Breastfeeding. Promotion and Public Awareness. Sanctioned: July 3, 2013 Enacted in Fact: August 5, 2013

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

TITLE I

General provisions

ARTICLE 1-Object. The purpose of this law is to promote and raise public awareness of the importance of breastfeeding and the best practices of safe nutrition for infants and children up to two (2) years.

ARTICLE 2-Reach. For the purposes of this law, the following actions are included in the framework of public breastfeeding policies: a) Promotion of exclusive breastfeeding and optimal feeding practices in children up to six (6) months of age (b) Promotion of continued breastfeeding and timely complementary feeding for children of up to two (2) years of life; (c) Dissemination and accessibility of information to the effects of public awareness, especially of women (d) Promotion and support for the creation of breast-feeding centres and breast milk banks.

ARTICLE 3-Application Authority. The enforcement authority of this law is the Ministry of Health of the Nation, which must coordinate its implementation with the authorities of the provinces and the Autonomous City of Buenos Aires.

TITLE II

Objectives

ARTICLE 4-Determination of the objectives. In the framework of the promotion and public awareness of breastfeeding are objectives of this law:

(a) Promote the practice of breastfeeding in accordance with the provisions of this law; b) Promote actions and make recommendations in the public, private and social security subsectors, in relation to the appropriate conditions of the (c) Inform the importance of the appropriate nutritional status of women of childbearing potential and especially since pregnancy, and promote their nutritional support up to 24 months of age (24) months. TITLE III

Financing

ARTICLE 5-Financing. The expenses that are required to comply with this law must be met with the items that the General Budget of the Public Administration for the Ministry of Health of the Nation, or with the affectation of budget appropriation of the items to be reallocated by the Executive Branch during the current financial year.

TITLE IV

Coordination with jurisdictions

ARTICLE 6-Coordination. The implementing authority together with the National Commission on Nutrition and Food should promote, within the framework of the Federal Health Council (COFESA), the application of this law in the field of the provinces and the Autonomous City of Buenos Aires. It must coordinate its integration with the existing programmes.

TITLE V

Additional provisions

ARTICLE 7-Regulation. The Executive Branch must regulate this law within ninety (90) days of its enactment.

ARTICLE 8 °-Commune to the national executive branch.
