COOPERATIONAL INSTITUTE And MUTUAL Decree 1288/98 The Honorary Advisory Council shall be established within the scope of the Institute. Functions.

VISTO Decree No. 420 of 15 April 1996 and

CONSIDERING:

That the Decree established the NATIONAL INSTITUTE FOR COOPERATION AND MUTUAL ACTION (INACyM), within the scope of the SECRETARIAT for SOCIAL DEVELOPMENT of the NATIONAL PRESIDENCE.

That in its article 3, the Decree assigns to the NATIONAL INSTITUTE FOR COOPERATIONAL ACTION And MUTUAL the fulfillment of the objectives and responsibility of the implementation of the provisions of the Laws. 19.331, 20.321, 20.337, 23.427 and 23.566 and the other emerging obligations and rights of the rules governing the functioning of the former National Institutes of Cooperative Action and Mutual Action.

Article 111 of Act No. 20,337 provides for the formation of an Honorary Advisory Council, as well as article 1 of Decree No. 1858 of 13 September 1991.

That by Decree No. 723 of 3 July 1996, in order to achieve greater efficiency in public expenditure, the post of Vice-President was abolished and the number of members of the Board was reduced, resulting in the fact that not all representative organizations of the sector will have an official representative at the Institute.

That, therefore, in order to ensure more equitable representation and achieve a real integration of cooperative and mutual organizations, it is desirable to constitute the Honorary Consultative Council.

That the present measure does not result in increases in the amount and cost of the funded charges approved for the NATIONAL INSTITUTE OF COOPERATIONAL AND MUTUAL ACTION.

That the NATIONAL EXECUTIVE POWER is entitled to the present measure under article 99 (1) of the National Constitution and article 13 of Decree No. 977 of 6 July 1995.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 -Consider, within the scope of the NATIONAL INSTITUTE FOR COOPERATIONAL ACTION MUTUAL, the Honorary Consultative Council to be chaired by the President of the NATIONAL INSTITUTE FOR COOPERATIONAL ACTION And MUTUAL will be composed of SEIS (6) advisors appointed by the Secretary of Social Development of the Presidency of the Nation, THREE (3) advisors by the cooperative sector and THREE (3) advisers by the mutual sector, on the proposal of the most representative organizations of the aforementioned movements. Art. 2° - The advisers will last four years in their functions, being able to be appointed for new consecutive periods or canceled their designation at any time at the request of the postulant entity, will not receive any retribution by the NATIONAL INSTITUTE OF COOPERATTIVE ACTION. And MUTUAL the expenses that demand their participation in the Council shall be borne by the entities to whom they represent. The appointment as a member of this Council is not incompatible with any other designation in the Public Administration. Art. 3° - The functions of the Honorary Advisory Council shall be:

(a) To propose to the Chairman of INACyM the rules of procedure of operation of the Council.

(b) To advise the President of INACyM on the development of plans and programmes related to the fulfilment of the legal objectives and responsibilities of the Institute.

(c) Evaluate the regulations applicable to cooperatives and mutuals at the national and sectoral levels by proposing any changes it deems relevant.

(d) To learn and to give an opinion on the draft amendments to the applicable rules generated by the Institute.

(e) Participate in the INACyM Directory Meetings convened for the purpose of dealing with topics of their competence.
