Decree 608/98

Please refer to the Secretariat of Communications in order to dictate the clear and interpretative rules for the correct application of the provisions set out in the Nros Decrees. 264/98 and 266/98.

VISTO Nros Decrees. 264 and 266 of 10 March 1998 and

CONSIDERING:

That the first of the administrative acts cited in the Hittite approved the Telecommunications Liberalization Plan, including the procedures for the allocation of new licenses to provide the services.

That Decree No. 266/98 approved amendments to the General Regulations of the Personal Communications Service (PCS), the Pliego de Bases y condiciones Generales y Particulares del Contest Público Nacional e Internacional para la Adjudicación de Licenses para la Prestación del dicho Servicio en el Area Múltiple Buenos Aires (AMBA) y su Extensión, y al Regulation General de Interconexión (RNI).

That it is necessary to empower the SECRETARIAT OF PRESIDENCE COMMUNICATIONS DE LA NATION to dictate the clarification and interpretative rules necessary to ensure the correct application of the provisions provided for in the aforementioned rules, without altering their substantive content, in the terms of the powers conferred by Decrees No. 245/96 and 1620/96.

It is also relevant to authorize the Secretariat to modify the time frames for implementation provided for in both the normative bodies mentioned in the Hittite.

Pursuant to article 6 of Decree No. 1185/90 as amended by its similar No. 2728/90, 761/93, 2160/93, 702/95, 515/96 and 80/97, the NATIONAL COMMUNICATIONS COMMISSION, without prejudice to its powers of control, attends the SECRETARIAT OF COMMUNICATIONS OF NATION in its regulatory activity.

The Legal and Regulatory Regulations of the NATIONAL COMMUNICATIONS COMMISSION (CNC) and the Directorate of Legal Affairs of the SECRETARIAT OF COMMUNICATIONS of the NATIONAL PRESIDENCE have taken action.

That the present measure is determined in the use of the powers conferred by article 99, paragraph 1, of the NATIONAL CONSTITUTION.

RIGHT:

Article 1-Please provide Mr. Secretary of Communications of the NATIONAL PRESIDENCE, with the assistance of the NATIONAL COMMUNICATIONS COMMISSION, with the provision of the clarification and interpretative standards necessary for the purposes of the administrative implementation of Decrees No. 264/98 and 266/98, and may also modify the time limits of implementation provided for in both regulatory bodies.
