VISTO Law 22.421 and Rule Decree 691/81; and
CONSIDERING:
That article 30 of Law 22,421 empowers the control agents designated by the Enforcement Authority to kidnap objects from an offence.
That in cases of kidnapping of living or dead animals, articles 46 and 47 of Decree 691/81 provide that the costs of deposit, transport and conservation are borne by the offender.
That the decree does not provide for similar measures when it comes to products or by-products of wildlife.
Taking into account the amount of goods seized by the enforcement authority and the expenses that this entails, it is necessary to reformulate article 48 of Decree 691/81, transferring the expenses of deposit to the offender.
That the present measure is determined in the use of the powers conferred by article 99, paragraphs 1 and 2 of the National Constitution.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 , Add as second paragraph of Article 48 of Decree 691/81, the following: "The expenses of deposit, transport and conservation shall be borne by the offender." Art. 2° La The Secretariat for Natural Resources and Sustainable Development is empowered to set tariffs for the costs of depositing and conserving the products and by-products of the wild fauna that are in the deposits of that organism, in accordance with article 60 of Law No. 11.672, supplementary Permanent Budget (T. 1.996).
