Decree 975/98

Amendment of Decree No. 637/79, which established rules to facilitate the shipment of goods abroad on appropriation.

VISTO Issue No. 061-005649/96 of the Register of the MINISTERY of ECONOMY AND PUBLIC SERVICES, and

CONSIDERING:

That Decree No. 637 of 16 March 1979 and its amendment, Decree No. 2799 of 26 October 1983 established an export regime in appropriation.

That said Decree establishes a list of goods classified under the old Nomenclature Tariff and Export Rights (NADE).

That the Common Nomenclature of MERCOSUR is currently in force, by which the exported products are classified.

It is considered necessary to adapt the existing regulations to the needs of international markets, in which the immediate availability of goods in the marketing centres is decisive for the specification of business.

That it is necessary to maintain the validity of this regime according to the usual operator of export and declaration of the values of it.

That the Permanent Legal Service of the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS has taken the intervention that is within it, considering that the proposed measure is legally viable.

That Article 373 of Law 22,415 and its amendments - Customs Code - empowers the NATIONAL EXECUTIVE PODER to take the proposed action.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 Replace Article 1 of Decree 637/79 and its modifications with the following text: "ARTICULO 1o- The exporters will be able to carry out shipments abroad as a consignment, of all the goods covered by the Common Nomenclature of MERCOSUR (NCM)".

Art. 2o- When shipments are made as appropriations, all measures that constitute interventions and/or prior controls for the export of goods that so require shall apply.

Art. 3o- Default of Decree No. 2799 of 26 October 1983.
