PRESTAM CONVENTION Decree 1411/98 Approve a Loan Convention to be signed with the International Bank for Reconstruction and Development, on the financing of the Pollution Management Project, which is implemented with the coordination of the Secretariat for Natural Resources and Sustainable Development. SECRETARIAT OF NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT OF PRESIDENCE of the NATION and the model of the Loan Convention, proposed to be subscribed between the ARGENTINA NATION and the INTERNATIONAL BANK OF RECONSTRUCTION and FOMENT, for an amount of DOLARES STADOUNIDENSES DIECIOCHO MILLONES (U$ 60,000), and

CONSIDERING:

That through the aforementioned Convention on the Promotion of International Reconstruction and Promotion BANCO concurs with the ARGENTINA NATION to the financing of the GESTION PROJECT OF CONTAMINATION, which is implemented with the coordination of the SECRETARIAT OF NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT.

That through the so-called Loan Convention the INTERNATIONAL BANCO OF RE-CONSTRUCTION FOMENT is committed to financially assisting the ARGENTINA NATION in order to enable the implementation of the Project, through the SECRETARIAT of NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT.

The objective of the Project is also to strengthen the capacity of the SECRETARIAN OF NATURAL RESOURCES and SUSTENTABLE DEVELOPMENT, to adopt, pilot and show new initiatives and instruments for the management of pollution.

That the activities of the PROJECT OF GESTION OF THE CONTAMINATION shall be carried out in the orbit of the SUBSECRETARIA OF ENVIRONMENTAL ORDER, through the NATIONAL DIRECTION OF ENVIRONMENTAL ORDER and the SUBSECRETARIA DE COORDINATION through the General DIRECTION OF PROJECTS,

That the execution of the Project will require the hiring of consultancy services, the realization of administrative expenses and the acquisition of goods and equipment that were necessary for its implementation, a situation that is specifically contemplated in the Loan Convention to subscribe to the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO.

That the general conditions, the periods of amortization, interest rates, commitment commissions and other clauses conferred on the proposed Loan Convention to be signed, are the usual ones agreed upon in this type of Convention and are appropriate to the purposes and objectives to which this Loan is intended.

That the Directorate-General for Legal Affairs of the Ministry of Economic Affairs and PUBLICOS has taken the intervention that belongs to him.

That in accordance with article 16 of Act No. 11.672 of the Permanent Supplementary Budget (T.O. 1997) and article 99 (1) of the NATIONAL CONSTITUTION, the NATIONAL EXECUTIVE POWER is empowered to approve this type of operation and subject any disputes to the decision of the Arbitrary Tribunals.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 Approved by the Convention on Loans, which consists of SIETE (7) Articles and SEIS (6) Annexes, to be signed between the ARGENTINA NATION and the INTERNATIONAL BANK OF RECONSTRUCTION and FOMENT, for an amount of DOLARES ESTADOUNIDENSES DIECIOCHO MILLONES (U$ 180,000) Art. 2o- Please refer to the Minister of Economics and Public Works and Services, or to the official and/or officials designated by him, to subscribe on behalf of the ARGENTINA NATION, the Loan Convention and all documentation relating thereto, as approved in article 1 of this Decree. Art. 3o- Please refer to the Minister of Economics and Public Works and Services, or to the official and/or officials designated by the latter, agree to and subscribe to the Loan Convention, which is approved in article 1 of this Decree, provided that they do not constitute substantial changes to the destination of the said Decree, nor do they change the agreed Arbitral Procedure. Art. 4o- Authorize the SECRETARIAT OF NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT of the NATION PRESIDENCE, whether or through the executing unit created by Resolution SRN and DS No. 364, of 21 May 1998, to perform all the operations, contracting and acquisitions necessary for the implementation of the Project, in accordance with the rules, conditions and procedures provided for in the Préstamus Convention, which forms part I.
