Authorize the Ministry of Economy and Public Works and Services to make a new call to National and International Public Licitation to hire, by the Public Work Concession System, the construction, maintenance and exploitation of the Physical Connection between the Cities of Rosario and Victoria. Amendment of Decree No. 855/95.

VISTO Expediente No. 561-025748/95 of the Registry of the Ministry of Economy ARTWORKS AND PUBLIC SERVICES)S, the Nros Laws. 17.520 and 23.696. Decree No. 855 of 6 December 1995 and the Resolution of the MINISTERY OF ECONOMY AND OURS AND PUBLIC SERVICES No. 787 dated 11 July 1997 and

CONSIDERING:

That Decree No. 855 of 6 December 1995 provided that the Physical Connection between the Cities of ROSARIO (Province of SANTA FE) and VICTORY (province of ENTRE RIOS) was granted in concession through the National and International Public Contest.

That by Resolution of the MINISTERY OF ECONOMY AND PUBLIC SERVICES No. 498 of 12 April 1996, the relevant appeal was made pursuant to the decree.

That by Resolution of the MINISTERY OF ECONOMY AND PUBLIC SERVICES No. 787 of July 11, 1997, the only offer presented was rejected, corresponding to the consortium composed of the companies BOUYGUES SOCIEDAD ANONIMA, JAN DE NUL N.V., DRAGADOS y CONSTRUCTIONS SOCIEDAD ANONIMA, FOMENT OF CONSTRUCTIONS AND CONTRACTIONS SOCIEDAD ANONIMA

That the Physical Connection mentioned in the first Considering is of priority interest for the NATIONAL STATE and for the Provinces of ENTRE RIOS and SANTA FE, which is why it is necessary to have a new call for National and International Public Litigation, authorizing to that effect the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES.

That the subsidy for the previous call was provided for in Article 9 of the National Budget Act No. 24,764, and the new studies carried out raise the need to increase the grant in a timely manner.

It is also appropriate to amend Decree No. 855 of 6 December 1995.

It is appropriate to authorize the MINISTERY OF ECONOMY AND PUBLIC ARTWS AND SERVICES, to reformulate the technical, economic and financial parameters of the work, in order to facilitate its realization.

It is convenient to determine for this new tender, the validity of the documentation attached by the companies and consortiums presented in the previous call.

That the General Directorate of Humanitarian Affairs of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS has taken the intervention that belongs to him.

That the present measure is in exercise of the powers conferred by article 99, paragraph 1 of the NATIONAL CONSTITUTION, and Law No. 17.520, as amended by its similar No. 23,696.

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1Authorize the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICS to make a new call for National and International Public Litigation to hire, by the Public Work Concession System, the construction, maintenance and exploitation of the Physical Connection between the Cities of ROSARIO (Province of SANTA FE) and VICTORY (province of ENTRE RIOS).

Art. 2o-Replace article 2 (b) of Decree No. 855 of 6 December 1995, which reads as follows:

"b) The procedure to be carried out for the granting of the concession must include the qualification mechanism, Data Room and the selection of the concessionaire, which must be developed progressively, in a framework of transparency that allows the widest participation of the proponents".

Art. 3o-Replace article 3 of Decree No. 855 of 6 December 1995, which reads as follows:

The concession granted will not have guarantees or guarantees to provide by the NATIONAL STATE: it will not have minimum income or transit insured. The concession will be for all purposes contract at risk, with the exception of the grant to grant the concessionaire, which is set at a maximum value of PESOS DOSCIENTS DIEZ MILLONES ($ 210,000) on the part of the NATIONAL STATE. and a tender of PESOS VEINTE MILLONES ($ 20,000.000) to grant for equal parts by the SANTA Provinces. The grant will be disbursed during the execution of the work, as provided for in the concession contract."

Art. 4o-La SECRETARY OF ARTWORKS AND TRANSPORT OF THE MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, will include in the preliminary draft budget for the period 1998 et seq., the necessary credits to cover the contribution of the NATIONAL STATE, to the sum of PESOSCIENTOS DIEZ MILLONES ($ 210,000) in the present development

Art. 5o-Replace article 5 of Decree No. 855/95, which reads as follows:

"ARTICULO 5o-Found to SECRETARIAT OF PUBLIC AND TRANSPORT OF THE MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICS to establish and modify the schedule of actions according to which it will process the procedure of selection of the concessionaire".

Art. 6o-Authorize the MINISTERY OF ECONOMY AND PUBLIC ARTWS AND SERVICES, to reformulate the technical, economic and financial parameters of the work, in order to facilitate its realization.

Art. 7o-Authorize the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICS to determine that documentation accompanied by the companies and consortiums presented in the previous call will be valid for the new tender.
