Approve an Acta Agreement between the National Telecommunication Company (in liquidation) and Telecom Argentina Stet France Telecom Sociedad Anónima.

VISTO Issue No. 11,067/97 and its aggregate without accumulating No. 7079/98 of the Register of the NATIONAL COMPANY OF TELECOMMUNICATIONS (in liquidation) and the provisions of Decree No. 1658 of 22 August 1991 and

CONSIDERING:

That the NATIONAL EMPRESS OF TELECOMUNICATIONS (in liquidation), within the framework of the process of privatization as provided by Law No. 23.696 and Decree No. 62 of 5 January 1990, is responsible for meeting the obligations and emerging rights of the transfer of the service it provided prior to 8 November 1990.

That Decree No. 1658/91 provides in its article 3 (e) that the Liquidating Officer has for the fulfilment of her mission, the attribution of controlling the development and proposing to the NATIONAL EXECUTIVE PODER, the approval of the final surrender of the state of account for the perceptions of the borrowing societies received by the provision of the telecommunications services provided prior to the date indicated. In addition, any other credit and/or capital contribution made by the NATIONAL TELECOMMUNICATIONS COMPANY or the NATIONAL STATE should be included in that topic and not expressly transferred.

That in the exercise of such powers and in the use of the powers conferred by article 3, paragraph (e) of Decree 1658/91, the Liquidating Officer representing the NATIONAL COMPANY OF TELECOMMUNICATIONS (in liquidation) and TELECOM ARGENTINA STET FRANCE TELECOM SOCIEDAD ANONIMA, held on 17 December 1997 an Agreement in the framework of transactional trafficking, complementary to the Agreement held on 27 August 1993, with the aim of considering factors not weighted in the latter and with the purpose of definitively closing the status of accounts derived from the management referred to in Chapter X of the Agreement on Transfer (Decree No. 2332 of 8 November 1990) and of any receivable arising from the privatization,

That it has been held ad referendum of the NATIONAL EXECUTIVE POWER.

That the General Directorate of Humanitarian Affairs of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS has taken the intervention that belongs to him.

That the present is given in the use of the powers assigned by article 99, paragraph 1 of the NATIONAL CONSTITUTION and the provisions of Act No. 23,696.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:

Article 1 Approve the Act of 17 December 1997 between the NATIONAL COMPANY OF TELECOMMUNICATIONS (in liquidation) and TELECOM ARGENTINA STET FRANCE TELECOM SOCIEDAD ANONIMA which, as ANEX I in authenticated copy, forms part of this decree.
