VISTO the Draft Law registered under N° 25.017 by the HONORABLE CONGRESS OF NATION on 23 September 1998 and


That through the Bill cited in the View, the benefits of the coverage of the NATIONAL INSTITUTE OF SOCIAL SERVICES FOR JUBILADOS and PENSIONADOS (INSSJyP) are granted to all beneficiaries of gratia pensions that suffer from disabilities, granted under Act No. 13.337 and its amendments.

Article 2 states that the rules and requirements to be fulfilled by the beneficiaries of the Bill shall be the same as those required to the recipients of the disability benefits granted in respect of non-contributory pensions by the SECRETARIAT for SOCIAL DEVELOPMENT of the NATIONAL PRESIDENCE.

Article 3 also states that the amounts of the benefits deducted in favour of INSSJyP will be up to a maximum equivalent to that of non-contributory pension recipients.

That currently, the cost of medical care for non-contributory pensions by the aforementioned Secretariat exceeds the funding obtained through the retentions made in such benefits and the medical assistance cost of the average INSSJyP beneficiary is above the above-mentioned retention, which makes the financing established in the Bill unviable.

On the other hand, no additional funding is determined in the previous consideration, which is why it is not properly expressed who should take charge of the cost of medical care of such benefits.

That the budget line that could be affected is also committed to the present exercise and taking into account the number of ex gratia pensions granted and to be granted, the greatest cost that will result in compliance with the Bill registered under No. 25.017 would lack funding.

It is up to the above-mentioned foundations to observe the Bill registered under No. 25.017.

That the NATIONAL EXECUTIVE POWER is entitled to dictate the present pursuant to article 83 of the NATIONAL CONSTITUTION.
