Breastfeeding. Promotion and Public Awareness. Sanctioned: July 3, 2013 Enacted in Fact: August 5, 2013

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

TITLE I

General provisions

ARTICLE 1-Object. The purpose of this law is to promote and raise public awareness of the importance of breastfeeding and the best practices of safe nutrition for infants and children up to two (2) years.

ARTICLE 2-Reach. For the purposes of this law, the following actions are included in the framework of public breastfeeding policies: a) Promotion of exclusive breastfeeding and optimal feeding practices in children up to six (6) months of age (b) Promotion of continued breastfeeding and timely complementary feeding for children of up to two (2) years of life; (c) Dissemination and accessibility of information to the effects of public awareness, especially of women (d) Promotion and support for the creation of breast-feeding centres and breast milk banks.

ARTICLE 3-Application Authority. The enforcement authority of this law is the Ministry of Health of the Nation, which must coordinate its implementation with the authorities of the provinces and the Autonomous City of Buenos Aires.

TITLE II

Objectives

ARTICLE 4-Determination of the objectives. In the framework of the promotion and public awareness of breastfeeding are objectives of this law:

(a) Promote the practice of breastfeeding in accordance with the provisions of this law; b) Promote actions and make recommendations in the public, private and social security subsectors, in relation to the appropriate conditions of the (c) Inform the importance of the appropriate nutritional status of women of childbearing potential and especially since pregnancy, and promote their nutritional support up to 24 months of age (24) months. (d) Spread the importance of the benefits of breast-feeding by: (e) Concierge and train the general population, health agents, social promoters and parents in particular, on the benefits and benefits of the social and economic benefits and benefits of the social and economic benefits and benefits of the breast-feeding and the correct use of substitute and complementary foods; (f) Promote the training of health teams in order to recommend breastfeeding in accordance with the scope of this law; (g) Develop research projects that promote safe nutrition practices for pregnant mothers and mothers breastfeeding and for children up to two (2) years of age; (h) to conduct research and interdisciplinary studies on infant feeding, breastfeeding and the socio-cultural, legal and economic factors involved in it; creation and development of breast-feeding centres whose role will be to collect, conserve and manage milk from the mother to the child herself; (j) Promote the creation and development of breast milk banks whose role will be to collect, process, preserve and distribute the same; k) Promote the provision of breast milk to infants when (l) Encourage voluntary and free donation of breast milk to provide existing and established breast-milk banks; (m) Promote the provision of adequate and complementary food and feed-in products. breast milk for infants of up to two (2) years of age, as determined by the regulations; (n) to disseminate the International Code of Sucedanees of Maternal Milk, as established by the Argentine Food Code, Law 18,284 and their complementary rules; or) Promote the accession of hospitals and care centres primary health to the programs "Friend of the Mother and Child Hospital" proposed by the World Health Organization-OMS- and the United Nations Children's Fund-UNICEF-to the "Center for Health Care Initiative of the Mother and Child" created by the Ministry of Health of the Nation and to those established by the sanction of this law; (p) To raise and update the indicators, the official statistics and the epidemiological studies related to this law; To conclude management agreements with the various jurisdictions in order to establish procedures, strategies and (r) Coordinate the necessary actions with representatives of public and private institutions, non-governmental organizations, laboratories, companies linked to the food supply, and the In order to promote the right conditions for the achievement of the objectives of this law, the nursing and nursing associations must promote the necessary regulations for the protection of the working mother in a period of (t) Promote the establishment of nursing homes in workplaces; or) Promote the establishment of necessary legislation on the creation, operation, control and quality standards of breast milk banks.

TITLE III

Financing

ARTICLE 5-Financing. The expenses that are required to comply with this law must be met with the items that the General Budget of the Public Administration for the Ministry of Health of the Nation, or with the affectation of budget appropriation of the items to be reallocated by the Executive Branch during the current financial year.

TITLE IV

Coordination with jurisdictions

ARTICLE 6-Coordination. The implementing authority together with the National Commission on Nutrition and Food should promote, within the framework of the Federal Health Council (COFESA), the application of this law in the field of the provinces and the Autonomous City of Buenos Aires. It must coordinate its integration with the existing programmes.

TITLE V

Additional provisions

ARTICLE 7-Regulation. The Executive Branch must regulate this law within ninety (90) days of its enactment.

ARTICLE 8 °-Commune to the national executive branch.
