Decree 1015/98

Authorize the State Department to sell the property where the Embassy operates in the Eastern Republic of Uruguay, and affect the funds obtained for the acquisition of the future residence of the Ambassador in that country.

VISTO the presentation made by the REPUBLIC ENVIRONMENTAL REPUBLIC OF URUGUAY, and

CONSIDERING:

For more than one hundred years, the Ministry of the Interior had its headquarters in the avenue Agraciada 3397 of the Prado district of the City of Montevideo, which is the property of the National State.

That the same was of great representativeness and in keeping with the importance and level of cultural and economic relations between the two countries.

That during the years and the growth of the bilateral relationship, at all levels, between the two countries, coupled with the demographic growth of the city of Montevideo, made to the aforementioned property its provileged location characteristics, given its antiquity, the necessary functionality for which it was acquired.

That such a building, for the reasons mentioned, was handed over to the Uruguayan Government for its use as the headquarters of MERCOSUR, adopting at that time and as a transitory solution the decision to rent a property to be used as the Official Residence of the Ambassador of the REPUBLIC in the ORIENTAL REPUBLIC of URUGUAY.

That in the present circumstances it is necessary to proceed to the sale of the aforementioned property of the National State in the avenue Agraciada due to the above circumstances.

That, in parallel, the Republic lacks a property in the city of Montevideo to be used as the official residence of the Ambassador in the ORIENTAL REPUBLIC OF URUGUAY.

In the light of the statement, it is appropriate to authorize the sale of the sito property in the Avenida Agraciada of the city of Montevideo and to affect the amount obtained by it to the acquisition of the future residence of the Argentine Ambassador in that country, either in a sale or rental operation with option of purchase, as appropriate.

That according to the information provided by the Embassy of the Republic in the ORIENTAL REPUBLIC OF URUGUAY, the prices of the properties in the city of Montevideo, for which it is intended to be granted, are in continuous process of increase.

That, in view of the situations described, it is necessary to print the highest speed to the aforementioned real estate operations, safeguarding the highest interests of the Republic.

That, in order to carry out the described operations, it might be necessary to waive immunity from jurisdiction.

That the Directorate-General for Legal Affairs of the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO has taken the intervention that belongs to him, expiating favorably.

That the present measure is determined in the use of the powers conferred in article 99, paragraph 1 of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:

Article 1 Authorize the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO to sell the property owned by the NATIONAL STATE in the avenue Agraciada 3397, neighborhood of the Prado, of the city of Montevideo, REPUBLICA ORIENTAL DEL URUGUAY.

Art. 2°- Authorize the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO to affect the funds obtained by the sale of the property described in article 1 to the acquisition of a property in the city of Montevideo, destined to future residence of the Ambassador of the Republic in the ORIENTAL REPUBLIC OF URUGUAY. In the event of a financial surplus in favour of the NATIONAL STATE, at the conclusion of both operations, authorize the MINISTERY of FOREIGN RELATIONS, INTERNATIONAL TRADE And CULTO to affect such funds to purchase the necessary furniture and equipment for the new RESIDENCE IN MONTEVIDEO.

Art. 3°- Authorize the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO to perform the operation mentioned in the preceding article by means of sale or for rent with option of purchase, according to what best meets the interests of the Republic. In this second case, rent fees may be cancelled in advance with the funds obtained from the sale specified in article 1 and pursuant to the authorization granted in article 2°.

Art. 4°- The operations authorized by the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO shall have the prior technical supervision of the NATIONAL DIRECTION OF STATE BIENES, dependent on the MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES.

Art. 5°- Authorize, for the purpose of specifying the above-mentioned legal operations, the Ministry of Foreign Affairs, INTERNATIONAL TRADE And CULTO to waive, with the opinion of its competent areas, immunity from jurisdiction if it corresponds, within the limits and with the scope established by Law No. 23.928 and Decree No. 2006/92, and in relation to the present.
