VISTO Draft Law No. 24,806 sanctioned by the HONORABLE CONGRESS OF NATION dated 16 April 1997 and
CONSIDERING:
That the wording of article 3 of draft Law No. 24,806 may cause confusion about the authorities implementing the sanctioning rules mentioned.
That from the omission of express references to the specific sanctioning legislation in the field of education, precisely in the article that establishes the punitive regime, the tacit derogation of that one could be inferred for the cases covered by the bill.
On the contrary, given the seriousness of the offences established, it is appropriate to apply all appropriate penalties.
That the criminal law establishes the obligation of all public officials and employees to report to the judicial authority the offences of public action that they know in the exercise of their functions, without limiting it to cases of violations of a particular article.
That nothing hinders the establishment by regulation of the duty to communicate the relevant to the respective authority of the consumer and user tuitive regime.
It is reasonable to initiate sanctioning actions in all cases, whether or not the commission of the facts ceases, irrespective of whether such a circumstance assists the assessment of the penalty.
It is for the reasons set out to observe article 3 of the Bill.
That this Decree is issued in the use of the powers conferred by article 80 of the NATIONAL CONSTITUTION.
