VISTO, Acts No. 24,804 of nuclear activity, No. 24,938 of the National Budget for the year 1998, Decree No. 660 of 24 June 1996, Administrative Decision No. 517 of 19 December 1996, and

CONSIDERING:

That Act No. 24,804, National Act on Nuclear Activity, provides that the National State shall establish the policy and exercise the functions of research and development through the National Atomic Energy Commission.

That Act provides that the NATIONAL COMMISSION ON ENERGY ATOMICA should advise the NATIONAL EXECUTIVE PODER in the definition of nuclear policy.

That in the context of the second State reform, which reorganizes the National Civil Service, Decree No. 660/96 transferred the NATIONAL COMMISSION ON ATOMIC ENERGY to the SECRETARIAT for Science and Technology of the MINISTERY OF CULTURE and EDUCATION.

That Administrative Decision No. 517/96 approved the organizational structure of the NATIONAL COMMISSION ON ATOMIC ENERGY.

That by virtue of the strategic nature of nuclear activity, its reintegration into the area of NATIONAL RESIDENCE is more appropriate.

That the present decree is issued in exercise of the powers conferred by article 99, paragraph (1) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Transfer the decentralized NATIONAL COMMISSION ON ATOMIC ENERGY of the SECRETARIAT OF SCIENCE AND TECHNOLOGY of the MINISTERY OF CULTURE AND EDUCATION to the NATION PRESIDENCE. Art. 2° - Amend Annex III to Decree No. 660/96 and its amendments incorporating the NATIONAL COMMISSION ON ATOMICA ENERGY as a decentralized body of the Presidency of the Nation. Art. 3° - The transfer provided by article 1 shall include organizational units with their respective posts, endowment, movable and immovable property and budgetary credits in force at the date of the present. Art. 4° - Within a period of TREINTA (30) days the NATIONAL COMMISSION OF ENERGIA ATOMICA will propose to the JEFATURA DE GABINETE DE MINISTROS the draft administrative decision to adapt the budget items to the provisions of this decree. Art. 5° - Expenditures for the operation of the NATIONAL COMMISSION ON ATOMICA ENERGY will be met from the budget lines of the jurisdiction of origin until the transfers provided for in the previous article are made.
