CONSIDERING:
That through the sanction of the precited law, the implementation of profound structural changes in the functions of the State has been emphasized.
That in order to establish the main premises on which modifications are based, the principles of effectiveness, efficiency and economy have been defined as guiding principles.
That such concepts are complemented by the strengthening of the provision of state services, aiming to achieve greater transparency in the management of acts of government.
That within the activities to be carried out by the State are the arrangements related to procurement and contracting.
That in that context and under the last paragraph of article 26 of Decree No. 558/96, it was established that the purchases and contractings - carried out in the Ministries, Secretariats of the Presidency of the Nation, and centralized and decentralized agencies of the NATIONAL PUBLIC ADMINISTRATION, should be subject to the control of Prices Witness of the General SINDICATURA OF NATION.
That the implementation of the above-mentioned control has allowed, among other things, to have statistics that support the successful exercise of their requirements demonstrated by convenient savings figures in the costs of acquisitions thus surveyed, so it is appropriate to maintain the functioning of the planned system.
That the volume of the consultations and their markedly heterogeneous nature require attention through consultancy services, so the executing agency has seen its level of expenditure increased by having to meet the costs of the service incurred in obtaining the information concerning the required prices.
That by failing to provide for the prescribed standards, how to cover the costs of the implanted system, the General SINDICATURA NATION has been hampered by its normal financial management in the absence of sufficient budgetary provisions, and it is therefore deemed necessary that the Agency receives a tariff for the purpose of reversing such a situation.
That the present is dictated in the use of the powers conferred by article 99, paragraphs 1 and 2 of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT OF THE ARGENTINA DECRETA NATION:
Article 1Authorize the General SINDICATURA OF THE NATION to receive a tariff, which allows for the costs of maintaining the system of "witness prices", by the Ministries; Secretariats of the Presidency of the Nation, and centralized and decentralized agencies of the National Civil Service, which must, by virtue of the provisions of Decree No. 558/96, submit to the consultation prior to their acquisitions and/or contracts. Art. 2o.The reference fee may not exceed the figure of SEIS BY MIL (6 %) to apply on the total amount of the purchase or informed procurement. The General SINDICATURA OF NATION will dictate the methodology that will govern its application. Art. 3° 3Those jurisdictions and entities that comply with the provisions of Decree No. 558/96 for the "witness price" system are excluded from the provisions of the previous articles by agreements previously concluded with the General SINDICATURA OF NATION and which have agreed on another form of compensation for price consultations. The expiry of the above-mentioned conventions shall automatically apply the regime provided for in this decree. Art. 4o.The jurisdictions and entities, which conduct the consultations provided for by this decree, are authorized to bear the costs of the tariff referred to in article 29 using the budget headings for the nature of the goods and services that are processed. Art. 5o.La General SINDICATURA OF NATION TO TREINTA (30) days after the end of each semester of the budget period, will inform the SUBSECRETARIA OF BUDGET OF THE MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICS on the consultations received by jurisdiction in a detail that gives account of the level of savings achieved, using the figures as well established as feedback elements for the consideration and fixing of the budgetary levels of the following year.
