CONSIDERING:
That by means of the aforementioned models of Loan Contracts and the CHARTER CONVENTION OF TECHNICAL COOPERATION NOT REEMBABLE, the INTER-AMERICAN BANCO of DEVELOPMENT concurs with the ARGENTINA NATION in the financing of the PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTS IN INTERNATIONAL RISK that will be implemented through the SECRETARIAN OF SOCIAL DEVELOPMENT
The purpose of the Programme to which resources are allocated is to contribute to the creation and development of an inter-agency network of services, with the participation of the Public Sector and Civil Society Organizations (CSOs), which provides preventive services and comprehensive care to improve the social integration and adaptability of children and adolescents at social risk Specifically, the Programme will support the NATION ARGENTINA to: (i) improve the quality of service delivery to children and adolescents at social risk, increasing the likelihood of their reintegration into society and improving their quality of life: and (ii) design and implement effective strategies to address the problem of children and adolescents at social risk.
That the resources of the models of Loan Contracts No. 1111/OC-AR and No. 1008/SF-AR and the CHAR CONVENTION OF TECHNICAL COOPERATION N° ATN/SF-6076-AR will be used to finance activities related to the implementation of the PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTES IN RISK.
That the implementation of the activities envisaged by the Programme requires the subscription of non-reimbursable funds transfer conventions between the PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTES IN RISK and those entities that are awarded through a competitive process of selection of proposals.
That the execution of the components of the Programme requires the acquisition of goods and the conclusion of contracts of location of work and/or services; with third parties, without dependency, according to the models of Contracts of Loan No. 1111 /OC-AR and No. 1008/SF-AR and of the CHARTA TECHNICAL COOPERATION DOES NOT REEMBOLSABLE N° ATARN/SF-60-76.
That the general conditions, the delays of amortization, the interest rates and other clauses contained in the models of Loan Contracts No. 1111/OC-AR and No. 1008/SF-AR and the CHAR CONVENTION OF TECHNICAL COOPERATION NO REEMBOLSABLE N°-6076-AR proposed to be subscribed, are the usual objectives that are agreed upon in this type
That it is necessary to create the EXECUTIVE UNITY of the PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTS IN RISK within the scope of the INTERNATIONAL FINANCING UNITY belonging to the SECRETARIAN SOCIAL DEVELOPMENT OF THE NATIONAL PRESIDENCE.
That the formalization of this operation requires that the ARGENTINA NATION, by means of the MINISTERY of ECONOMY AND ARTWORKS AND PUBLIC SERVICES, subscribes the Contracts of Loan No. 1111/OC-AR and No. 1008/SF-AR and the CHAR CONVENTION OF TECHNICAL COOPERATION DOES NOT RETURN/TEN-60
That under Decree No. 434 of 15 May 1997 and Administrative Decision No. 210 of 15 May 1997, the JEFATURA DE GABINETE DE MINISTROS has taken appropriate action.
That the models of Loan Contracts No. 1111/OC-AR and No. 1008/SF-AR and the CHAR CONVENTION OF TECHNICAL COOPERATION NO REEMBOLSABLE N° ATN/SF-6076-AR proposed to be subscribed are covered in the terms of Article 60 in fine of the Financial Administration and National Public Sector Control Systems Act No. 24.156.
That the General Directorate of Humanitarian Affairs of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS has taken the intervention that belongs to him.
That in accordance with Article 16 of 1st Law No. 11.672, Supplementary Permanent Budget (T. 1997) and Article 99 (1) of the NATIONAL CONSTITUTION, the NATIONAL EXECUTIVE POWER is empowered to approve operations of this nature and subject any disputes to the decision of the Arbitrary Tribunals.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1-Apply the model of Loan Contract No. 1111/OC-AR which consists of SIETE (7) Chapters and VEINTITRES (23) Clauses, the General Rules Applicable to the Contracts of Loan of the BANCO INTERAMERICAN DEVELOPMENT, composed of NUEVE (9) Chapters and CUARENTA and OCENSHO Art. 2°-Apply the model of Loan Contract No. 1008/SF-AR consisting of SETE (7) Chapters and VEINTITRES (23) Clauses, the General Rules Applicable to the Contracts of the Benefit of the BANCO INTERAMERICAN DEVELOPING, composed of NUEVE (9) Chapters and TRES (43) Art. 3°-Approved the model of the CONVENTION OF TECHNICAL COOPERATION N° ATN/SF-6076-AR which consists of CATORCE (14) Clauses, the General Conditions Applicable to the Non-Refundable Technical Cooperatives of the INTERAMERICAN BANCO, interested in DIECISIETE (17) Art. 4°-The Contracts of Loan and the CONVENUE CHARTER of TECHNICAL COOPERATION NO REEMBOLSABLE, whose models are approved by Articles 1, 2 and 3 of this Decree, will be allocated to the financing of the PROGRAMME of ATTENTION TO CHILDREN AND ADOLESCENTES IN RISK, up to the equivalent of DOLARES STADOUNIDENSES TREINTA MILLONE (U 000 US$. Art. 5°-Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him, to subscribe on behalf of and representation of the NATION ARGENTINA, the Contracts of Loan No. 1111/OC-AR and No. 1008/SF-A, the CHAR CONVENTION OF TECHNICAL COOPERATION DOES NOT REMAINABLE N. ATN/SF-6076-AR and all documentation relating to them, according to the models approved by Articles 1, 2 and 3 of this Decree. Art. 6°-Includes the change in the form of the Préstam Contracts, the Préstam Contracts No. 1111 /OC-AR and No. 1008/SF-AR, and the TECHNICAL COOPERATION CHARTER. Art. 7°-Disengage with the SECRETARIAT for SOCIAL DEVELOPMENT of the NATIONAL PRESIDENCE, through the International Finance Unit, as the executor of the PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTS IN RISK. Art. 8°-Consider the scope of the International Finance Unit of the SECRETARY for Social Development of the NATIONAL PRESIDENCE, the EXECUTIVE UNITY OF THE PROGRAMME OF ATTENTION TO CHILDREN AND ADOLESCENTES IN RISK, which will be responsible for its implementation as well as the administration of the funds allocated to it. Art. 9°-Please provide to Mr. Secretary for Social Development of the NATIONAL PRESIDENCE, or to the staff member or officials designated by the NATIONAL PRESIDENCE, to sign Non-Refund Transfer Agreements with the procuring entities. Art. 10°-Please provide to Mr. Secretary of Social Development of the NATIONAL PRESIDENCE, or to the staff member or officials who designate the same, to acquire the movable goods and/or equipment that are necessary for the implementation of the Programme, subjecting the respective contracts to the procedures of acquisitions, to the rules and procedures contained in the Loan Contracts and the CONVENTION CHAR of TECHNICAL COOPERATION.
