CONSIDERING:
That it is necessary in the present circumstances to adapt the procedure in force to allow the Associations of Social Works and the Social Works with their own effects, creditors of other Health Insurance Agents, which can effect, through the intervention of the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW, the timely collection of invoices generated by the provision of the services.
That this would project a greater dynamism to the System, decreasing the costs of the Controller by replacing them with automatic mechanisms of liquidation and control between entities of the system itself.
That the Social Security solidarity system should continue to allow equal, efficient and equitable access to health benefits and at the same time must tend to contain unproductive spending.
In view of the fact that the collection and distribution of the resources of Social Works is assigned to the IMPOSTITIVE GENERAL DIRECTION, it is incumbent upon the agency, through the intervention of the NATIONAL ADMINISTRATION OF the HEALTH FOLLOWER, to be the agency that concretes the retention and deposit of the funds.
That the automatic mechanisms to implement are already embodied, without prejudice to other rules, in Article 16 of Decree No. 578/93, in Joint Resolution No. 320/93 of the MINISTERY OF HEALTH AND SOCIAL ACTION, 753/93 of the MINISTERY OF ECONOMY AND PUBLIC SERVICES AND 565/93 of the MINISTERY OF WORK AND SECURITY SOCIAL, concerning the automatic debit on the funds of the Social Works for the Public Hospital of Self-management, and in the regulation of Law 23.661 provided by Decree No. 292/95, amended by its similar No. 492/95, concerning the automatic distribution of the Solidarity Fund for the Redistribution of the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP.
That the present is dictated in the use of the powers conferred by article 99, paragraphs (1) and (2) of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . Social works with their own effects or Social Work Associations (A.D.O.S.) that are creditors of other entities of the system provided for in Law 23.661, for medical, pharmaceutical, dental and/or biochemical benefits, may receive their credit through an automatic debit to be made by the collecting agency. Art. 2o El The Creditor Health Officer must submit to the NATIONAL ADMINISTRATION OF THE HEALTH A "Journal Declaration" of his credit, signed by his Legal Representative, attaching a copy of the unpaid bills claimed. Art. 3o . The NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP will proceed to notify the debtor health agent, who in a single and unlikely period of TEN (10) days must cancel the obligation by submitting the corresponding documentation, signed by the Social Work or Association of Complaining Social Works. Art. 4o La The lack of response or cancellation of debt will activate the automatic debit mechanism, so the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP will request the IMPOSITTIVE GENERAL DIRECTION .Centralized Collection System. withholding from the collection of the debtor health agent the amount claimed, funds that will be deposited to the order of the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP in a bank account specially authorized by the latter. Art. 5o LaThe NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP will proceed to hand over the funds received by this mechanism to the creditor health agent, who will issue the corresponding documentation for the health officer from whom the funds were extracted. Art. 6th . The NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP will agree with the IMPOSTITIVE GENERAL DIRECTION on the procedural aspects necessary for the functioning and effectiveness of this system, with the first authority for the dictation of the relevant interpretative and complementary norms.
