Authorize the Federal Broadcasting Committee to call a public contest to award the license for the installation, operation and operation of a sound broadcasting station by modulation of amplitude in the City of Mendoza.

VISTO acted in Expediente No. 1846/96 of the registration of the FEDERAL COMMITTEE OF RADIODIFUSION and the provisions of Acts No. 22,285 and 23,696; and

CONSIDERING:

It is the policy of the National Government to meet the objectives set out in Act No. 23,696 on privatization and private capital participation.

That in accordance with article 9 and Annex I of the precited law, all media administered by the National State were declared subject to privatization, including the sound broadcasting station for the modulation of the amplitude called LV8 RADIO LIBERTADOR, of the city of MENDOZA, the homonymous province.

That in order to carry out the aforementioned privatization, the aforementioned legal system gives wide powers to the NATIONAL EXECUTIVE PODER.

That, for that purpose, it is appropriate to authorize the FEDERAL COMMITTEE OF RADIODIFUSION, in its capacity as implementing authority of the National Broadcasting Act No. 22,285, to implement the contestal acts provided for in article 39, paragraph (a), of the aforementioned policy brief, in order to award the corresponding license for the installation, operation and operation of that station, which will be identified with the distinctive signal "LR.80

That the public contest referred to in the previous consideration will include the installation, operation and operation of a sound broadcasting station by frequency modulation, located equally in the city of MENDOZA, the homonymous province, which will operate in the frequency of 92.7 Mhz with a equipment of PRE=40 Kw and HMA= 150 mts., equivalent to category "B" and identified with the distinctive sign "LRJ 300".

That, for the same purpose, it is appropriate to authorize the said agency to develop the General and Private Bases and Conditions which will govern the relevant contest.

That the NATIONAL COMMUNICATIONS COMMISSION has taken the intervention provided for in article 94 (f) of Act No. 22,285, determining the frequency, distinctive signal and other technical emission values corresponding to the contested stations.

That, for its part, the TRIBUNAL DE TASATIONS DE LA NATION has valued the movable and immovable property that will be transferred, together with the frequency assigned to the station whose privatization is currently available.

That, for this purpose, the call to contest authorized by the present of the provisions by Decree No. 1151/84, through which the National Broadcasting Plan approved by Decree No. 462/81 was suspended.

That the legal service of the FEDERAL COMMITTEE OF: RADIODIFUSlON has issued the corresponding opinion.

That the present measure is made in the use of the emerging powers of articles 99, paragraph 1 of the National Constitution, 3rd and 39 (a) of Act No. 22,285 and 11 of Act No. 23,696,

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1-Authorize the FEDERAL COMMITTEE OF RADIODIFUSION to call a public contest for the purpose of awarding the corresponding license for the installation, operation and exploitation of a sound broadcasting station by modulation of amplitude in the city of MENDOZA, province homonymous, which will be identified with the distinctive sign "LRJ 208" (ex LV8 RADIO LIBERTADOR) and issue 780

Art. 2o -The public contest referred to in the previous article will include the installation, operation and operation of a sound broadcasting station by frequency modulation, also located in the city of MENDOZA, the homonymous province, which will operate in the frequency of 92.7 Mhz with a PRE=40 Kw and HMA=150 mts, equivalent to category "B" and identified with the distinctive sign "LRJ 300".

Art. 3°-Authorize the FEDERAL COMMITTEE OF RADIODIFUSION to develop the Pledges of General and Particular Bases and Conditions that will govern the relevant contestant acts.

Art.4°-Except as provided by Decree No. 1151/84, through which the National Broadcasting Plan approved by Decree No. 462/81 was suspended, to the public examination authorized by the present.

Art.5°-For the opening ceremony of the tenders received, please refer to the intervention of Mr.

Art. 6°-Give the government of the province of MENDOZA, in the procedure of privatization provided for by this decree, the participation provided for in article 11 of Act No. 23.696.

Art. 7°-Contact the Bicameral Commission established by article 14 of Act No. 23.696.
