VISTO Issue No. 2002-4252/96-0 of the registration of the Ministry of Health and Social Action, and

CONSIDERING:

It also deals with the regulation of Law 23.753, which contains provisions on relevant aspects of the prevention of diabetes and various problems arising from the care of diabetic patients.

It is necessary to issue the corresponding regulations in order to enable their implementation in the shortest possible time.

That the General Directorate of Humanitarian Affairs of the Ministry of Health and SOCIAL has taken the intervention of its competence.

The exercise of the powers conferred by article 99, paragraph 2, of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1-The MINISTERY OF HEALTH AND SOCIAL ACTION, through the SECRETARIAT OF HEALTH PROGRAMMES and the technical areas of their respective unit, shall act as the Authority for the Application of Law 23,753 and the present regulatory decree. Art. 2°-The MINISTERY OF HEALTH and SOCIAL ACTION shall, as appropriate, promote the accession of the provinces and, eventually, of other jurisdictions to the regime of the aforementioned Law and of the present Rules. Art. 3°-The Applying Authority shall, through the various jurisdictions, have the necessary measures to ensure that patients with diabetes are provided with medications and diagnostic reagents for self-control that are deemed to be essential for proper treatment, as set out in the National Diabetes Programme and in the technical standards approved by competent authority in the national order. Art. 4°-The provision of medicines and other elements referred to in the preceding article shall be financed by the usual channels of social security and other systems of private medicine to meet the needs of the patients covered by them, with the State area in the different jurisdictions being the case for those patients who lack resources and social medical coverage. Art. 5°-The MINISTERY OF HEALTH AND SOCIAL ACTION will urge the different jurisdictions to achieve the coverage of the CIEN by 100 per cent of the demand in the case of insulin and the elements necessary for its application and a progressively growing coverage-never less than the SETENTA FOR SCIENT (70 per cent)- for the other elements established in the aforementioned Programme and the corresponding technical standards. Art. 6°-The MINISTERY OF HEALTH AND SOCIAL ACTION shall urge jurisdictions to establish, in anticipation of emergency situations affecting the insulin production, distribution or dispensation chain, such emergency measures as they deem necessary to ensure the provisions of article 3 of this regulation. Art. 7°-The medical commissions established by Act No. 24,241 as amended by Act No. 24,557 are competent to comply with article 3 of Act No. 23.753. Medical commissions shall be established within the scope of the MINISTERY OF HEALTH and SOCIAL ACTION to intervene in any dispute of those provided for in article 4 of Law 23,753.
