Amendment. Sanctioned: December 16, 2014 Enacted: December 18, 2014

The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc., are sanctioned by law:

ARTICLE 1-Substitute Article 252 of the Criminal Code by the following:

Article 252: It shall be repressed with a fine of seven hundred and fifty ($750) to pesos twelve thousand five hundred ($12,500) and special disablement from one (1) month to one (1) year, the public official who, without having been admitted to the resignation of his destination, shall be subject to the will leave with damage from the public service. The member of a national security force, provincial or Autonomous City of Buenos Aires, or state armed agency that by its nature has in charge the care of persons, who knowingly will leave unjustifiably acts of service or maliciously omit the regular provision of the function or mission to which it is regulated, it will be repressed with prison sentence of one (1) to three (3) years and special disablement to exercise public charges for the double time of conviction. If, as a result of the abandonment or omission established in the preceding paragraph, damage to property of the force, third-party property, injury or death of his or her comrades or third parties is caused, a prison sentence of two (2) to eight (8) years shall be applied Absolute disablement to hold public office. The military officer who will leave his service, his destination or who will defect in time of armed conflict or disaster zone, will be sentenced to one (1) to six (6) years. If, as a result of his conduct, the death of one or more persons is caused, military losses are suffered or prevented, or the salvation of life is difficult in the event of a catastrophe, the maximum sentence will be raised to twelve (12) years. In any case, the penalties provided for will be imposed, provided that the offence is not punishable by a more serious penalty.
