VISTO Decree No. 995/91 and its amendment No. 1435/91, both ratified by Article 35 of Law 11.672 (t. 1996), Decree No. 765/93, 2076/94, 558/96, 660/96, 1274/96, Law No. 24.629, and
CONSIDERING:
That Decree No. 995/91, as amended by Decree No. 1435/91, established the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE), as an agency under the NATIONAL REPRESIDENCE, having been both acts ratified by article 35 of Act No. 11.672, Supplementary Permanent Budget (T. 1996).
In turn, by Decree No. 765/93, the powers assigned to the Chairman of the above-mentioned Commission were amended.
On the other hand, Decree No. 2076/94 adopted the National Space Plan, providing, inter alia, that the actions provided for in that Plan for the period 1995-2006 are the Strategic Plan of the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE).
That also, through Law No. 24,629 and the Decree No. 558/96 and 660/96 and modifications, a new phase of the State Reform was implemented.
That Decree No. 660/96 provided that the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE) would act within the scope of the MINISTERY OF CULTURE AND EDUCATION, through the SECRETARIAT OF SCIENCE and TECHNOLOGY.
That, by Decree No. 1274/96, the Functional Organic Structure of the Ministry was approved, with the reference to the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE) relied on the Ministry of Foreign Affairs, INTERNATIONAL TRADE and CULTO.
It is also advisable to make explicit the inclusion of the above-mentioned COMMISSION, as provided for in article 15 of Decree No. 1274/96.
Given the strategic projection that has gained space activity, it is necessary to clearly differentiate the political role of the executive-technical roles that converge in the NATIONAL COMMISSION OF SPACE ACTIVITIES (CONAE), while preserving an adequate hierarchical level of the Agency in relation to other equivalent entities of countries with outstanding space activity.
That the experience from Organizations of the characteristics of the NATIONAL COMMISSION OF SPACE ACTIVITIES (CONAE), which apply the matrix structure, shows the desirability that activities related to the executive-technical aspects, be conducted by a professional of the Permanent Plant of the Agency, designated by the Board, with explicit capacity and background, both technical and managerial, for the performance of the post.
In turn, it is appropriate for them to be part of the Board of Directors of the Commission, the professionals of the Permanent Plant with the highest executive-technical and scientific responsibility of the agency.
The TECHNICAL COMMISSION ASSESSMENT OF THE PUBLIC SECTOR, the UNITY OF REFORM AND MODERNIZATION OF THE STATE and the Legal Service of the Ministry of Foreign Affairs, INTERNATIONAL TRADE AND CULTO.
Therefore, it is necessary to introduce the necessary adjustments to Decrees Nros 995/91 and amendments.
That the present measure is determined in the use of the powers conferred by Article 99(1) of the NATIONAL CONSTITUTION and by Law No. 24,629.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 s Replace Article 5 of Decree 995/91 and amend the following:" ARTICLE 5 La The NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE) will have the following organizational structure:
(a) A board composed of ONCE (11) members. The Directory will consist of the following:
A president. The post of President shall be served by the Minister for Foreign Affairs, International Trade and Worship. The official shall submit to the President of the Nation an annual report on the activities carried out by the Agency.
A Vice President. The post of Vice-President shall be held by the Secretary for Foreign Affairs and Latin American Affairs of the Ministry of Foreign Affairs, International Trade and CULTO.
A representative, appointed by the NATIONAL EXECUTIVE PODER, on the proposal of each of the following areas of the National Civil Service.
MINISTERY OF EXTERNAL RELATIONS, INTERNATIONAL TRADE AND CULTO;
MINISTERY OF CULTURE AND EDUCATION;
DEFENSA MINISTERY;
MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES;
SCIENCE AND TECHNOLOGY SECRETARIAT OF CULTURE AND EDUCATION MINISTERY;
SECRETARIAT OF COMMUNICATIONS;
SECRETARIAT OF NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT.
Such officials will last four years in their functions, renewing themselves for half each TWO (2) years, and may be re-elected indefinitely.
Two permanent plant professionals who will be appointed by the Board members to serve as Executive and Technical Director and Scientific Director.
The Executive and Technical Director and the Scientific Director may be removed with a substantial cause.
(b) The legal representation of the Agency shall be exercised by the President of the Board who may delegate it to the Vice-President of the Board or to the Executive and Technical Director, indistinctly.
(c) The Executive and Administrative Tasks of the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE), in the terms specified in the Nros Decrees. 995/91 and 765/93 will be exercised by the Executive and Technical Director, except those explicitly decided to retain the President of the Board.
(d) The Executive and Technical Director shall make the draft annual report (memory and balance) for analysis by the Board.
(e) The functions of the Board will be:
I) The definition and follow-up of the annual guidelines for the implementation of the National Space Plan.
II) The evaluation of the activities carried out by the NATIONAL COMMISSION ON SPACE ACTIVITIES (CONAE).
III) Analysis of the draft annual report (memory and balance sheet).
IV) The adoption of the annual budget proposal, in line with the forecasts set out in the National Space Plan.
The Board shall hold regular meetings on a monthly basis, which shall be chaired by the President of the Board or, failing that, by the Vice-President or the Executive and Technical Director, in that order.
Extraordinary meetings may be held at the request of the President, the Vice-President or the Executive and Technical Director."
