CONSIDERING:
In accordance with Laws No. 22,439, No. 24,393 and its regulatory decrees, the NATIONAL DIRECTION OF MIGRATIONS is responsible for the primary responsibility of monitoring compliance with migration standards and for intervening in the implementation of policies, plans and projects developed in population matters.
That Administrative Decision No. 5/96 established, within the scope of the NATIONAL DIRECTION of MIGRATIONS, the Administrative and Financial Services Directorate to comply with the provisions of article 111 of Law No. 22,439 and directly administer the specific affectation resources provided for in this legal rule.
That Decree No. 146/96 established that the NATIONAL DIRECTION OF MIGRATIONS should be relied directly on by the ex-SECRETARIAT of POPULATION AND RELATIONS WITH THE COMMUNITY OF THE MINISTERY OF INTERIOR.
That the implementation of Decree No. 146/96 and Administrative Decision No. 5/96 have demonstrated the continuation of the management autonomy process initiated and constitute the proven precedent for deepening the decentralization of the agency, in accordance with the objectives envisaged in the State reform.
In order to comply in time and form with the complexity and specificity of the existing procedures, experience has demonstrated the need for the NATIONAL DIRECTION of MIGRATIONS to have its own legal service as well as an appropriate internal control system.
That the decentralized entity, envisaged in the organizational structure of the MINISTERIO DEL INTERIOR approved by Decree No. 1410/96, conforms to the requirements of an efficient management of migration and population policy carried out by the National Government, within the framework of the current globalization and integration processes.
That the measure programmed does not imply an increase in the budget allocations allocated to the Jurisdiction for the present period.
That the TECHNICAL ADMISSION OF PUBLIC POLICY OF THE PUBLIC SECTOR and the UNITY OF REFORM AND MODERNIZATION OF THE STATE OF THE GOVERNMENTAL JEFATURA OF MINISTERS have taken the intervention that they are entitled to.
The present is given in the exercise of the emerging powers of article 99, paragraph 1, of the National Constitution and Chapter II of Act No. 24,629.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . Approved the organizational structure of the NATIONAL DIRECTION OF MIGRATIONS, a decentralised body dependent on the SUBSECRETARIA DE POBLACIÓN of the MINISTERIO DEL INTERIOR, in accordance with the Organigram, Primary Responsibilities and Actions and Charges Permanent Plant, Non-Permanent Plant and Global Endowment, which as Annex I, II and IIIa, IIIb and IIIc.
Art. 2o . Please encourage the decentralized NATIONAL DIRECTION OF MIGRATIONS to fulfil the objectives and responsibility for implementing the provisions of Laws No. 22,439 and No. 24,393 and its regulatory decrees, and other obligations and emerging rights of the rules currently governing the National Directorate of Migration.
Art. 3o . Transfer to the decentralized NATIONAL DIRECTION OF MIGRATIONS the totality of the existing budgetary, assets, liabilities and staff of the former National Directorate of Migration.
Art. 4o El The National Director of the NATIONAL DIRECTION OF MIGRATIONS will have rank and rank of Assistant Secretary.

Art. 5o . Please refer to the position of Internal Auditor of the NATIONAL DIRECTION OF MIGRATIONS, in accordance with the conditions set out in Decree No. 971 of 6 May 1993, its amendments and complementary ones.
Art. 6th . Please provide for the term of NOVENTA (90) days to the NATIONAL DIRECTION OF MIGRATIONS to designate on an interim basis, and until the selection processes are carried out, to the staff who will be responsible for the organizational units that are approved by the organisational structure established by the present.
Art. 7o de Within the period of TREINTA (30) days from this Decree, the NATIONAL DIRECTION OF MIGRATIONS shall submit the proposal of organizational structure of the lower openings than approved in this Decree, in accordance with the provisions of Decree No. 1545 of 31 August 1994 regulated by SFP Resolution No. 422 of 13 September 1994.

Annex II
NATIONAL DIRECTION OF MIGRATIONS
UNITY OF INTERNAL AUDITORY
PRIMARY RESPONSIBILITY:
Provide a service consisting of the comprehensive and timely review of the financial and administrative activities of the National Directorate, covering the budgetary, financial, economic, property, policy and management aspects, the evaluation of programmes, projects and operations, based on economic, efficiency and efficiency criteria.
ACTIONS:
1. Develop the annual and global plan of the U.A.I. of the National Directorate in accordance with the existing standards.
2. Produce comprehensive and integrated information on the management of the various areas of the National Directorate, analysing the implementation of the policies and targets set by the High Authority.
3. To advise the National Directorate on the systems and procedures to be applied in the agency.
4. To bring to the attention of the High Authority and the General SINDICATURA of the NATION any acts which they have carried or deem may cause significant damage to the heritage of the National Directorate.
5. Evaluate the accuracy of accounting regularity in registrations and safeguard measures taken for restricted access to liquid, fixed, documentation and records.
6. Issue periodic reports on internal audit controls, limited review, special and financial controls on the subject under control.
7. Diagnose the degree of reliability of the analysed information systems, based on the existence of control disciplines and basic accounting controls.
DIRECTION OF FOREIGN ADMISSION
PRIMARY RESPONSIBILITY:
Fiscalize the admission of aliens throughout the National Territory.
ACTIONS:
1. Develop policy proposals concerning the admission of aliens to the country and, in general, concerning the area of their competence.
2. Process applications for admission of aliens who manage their residence in the country, their renewals and extensions, as well as authorizations to temporary residents, to develop remunerated or profitable activities.
3. Develop, propose and apply the psychophysical selection criteria of aliens who request their residence in the country.
4. Implementation of environmental reports required to resolve
the admission of foreigners.
5. Exercise the powers delegated by the National Directorate
resolve procedures for your competition.
DIRRECTION OF MIGRATORY CONTROL
PRIMARY RESPONSIBILITY:
Control the entry and discharge of persons by the places authorized to do so and the stay of foreigners in the country.
Coordinate and monitor the functioning of the delegation and Migration Offices of the agency within the country and maintain, at its level, liaison with the Assistant Migration Police and delegated authorities.
ACTIONS:
1. Develop policy proposals concerning the control of the entry and discharge of persons and the permanence of foreigners in the country and, in general, concerning the area of their competence.
2. Intervene in the development of projects related to the empowerment of places (airports, steps, bridges and ports) for the international transit of people.
3. Fiscalize the entry and return of persons to the country, grant relevant migration qualifications and conduct inspections of international means of transport.
4. To intervene in the declaration of illegality of the stay of aliens in the Republic and in the relevant measures to be taken.
5. Control compliance with the obligations of job and accommodation providers with respect to the foreign population residing in the country and grant inspection certificates.
6. Ensure the supply of the necessary effects to ensure the normal functioning of the Delegations, Migration Offices and the Assistant Migration Police.
DIRECTION OF SYSTEMS
PRIMARY RESPONSIBILITY:
Propose the diagnosis and monitor the design, analysis, evaluation, implementation, monitoring and control of information systems, for the computerization of the various programs, projects and activities of the agency.
ACTIONS:
1. Systematize and process information related to the internal functioning of the body.
2. Prepare the information and optimize the integral use of the available computing equipment, performing activities of reception, codification and recording of the information in magnetic supports, in accordance with the priorities set by the Directorate.
3. Coordinate the Computing Centre and technically assist in the operation of the auxiliary teams and in the technical training of staff.
4. Keep constant contact with the user sectors, providing professional and technical assistance.
5. Plan, promote and implement systems in accordance with technical, economic and operational feasibility.
DIRECTION OF ADMINISTRATION AND HUMAN RESOURCES
PRIMARY RESPONSIBILITY:
Conduct activities that provide technical-administrative support for the management of the financial, human and material resources of the National Directorate and obtain the necessary information for decision-making.
ACTIONS:
1. Direct the accounting, economic and financial services of the National Directorate.
2. Develop the annual budget proposal and control budget execution for the National Directorate.
3. Manage funds from the General NATION TESORERY and the specific affectation resources established by Law No. 22,439.
4. To effect, in accordance with the existing rules on procurement, purchases, transfers and payments for management.
5. Fiscalize the economic and financial management of the delegation and migration offices of the interior of the country.
6. Planning, directing and controlling the administration of human resources of the National Directorate.
7. Coordinate and monitor staff selection, training and evaluation processes.
8. Lead the actions of analysis, planning and organizational design.
9. Direct the general services and systems of maintenance and administration of the goods of the National Directorate.
DIRECTION OF LEGAL MATTERS
PRIMARY RESPONSIBILITY:
Legal and legal advice on matters of competence of the National Directorate.
ACTIONS:
1. Intervene, supervise and advise on all matters of a legal and legal nature related to the application and interpretation of Law No. 22,439.
2. To produce the legal opinions requested by the different areas of the agency in accordance with the current regulations.
3. To chair, by delegation of the National Director, the Committee on Eligibility for Refugees.
4. Collect and analyse existing domestic and foreign provisions that are relevant to the National Directorate.
5. Representing the National Directorate of Migration in matters falling within its competence when it is a party, assigning the cases and giving relevant instructions to the representatives or sponsors who must intervene.
DEPARTMENT
PRIMARY RESPONSIBILITY:
Direct the instruction of administrative sums to be initiated when there are reasons to justify it.
ACTIONS:
1. Conduct investigations into the facts or omissions leading to the conduct of summaries.
2. Monitor the collection of reports and documentation required to determine fiscal damage and emerging property liability.
3. To seek complaints against the competent criminal justice system, where there are indications of the commission of a crime of public action in a summary.
4. Propose, where necessary, the authorization of specific and determined proceedings outside the seat of its functions.
5. Propose the designation of an "ad hoc" instructor in cases where there are duly substantiated reasons to justify it.
