and primary care centers of health programmes "Hospital friend of the mother and the child" proposed by the World Health Organization - who - and the UN Fund for children - UNICEF-to the "initiative Center of friend of the mother and of the child health" created by the Ministry of health and who are established from the sanction of the This law; (p) to relieve and updating the indicators, official statistics and epidemiological studies related to this Act; q) signing agreements of management with different jurisdictions in order to set goals, strategies, and procedures to meet objectives within the framework of this law; (r) to coordinate actions with representatives of public and private institutions, non-governmental organizations, laboratories and companies linked to the feeding of infants and of associations of health professionals, in order to promote the right conditions for the fulfilment of the objectives of this Act; (s) promote the necessary regulations for the protection of working mothers in breastfeeding period; t) promote the establishment of breast in workplaces; (u) promoting the necessary legislation on the creation, operation, control and quality standards of breast milk banks. title III funding Article 5 - financing. Expenditures that requires the fulfillment of this law should be taken care with headings which allocate annual General budget of the Government for the Ministry of health, or with the involvement of the budgetary credit of headings that reassign the Executive to enter into force during the current financial year.
Title IV coordination with all jurisdictions article 6 - coordination. The enforcement authority with the national food and Nutrition Commission should promote, within the framework of the Federal Board of health - COFESA –, the application of this law in the field of the provinces and the autonomous city of Buenos Aires, and must coordinate their integration with existing programs.
Title V supplementary provisions article 7 - regulation. The Executive branch must regulate this law within the period of ninety (90) days since its enactment.
