Please see a system of personal forecasting contributions for personnel in activity with the military status of Gendarme.

VISTO was informed by the National Director of Gendarmerie, as proposed by the Minister of the Interior, and

CONSIDERING:

That the modification of the organic and foreseeable legislation of the National Gendarmerie, in accordance with the guidelines established by the State Reform Regime, continues to be studied and elaborated, in accordance with the institutional unit established by Decree No. 660 of 24 June 1,996, which was issued under Act No. 24,629.

It is necessary to provide and ensure the continuity and integrity of the payment of the assets of passivity, which that Security Force serves through the resources with specific impact that are obtained through the perception of the contributions of the staff established by Law No. 22.788.

That the fulfilment of the pre-paid obligation cannot be effected by the resources allocated on the basis of the current budgetary restriction, if no special conjuncture measures are taken to ensure that this predictive need is met immediately.

That the modification of the system of the contributions of the staff of the institution would reduce the necessary contribution by the National Treasury and at the same time specify its equalization with those carried out by the military personnel of the Armed Forces, in accordance with the principle of identity between the monthly assets subject to contributions with the personnel of Gendarmería Nacional, established in article 75 of Law No. 19,349, as amended by Law No. 20,796.

That in the case the normal procedure of sanctioning and enacting the laws cannot be expected, given the foreseeable nature of the matter in question and the specific need to give urgent satisfaction to the payment of the benefits.

That it is not possible accordingly. That the realization of the proposed measures be verified by the procedure envisaged by the NATIONAL CONSTITUTION for the sanction of the laws.

That the present decree is set forth in the General Agreement of Ministers and in the use of the powers conferred by article 99, paragraph 3, of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION IN GENERAL AGREEMENT OF MINISTERS

RIGHT:

Article 1- Note for the personnel in the activity of Gendarmería Nacional with the military state of Gendarme, the following personal forecasting scheme:

(a) The ONCE FOR SCIENTI (11 %) about the monthly and general supplements subject to contributions.

(b) The first month ' s TEN (10 per cent) of having monthly and general supplements subject to contributions of its new degree, of graduates of Schools, Military and/or Security Institutes of the Junior Staff who attend the category of senior staff and of the staff of seekers when promoted to junior sub-official, without prejudice to the discount established in the preceding subparagraph (a) for the previous grade.

(c) The difference of the first month of the monthly and general supplements subject to contributions, in the cases of promotion or change of category, when this implies an increase of such income of the activity staff, without prejudice to the discount of the ONCE per SCIENTO (11 %) the over the last income for the same concepts that he has perceived in his previous retribution.

(d) TEN BY SCIENTO ( 10%) of the first month of having monthly and general supplements subject to staff inputs entering as junior staff.

(e) CINCUENTA BY CIENTO (50 %) of the first month of the monthly and general supplements subject to contributions in the cases of highs of civilians in the telephones with professional functions of Gendarmería Nacional, in the category of senior staff.

Art. 2°- Please note a discount of the ONCE FOR SCIENTY (11 %) on a monthly basis as a personal contribution on the existence of retired staff and pensioners, who receive such benefits under the Act No. 19,349 (National Gendarmerie Act) and its amendments.

Art. 3°- Please note that a discount of 3 per cent of the monthly staff on the basis of personal input on the existence of retired staff and pensioners, who receive such benefits under the law prior to the Act No. 19.349 (National Gendarmerie Act).

Art.4°- Note a discount of the ONCE per CIENTO (11 %) per month as a personal contribution on the existence of the retired staff and that of the pensioners, respectively, in accordance with article 96 (a) subsections (1) and (2) (b), subsection (2) and (3) of Law No. 18.834 (of the National Gendarmerie); article 76, subparagraph (l), subsections (a) and (b)

Art. 5°- The amounts collected will constitute the resources with specific impact aimed at financing the expense required for the payment of the national Gendarmerie passivities.

Art. 6°- The relevant agency will provide the necessary resources that do not meet the discounts made to meet the monthly payment of the staff ' s passiveness of 109 preceding items, in accordance with the budgetary provisions set out in the Budget Act.

Art. 7°- This decree shall enter into force on the day of its publication in the Official Gazette.

Art. 8°- To give account to the HONORABLE CONCRESO DE LA NATION pursuant to article 99, paragraph 3, of the NATIONAL CONSTITUTION.
