NATIONAL PLAN FOR THE REDUCTION OF FOOD LOSSES AND WASTE
The Senate and Chamber of Deputies of the Argentine Nation, meeting in Congress, etc.
Article 1-Create the National Plan for the Reduction of Losses and Waste of Food.
Art. 2nd-Object: This law aims to reduce and eliminate Loss and Waste of Food (PDA), through the empowerment and mobilization of producers, processors, distributors, consumers and associations; particular relevance to the attention of the basic food needs of the population under conditions of vulnerability and with a risk of subsistence.
Art. 3 °-Create the Register of Institutions of Public Good for Food, in the field of the Ministry of Social Development of the Nation, or the one that in the future will replace it. In this case, the public or private institutions must register, legally constituted and comply with health controls provided for in the Argentine Food Code. These will be responsible for the reception of food products and for free delivery to final consumers.
Art. 4 °-Actions. Public policies for the promotion, development and promotion of the reduction of PDA and the donation of food should mainly comprise the following actions:
(a) Generate information and communication campaigns for the awareness of each of the actors in the food chain and consumers, aimed at optimizing practices to avoid losses and waste.
(b) Develop and train in processes and strategies for the conservation of crop products, particularly small-scale agriculture, intended for self-consumption or for sale; taking into account forms of use and consumption, traditional products.
c) Promote improvements in infrastructure, particularly transport, energy and market facilities, which make it possible to reduce PDA.
(d) Promote development and facilitate access to equipment and new technologies/innovation, which will contribute to reducing food losses at all stages of the chain.
e) Include the food and nutrition security issue and the way to avoid PDAs at all levels of education.
f) Manage with food producers and marketers, food banks, associations or non-governmental organizations, media, educational establishments, or other national and international entities, the subscription of agreements aimed at reducing food loss and waste, as well as encouraging and channelling the donation of food products in the terms of Law 25,989.
(g) Promote in the mass media permanent campaigns to raise awareness of the loss and waste of food, the revalorization of food and its use for the benefit of those who lack the resources economic to acquire them, and responsible consumption.
(h) Train operators in the food chain on the benefits of food donation.
(i) Any other action aimed at increasing the quantity and quality of food donated for the benefit of persons in a situation of vulnerability.
Article 5-The Executive Branch shall determine the specific enforcement authority of this law.
Article 6-Incorporate as Article 9 ° of Law 25,989, the following article:
" Article 9 °-Good faith of the donor and donor is presumed. From the moment of delivery of the donated thing to the recipient, under the conditions required by Article 2 °, the donor is released from all responsibility and will not respond to civil or criminal damage caused by the damage caused by the donated or the risk of the same, unless it is proved to be the fault or fault attributable to the donor, for actions or omissions prior to the delivery of the thing. "
Art. 7 °-Invite the provinces and the Autonomous City of Buenos Aires to adhere to the regulations established by this law.
Art. 8 °-Commune to the national executive branch.
