Act No. 24,629, Issue No. 311-000650/96-1 of the Register of the NATIONAL INSTITUTE of VITIVINICULTURA, a decentralised agency in the jurisdiction of the SECRETARIAT of AGRICULTURA, GANADERIA, PESCA and ALIMENTATION of the MINISTERY of ECONOMY AND ARTH AND SERVICES
CONSIDERING:
That Act No. 24,629 initiated the administrative reorganization of the State in order to improve its functioning and the quality of services provided by the different jurisdictions of the National Civil Service.
In order to ensure the attainment of the above-mentioned mandate, the above-mentioned norm entrusted the NATIONAL EXECUTIVE PODER with carrying out, within its scope, the reorganization of the public sector to achieve greater efficiency and rationalization, enabling it to centralize, merge, transfer to the provinces, reorganize or delete, in whole or in part, decentralized agencies created by law.
That in the organization of the National State the NATIONAL INSTITUTE OF VITIVINICULTURA occupies a relevant place, given the fiscal function that implies the control of the genuinity and aptitude for the consumption of the wine products and also the control of the production, circulation, fractionation and marketing of the ethyl and methyl alcohols.
That, as a step prior to the strengthening and comprehensive modernization of its functioning, it is necessary to adjust the structure of the NATIONAL INSTITUTE OF VITIVINICULTURA, in order to install the central responsibilities on the basic processes that the agency intends, thus achieving efficiency and effectiveness in the fiscal function.
That UNITY OF REFORM AND MODERNIZATION THE STATE has taken the intervention that belongs to it, expiating favorably.
That the present is dictated in the use of the powers granted to the NATIONAL EXECUTIVE PODER by Article 99 (1) of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . Approved the organizational structure of the NATIONAL INSTITUTE OF VITIVINICULTURA, a decentralized body within the jurisdiction of the SECRETARIA DE AGRICULTURA, GANADERIA, PESCA and ALIMENTATION of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SEVICIES, in accordance with the Organizational chart, Objectives, Primary Responsibility and Actions Art. 2o . Within a period of TREINTA (30) days, from the publication of the present act, the NATIONAL INSTITUTE OF VITIVINICULTURA shall raise the proposal for lower openings, as provided for by Decree No. 1545 of 31 August 1994, regulated by Resolution No. 422 of 13 September 1994 of the Register of the SECRETARIAT of the PUBLIC FUNCION, then dependent on the PENCIA. Until then, existing units will be in force, with the assignment of the respective posts with executive functions. Art. 3o El The expenditure that demands the application of this measure will be met with the credits of the specific items allocated to the NATIONAL INSTITUTE OF VITIVINICULTURA by the Budget of the current National Administration. NATIONAL INSTITUTE OF VITIVINICULTURA
Objectives
Verify, as a national enforcement authority, compliance with Acts 14.878 and 24.566, by issuing the necessary rules for the attainment of the purposes inherent therein.
Adopt and coordinate the implementation of plans and programmes for the control of the genuinity of wine products, in the production, processing, fractionation and marketing stages, in accordance with Law No. 14.878 and its amendments.
To approve and coordinate, with the National Food System, the implementation of plans and programmes to exercise control of the production, circulation, fractionation and marketing of alcohols, in accordance with the National Alcohol Act No. 24,566.
To promote research to improve the control of wine products and alcohols and to ensure the continuous updating of the control mechanisms for technological innovations and the new analytical techniques in place in different countries.
To participate actively in meetings of international technical agencies linked to the wine sector, in order to increase the gravitation of the ARGENTINA REPUBLIC in the decisions taken in them.
Understand export certifications, intervening in the adoption of measures to resolve differences in international trade.
Coordinate, as a specific agency, the ongoing updating of wine and alcohol statistics, being responsible for providing this information to the National Statistical System and the International Organization for the Development of the World Wine and Livestock (O.I.V.), as an official delegate for the World Viticulture Statistics.
UNITY OF INTERNAL AUDITORY
Primary responsibility
Verify the maintenance of an adequate internal control system incorporated into the organization of the Institute, by favouring economic, efficiency and effectiveness guidelines.
Actions
1- Establish the overall and annual planning of the Internal Audit and the specific programmes, in accordance with the guidelines established by the General SINDICATURA OF NATION and direct its implementation.
2- Assess compliance with policies, plans and procedures established by the Agency ' s senior authority.
3- To advise on the determination of the rules and procedures of the Internal Control System.
4- Verify compliance with the regulations in force in the management of the agency, both in administrative and technical matters.
5- Comply with the reliability of the background used for the preparation of reports or accounting statements.
6- Issue periodic reports on audits and other controls performed.
7- To inform the superior authorities and the General SINDICATURA OF NATION regarding the level of implementation of the recommendations and/or observations that have been made.
8- To report on the topics that the General SINDICATURA OF NATION requires in the development of its activities.
FISCALIZATION GERENCE
Primary responsibility
Manage, throughout the national territory, the rules and procedures set out in Acts 14.878 and 24.566, their supplements, extensions and regulations, through the technical and legal countermeasure of the production, industrialization and marketing of wine products and alcohols, in order to ensure the genuinity and/or aptitude for the consumption of the products defined in the above-mentioned domestic instruments, both for the export of domestic products.
Understand the coordination and supervision of wine and alcohol studies necessary to establish scientific and technical bases for efficient control.
Monitor the development of statistical information in the wine sector.
Actions
1- Coordinate the control of the production, industrialization and marketing of wine and alcohol products, planning the same at the national level.
2- Coordinate the study, development, updating and application of rules of procedures for the control of wines, alcohols and enological products.
3- Monitor the ongoing updating of the sector's competition records, in accordance with the relevant regulations.
4- Planning and coordinating the implementation of studies on technological processes, treatments, materials and products for the use of energy, as well as on practices that are incorporated into the industrial activity of the sector, for the consequent normative updating of control.
5- Certify the correct legal classification of products according to the result of your analysis.
6- Organize and exercise control over export and imports of wines, musts and alcohols.
7- Understand in the direction, coordination and monitoring of the activities of the agency delegations in the country.
8- Coordinate the study, development and updating of general, special and sensory analytical methods to ensure the genuinity and aptitude for the consumption of wine products.
9- Understand the standardization of the methods of analysis of wine control, alcohol and enological products in the laboratories of the Agency, in accordance with national and international standards on quality and certification.
10- Understand in the habilitation and auditing of private wine and alcohol analysis laboratories.
11- Organize, direct, coordinate and monitor the functioning of the Agency ' s laboratories.
12- Develop and coordinate the implementation of the relevant rules for the approval of products of enological use and/or other products or elements of use in winemaking establishments, as well as those for the production, fractionation and handling of alcohols.
13- To grant certificates of free circulation analysis, processing, control, approval, counter-verification, export aptitude, import and particulars, referring to products and by-products of the wine industry and of enological use, as well as those required.
14- Understand the setting of tolerances and limits of components in wines, alcohols and enological products.
15- Participate in technical meetings of national and international agencies, where the topic of the area of their competence is concerned, intervening in the decision-making and adoption of standards on the establishment of methods of analysis and limits of components and/or all other technical ones, which may affect the production and marketing of the sector and in the control of wines and alcohols.
16- Program the collection, analysis and dissemination of statistical information on wine and alcohol activity in domestic and external markets in those aspects related to production, distribution and marketing.
LEGAL AND ADMINISTRATIVE SUBGERANCE
Primary responsibility
Understand the coordination of technical, legal and administrative support activities of the Agency.
Actions
1- Direct, coordinate and monitor the management of budgetary, administrative-counting, legal, computer, human resources and general services matters.
2- Propose to the superior authority projects, plans and operational programs of the areas of its competence, evaluating and collaborating its results.
3- Control the efficient and proper administration of human, financial and computer resources.
4- Intervene in the development of all draft laws, decrees and resolutions linked to the substantive work of the entity.
5- Supervising legal issues, as well as administrative-disciplinary summaries and/or breaches of the rules governing the substantive actions of the agency.
6- Coordinate the dispatch, follow-up and archive of the administrative documentation, determining for each procedure the units of the jurisdiction with primary responsibility to understand in the respective subject.
